Can a partner's drawings be more than money in his capital account such that his capital a/c shows negative balance at the end of the year(31st March)

sir, in one case, the court has awarded maintenance as Rs. 11,000/- rupees for her and her son, her husband is professor. now the opponent has filed a revision regarding quontum of the amount. but in fact the salery of the opponent is 40,000/- and he has also othe sources of the income such as agricultural land etc. revision is pending before the session court now i have file an application u/s. 125[3] of cr.p.c. now the difficulty is that, when court isuued notice on the adress of the opponent so, it returned as endorsement that, opponent is not residing at this address, while the revision which is filed before the session court shows same adress, in short he is trying to avoid the service of the notice, what remedy i have now?

Can a property on my name be posthumously "Gifted" to my children, living in the USA? Can I write a Will using the term "Gift" instead of "Bequeath/ Inheritance"?
The intention is that Gift does not attract much tax as Inheritance in the USA.

My daughter very very fair had been married about 8 years back to my own sisters son. From day one my son-in-law, his married sister, his mother harasses her on flimsy grounds. So many times the matter was compromised but about 18 months back she was forced out of the House at midnight along with her 2 year old son. She was not allowed to taken even clothes of her and son leave alone Jewellery. She came midnight in an auto away from house about 25 kms. We were shocked even after compromise from relatives, Community elders they were reluctant to take her back to their home. We thought being sisters son it may not be good to go to POLICE or file 498 etc., I Have given DOWRY, GOLD, SILVER and performed the marriage in a grand manner.This is my eldest daughter, 2nd daughter married and living with her husband at London happily with a son. Still I have to marry 2 daughters who are of marriageable age.fATHER-IN-LAW is dummy & cannot control his family. Now we received a Divorce Court Notice from Son-in-Law. Please guide us in the matter as to what cases we can put on them as they have scant respect for our patience. THANKS FOR THE GUIDANCE RECEIVED .

Is it mandatory to provide proof of visiting home town in case of availing Home Town LTC? Suppose the nearest railway station is situated in a different municipal area from the declared home town( for e.g. Howrah in case of Kolkata) is it mandatory for the claimant to produce a document to office as a proof of having visited home town even if railway tickets for journey from Hqrs. to the nearest railway station of home town has been provided to office? May the experts provide their valuable opinion in this regard.

she had file DV case along with Crpc. 125 case after filing IPC 498 & 376 case against me. I had win Crpc case as well Divorce petition on merits, in which Judge continue her maintenance under section 25 of Hindu marriage act. on this decree she has taken a stay. then after 5 years she completed LLB & now file interim application to order to draw shridhan, but the things she rout, which are not given to me, as well all jewellery she had taken with her when she left my home without intimation.
hence request that please tell me the case law that can elaborate that, No interim order can be passed until & unless matter is not heard & demanded things has to be proved.

A person has purchased an agriculture land having area 50 kattah vide a single deed.
Now he has mutated and converted 40 kattah of land (part) and approached for loan to create an assets on converted land.
As such, in a single deed having agriculture land and converted land also. Party want to mortgage only 40 kattah land (converted)
whether we can create equitable mortgage by deposit of aforesaid title deed ? and enforce sarfaesi on that

Supreme Court of India in Civil Appeal No.9096 of 2013 titled Union of India & Anr. Vs. National Federation of Blind & Ors dated 8.10.13 has provided reservation in promotion for persons with disabilities in all Groups and endorsed it in SLP(C) No.9473 of 2011 in MCD Vs. Manoj Gupta dt. 10.12.2013. Hon’ble Supreme Court of India has also dismissed the SLP arising out of final judgment order dated 4.12.13 in PIL No.106/2010 passed in the High Court of Bombay in Union of India Vs. National Confederation for Development of Disabled dated 12.09.2014. Despite this Department of Personnel is not implementing reservation in promotion for persons with disabilities in all Groups . What action needs to be taken by all employees with disabilities. Kindly suggest how we can get this judgment implemented by the Government? Kindly suggest what should be done? It is a social cause for persons with disabilities.

I need your suggestions please....
My marriage was held on 2010 at kolkata & my working place is haryana. I have a son 2.5 years old.
I filled sec 9 rcr on 2012.Wife reply with sec 24. I filled sec 26 for child visitations. Sec 24 result come Rs.8000 per month ( Rs.5000 for wife+ Rs.3000 for child).Sec 26 order in favour me but wife never followed this Order. Court reconciliation failed, wife says,husbent not willing to take responsibility.
I submitted all my evidences, which was granted in court, also continuing maintenance money to her.
In argument stage, i appear so many times but due to slow processing & her lawyer absences .......i lost my hope.
My wife also not having any intention to cope up.She also never allow me to see my son.Now she is join college without inform me and enjoying her life as a unmarried woman.
So, i lost my hope and discontinued my sec 9 on sept 2014 But till date, i am giving maintenance Rs.3000 for my son.
I have all these money order recipes.
Now, my wife filled sec 125 with so many false aligation. She states that i never paid any maintenance at any time.
It is very difficult for me to fight sec 125 in every month at kolkata.
My current salary is 23k and my parents are fully dependent on me.
1. What should i do now?
2. If i not face sec 125, then what willbe the effects and when it will execute?
3.On which basis judgement willbe passed?
4.Should i move for divorse?
5.How could i restrict to trasfar my divorse case?
Ntc 1959 query
I have home which construct in 1995. At that Builder Register One NTC under Bombay Non trading Act 1959. Builder Constructed some illegal construction which still unsold at current. He also not pay some legal dues also. My first query is that after abolish this law what the status of this NTC Second can we start to operate this NTC if builder not handover to us. The Property situated & Register NTC is in Ahmedabad Gujarat. Please reply me
