Interim Award vs Interim Orders

May I request experts to please let me know the difference between Interim award & Interim Orders in arbitration proceedings. If possible, please explain in detail. Searched the entire net but could not find an answer. Thanks.

How can we request court to break the house lock

Dear Sir,

A judgement is passed in my favor in district consumer forum due to delay in service. Accordingly i have done the balance payment but the builder locked the flat and he is not handing over the possession to me. I have already filed an Execution Application in the district forum but i would like to know if i can request the district forum to break the lock of the flat and handover the possession to me?

Need a settlement

Me and my friends were booked under section 353,332 and 34 of Ipc.
We had a heated argument with a bus driver eventually leading to the assault in bus depot. Even though it was the driver who started the assault we were the one who were arrested on spot ( bail granted) . It happened in july 2012. Even though we haven't started the criminal proceedings yet. We're looking for a settlement where the driver is ready to settle but here in mumbai after meeting with multiple lawyers we got multiple advice but nothing concrete some say out of court settlement, aur settlement through lok adalat is possible and some say it isn't. We're really in need for a solution to this Asap. Please revert with the best possible solution our career is at stake. Thanks,

Right of a tenant

Hi,
I run a shop of garments in AMRITSAR, on a rented premises from last 35 years. Besides me there are 6 other tenants running there businesses.The building has been sold by the owner to some powerful builder without any notice to us. We fear that the new owner shall try to evict us by using pressure techniques. So we obtained an order for permanent injunction from the civil court the next date for which is fixed for appearance.
May we have any guidance about our rights by some learned expert, we shall be grateful.

Sale of joint property without partition

A 60 marla plot is lying on the highway. This property of land is jointly on the name of 2 sisters and 3 brothers. Out of which one sister sold their part without the consent of the others. Can she sale the land without partition. What can they do (other members) in this situation. Please Guide. They go in the civil court for suit of partition or in the Tehsildar office for partition. Or any other remedy.

How to make payment to buy notice period?

I have the option to buy my notice period but the Agreement remains silent on 'mode of payment'.

Can somebody please tell me the fastest mode of payment and how to pay without any bank details of the company and also keep a record of the payment?

Please note that the payment terminates the contract and I need to do this soon. The co. is trying to hold me back from doing so. The person who signed it is not a party and cannot pay him. This is a Pvt. Ltd Co.

Order 39 Rule 1 and 2

Sir in a suit for recovery based on an agreement to sell a piece of land an application u/o 39 R 1 and 2 CPC was also filed with main suit.After consideration the application was dismissed by court stating the reasons " That the applicant has proper and specific remedy and recourse at law in that regard so as to prevent disposal of property to defeat the lawful claim or say decree as might be awarded in case he succeeds to establish the same in accordance with law �so this application at the outset does not appear to be maintainable and the same is meritless."Application stands disposed off accordingly being dismissed.Sir I want to know that as per order of dismissal of application what is the proper and specific remedy and recourse at law in that regard so as to prevent disposal of property ?

Commercial agreement/contract-applicability of indian stamp act

Is is necessary to execute commercial agreement on Rs 100/- Non judicial stamp paper? I understand that such type of agreements are covered by entry No 5 (c) of schedule 1 of the said act.
Can we execute such type of agreements on plain paper or company's letter head?

Non issue of certificate by Society committee

Hello All,

In today's AGM society decided not to issue share certificate to all the members who Dont have possession letter.

Even some of them submitted the possession letter & they said they require 3 letters.
1) payment made by us to builder with number details
2) declaration form
3) possession letter.

Since during my possession , I have found that certain construction was not completed, I have decided not to sign on Declaration form stating work was not fully completed by builder.

Since I Dont have declaration letter I was refused to issue share certificate by soxiety . Can somebody confrim what documents are required to issue share certificate & whether society managing committee have any rights not to issue share certificate on above document & what legal action I can take against society committee.

In cyber law cases what should be the questions on the technical points to be covered in the cross examination of the witnesses.expert and the Investigation officer? Whether any book for cross examination could be suggested by the Hon'ble members and experts for defending a criminal case related to Information Technology Act and the IPC?
