Procedure

I filed section 9 of Hma act. in 2010 and the same decree was awarded in my favour.
In 2014 my husband file appeal in punjab and haryana high court.

My Query : Can i file section 24 application in said appeal for maintenance.

dalit muslim taking sc reservations or not

I am dalit Muslim. My cast is taral this cast is included in sc reservations in maharashtra. I taking sc reservation or not. Currently i am open category due to all school and revenue record is taral. Which decisions of suprim court of this matter please tell me

Divorce

My divorce case is pending/running since 2004, in last few months the court conducted 3 counseling procedure as per rules. Please tell me how much time more court may take to finalize the case as per provisions.

Also please tell me whether there is any provision that I have to pay court expenses/fees borne by her till date... as I have filed for divorce.

Quashing false declaration suit in high court

My grand father is having 3 acres 13 guntas land. out of which, 10 guntas land was acquired by government to construct road. My grand father's aunt filed civil case against government in bangalore civil court, as her land measuring 2 acres 04 guntas was also acquired for road purpose. During evidence in Bangalore civil court she said entire 3 acres 13 guntas land is my grand father's share, which is true. and order was also passed in my grand father's favour. and compensation for 10 guntas land was awarded. Now recently the same lady has filed Declaration and injunction suit in another civil court saying she is the owner of the land for 3 acres 13 guntas land which belongs to my grand father and has no record in her name, she has suppressed her statement which was given in bangalore civil court. Our counsel submitted rejection of plaint under order 7, rule 11 of CPC. But Judge did not allow it. Now my question is can we go for quashing of this declaration and injunction suit in high court based on her statement and her children's statement in bangalore civil court, in which they have clearly said 3 acres 13 guntas land belong to my grand father. Which is mentioned in the order copy too ?

मेरी बहन की शादी पिछले अप्रेल महीने में एक तलाकशुदा व्यक्ति के साथ हुई है, यह शादी रिश्तेदारों ने तय करवाई थी, शादी तय होने के बाद अचानक ही लड़के की माँ ने हम पर दबाव डालकर दहेज़ के नाम पर एक लाख रूपये अपने बैंक अकाउंट में जमा करवाने को कहा, मज़बूरी में यह पैसा मैंने अपने अकाउंट से लड़के की माँ के अकाउंट में ट्रान्सफर किये,

शादी होने के दुसरे दिन जब मैं लड़के वालों के घर अपनी बहन से मिलने पहुंचा तो वहां पर लड़के की माँ और भाई ने मेरे साथ बहुत ही अभद्र व्यवहार किया और मुझको मेरी बहन से मिलने से साफ़ मना किया, साथ ही मुझे धमकी भी दी की कम दहेज़ देने के कारण इसकी सजा वो मेरी बहन को देंगे और मुझे अपने घर से भगा दिया, इस बीच लड़के का व्यवहार भी ठीक नहीं रहा, मज़बूरी में मैं अपने घर वापस लौट आया, रिश्तेदारों और परिवार के लोगों ने मुझे समझाया की सब ठीक हो जायेगा वे बात करेंगे, पर कुछ भी ठीक नहीं हुआ, मेरी बहन के ऊपर कई प्रकार की बंदिसे उसके ससुराल वालों की तरफ से डाल दी गई, उसको किसी से भी बात करने की इजाजत नहीं थी, उसको अपना फ़ोन भी इस्तेमाल करना सख्त मना था, हम अगर फ़ोन पर बात करना चाहते तो उसको घर के फ़ोन में रिकॉर्डिंग लगाकर बात करने को दिया जाता, या उसको सबके सामने खड़ा हो कर बात करनी पड़ती, इस दौरान जिस लड़के के साथ शादी हुई थी वह भी घर पर नहीं आता था, लड़का अत्यधिक शराब पीने का आदि था और ज्यादातर समय घर पर से दूर ही रहता था, उसकी तरफ से कोई भी सहायता या सहानुभूति मेरी बहन को नहीं मिली, हमें ये भी कहा गया की लिख कर दो की अगर तुम्हारी बहन को कुछ हो गया तो उसकी जिम्मेदारी ससुराल पक्ष की नहीं होगी, इस प्रकार किसी तरह 15 दिन बिताने के बाद मैं अपनी बहन को मज़बूरी में मैं अपने घर ले आया, जिसके लिए भी मुझे काफी जद्दोजहाँ करनी पड़ी.

इस बात के लगभग एक महीने से ऊपर हो गए हैं पर मेरी बहन के ससुराल वालों ने एक बार भी उसका हाल समाचार पूछने के लिए कभी फ़ोन नहीं किया, मेरी बहन अब वहां जाना नहीं चाहती और हम भी अब वहां भेजना नहीं चाहते, कृपया करके बताये की क्या उपाय बचे हैं और यह भी की मेरी बहन को गुज़ारा भत्ता मिल सकता हैं या नही.

meaning of "kulmukhtyar patra" & its validitity

Dear Sir/ Madam,

What is the Meaning of "Kulmukhtyar Patra"
& its Validity for future reference.

if X person who want to buy property on others name who is his relative,in such as case what should do the X for obtaining of Legal rights & authorities for the same property for future precaution.

if,such person denies & says that the property is belongs from me,but it was not actual.

Intercountry family adoption

But sir my question was different . Will you please guide me?
My question is * when there is intercountry family adoption is took place is it mendatory to fulfil all criteria as per the hague convention??

Pagdi system

One of our neighbours had bought his flat on a pagdi system 40yrs ago.He was made to pay the pagdi for 3 months along with the purchase price of the flat and the land lord transferred the flat from the name of the old tenant to his name. A paper which was not a stamp duty paper but a simple paper with the sign of all the three parties with the receipts of 3months pagdi was handed to our neighbour. He has now lost the same paper and the land lord has expired. His heir is unaware of all this. Is there any way wherein our neighbour can get some proof of his tenency. He has the receipts of the pagdi paid to the land lord through out these years. Thank you

Deemed sealed cover procedure & reversion

An Officer, who was serving as Assistant Commissioner, was promoted as Deputy Commissioner on ad-hoc basis with effect from 1.8.2013.

The Departmental Promotion Committee for regular promotion to the same post met during July 2014. The Officer has been the senior most of the two officers in the one of consideration. Five posts of Deputy Commissioner were vacant.

The promotions, as recommended, were approved by the Minister in the last week of July. However, the said officer was placed under suspension pending disciplinary proceedings on 1/8/2014.

On the other hand, the other officer (who also was promoted on ad-hoc basis with effect from 1/8/2013) was promoted as Deputy Commissioner on regular basis on the same date.

The suspension was not continued beyond three months, no charge-sheet was issued but the suspension was revoked on 1/11/2014 and on the same date the officer was transferred in the capacity of Deputy Commissioner to another place and he has been functioning in that capacity.

However, on 21/7/2015 he has been reverted as Assistant Commissioner stating that the recommendations of the DPC in his case is deemed to have been kept in the sealed cover.

Till date no charge-sheet has been issued.

In the light of the facts, can the reversion be judicious and in accordance with the extant norms? What are the grounds on which he can seek judicial remedy?
