156(3) cr.p.c.

Some one files an application u/s 156(3)cr p c on June 2014, after hearing it was dismissed. After that the person hiding previous application filed the same application in same court just a year after that was also rejected on none present ground. Then he files the very same application in superior court stating that the very previous application was rejected on none present ground and here he also hide the fact and dismissal of first application.What is the remedy available for the person against the application is filed?

Calculation for closed garage for redevelopment

I have a closed garage in the stilt of residential building in Mumbai. It was allotted by the Society few years after the building was made for a minor consideration. Garage is not registered.
Our society is now going for redevelopment. Can I claim garage area to be added to my flat area? Can I also get additional FSI for garage?
Please guide practices normally adopted by the builders. Thanks.

Exparte decree

Sir,
A will was written by the property owner Mr.A in the year 1966 and it is registered. In will the matter is like this "After his death his property should enjoy 50 percent by his wife and 50 percent by his brothers children". Mr.A was expired in the year 1970. After that a clash arised between Mr.A wife and Mr.A brothers children on the written Will. Mr. A wife approached court against Mr.A brothers children filing that the entire property should belongs to her only(She dont have Children). The deponants attended only once in the court and didnt produced the registered will and they were not attended the court for remaining times. In the year 1994 The court has given judgement (Exparte decree) to Mr.A wife as she is the owner of the entire property, with out noticing the registered will. Based on the judgement I was purchased the same property from her in 2011. After 21 years of judgement, Now Mr.A brothers children approaching court with registered will for their share against Mr.A wife. Is it favourable for them if they produced the will now? Is there any problem for me and property purchased by me?

Filing of original suit

Bank gave loan Rs.18 lakhs to purchase diesel generator under Hypothecation agreement .Party has removed the generator set .Now it is not traceable.Can the bank initiate proceedings under RDDBFI Act or is it sufficient to file original suit i civil court for recovery of money Pls advise

Husband and mother creating problems after marriage

Hi, I got married to my lover through special marriage act and we got the certificate of marriage. Our formal engagement took place through parents' consent. Then we got married through special marriage act which was initiated by my husband. Right now we both are not living together after our register marriage. Our parents have fixed a date for formal arranged marriage on 7th Dec 2015. In between, both our families went for marriage shopping, in that his mother started demanding jewels, silk cloths etc.,My parents bought them everything. Our wedding mandap is fixed and my father had given advance for mandap too. Our marriage invitation card is ready and we informed all our relatives, friends and neighbors. Even they informed their relatives, friends and their neighbors. Both our families have common friends and every body is invited for our formal marriage. In between, there was a small fight between me and my husband regarding their demand for money.They want us to move in a new flat and want me to take care of all expenses of deposit,rent, household expenses, furniture etc, so I had small fight with my husband stating there should be equal partition of expenditure as I have EMIs to pay for. After that my mother-in-law called me up and scolded me saying "I will cancel the marriage, you should not try to contact my son. arrogant about my job and salary.My son hates to talk to you. I will make you and ur parents cry for this". We are not talking to each other for the past 3 days.Can I file a complaint for forgery, defamation, cheating case on them? Please advice me what is the legal remedy for me now. I am really fed up that even after marriage I am facing such situation where I am not able to talk to my husband, where we both are earning and I am asked to bare all the expenses. Since I was against that they are now creating a fuss. Please advice as soon as possible.

Residential Property Fraud by builder

Hi,

I need some guidance to file a case against builder.

We had made the booking by depositing Rs.2,90,000/- one year before through cheque and received receipt of the same.

Later on it came to our knowledge that place on which builder is commencing construction is illegal and its in dispute with high court of restraining any construction on the said property as it was alloted for agriculture purpose.

So i had applied to him for refund of my monies deposit while booking, to settle our claim of refund he gave us post dated cheques on installment out of which two got bounced and after that we have stop depositing his other cheques.

We had approached him again he promised me to pay but now he is delaying by giving illogical stupid reasons.

Kindly help me out in this case !!
