Dear Team
We are a building of 4 floors(Ground +4) with total of 20 members with 4 members on each floor. Age of our society as of today is 16 years. We pay a Maintenance of around700rs
Our Builder initially had plan to build 7floor building but since he could not get a necessary approval from authorities he settled on 4 floor.
While doing so he had made a provision of lift(Duct)(space for installing lift) in our building with no lift and he had sealed the open gaps with bricks on each floor. So now to install new lift all we just have to break walls on each floor
Now the issue is 12 members of out of 20 have agreed to install a new lift by asking a contribution of around 50 thousand per Flat.
8 members have strictly objected for installation (Ground and First floor). I am myself in this 8 members. Our Reason for objection is since lift duct was created by builder for 7 floors Contribution for buying new lift installing and maintaining Should not be laid on only20 members as cost per member increases.
Many of this 8 members are not so financially well off and also could not afford to increase Maintenance charges. Our objection is purely on Financially and on basis that since building did not have a lift for 16 years why now.
Since people in favor of Buying lift are more they are planning to pass resolution in Managing committee meeting and are going ahead by levying the same in monthly Bills. They are also ready to take 50000 rs in installments. There are several expenses like structural audit other then new lift cost which we think is not necessary since buiding is still deprived of basic things like cleanliness proper parking area water etc.
My question to you is now is there any way we 8 members can stop process of buying new lift or can we stop paying charges levied in monthly maintenance for buying new lift. Is there any legal solution for this.

A friend of mine was working with a reputed MNC and he quit when he got another offer from another MNC. however, the 2nd company took time to send the offer letter so he had to nove his last date in the 1st one. Suddenly the second one asked him to join and in between all this there was a discrepancy of 1 week in the relieving and joining dates. Now after 15 months of working he was fired suddenly with that reason of descrpancy. He is unable to find a job anywhere else due to that issue and the second company is not ready to move his dates and give him another letter. Can he file a complaint against them.

I filed a case against my employer for not releasing my salary and for not providing releiving and experience letter in labour court. Today they release my salary by a cheque but for releiving letter they told me to visit the office. I resign from the company on 27th july and serve a notice period till july 20th. After that i visited the office six times for this reason but they are not responding and finally i filed the case in labour court. They are accusing that your previous records are not clear after i completed my notice period then they told this to me. Earlier everything was fine because i am working there and following their work procedures and rules. Please help me if they ask me the same question again.

Me and my friends were booked under section 353,332 and 34 of Ipc. We had a heated argument with a bus driver eventually leading to the assault in bus depot. Even though it was the driver who started the assault we were the one who were arrested on spot ( bail granted) . It happened in july 2012. Even though we haven't started the criminal proceedings yet. We're looking for a settlement where the driver is ready to settle but here in mumbai after meeting with multiple lawyers we got multiple advice but nothing concrete some say out of court settlement, aur settlement through lok adalat is possible and some say it isn't. We're really in need for a solution to this Asap. Please revert with the best possible solution our career is at stake. Thanks, REGARDS.

Hi
Our society had provided POA to builder for demolition and reconstruction of flats.while builder is supposed to pay us rent till possession of apartment at Rs12k per month. The builder had a contract for 4 years to accomplish the same but nothing done in last 3 years.after demolition no work is started expect the CMDA approval.
However off late - for last 9 months builder is not paying the rent
The builder had also pledged some part of the land and he is also planning to sell some portion of land
The Societies president/treasurer are conniving with the builder and they may have a super authority sort of in the society.
What are the options we have (i presume this could be a irrevocable POA)
Please provide steps for
1) getting documents from bank in which its pledged legally
2) revoke POA
3) How to get forcenics analysis of society president and treasurer for conniving
4) how long these cases can go? what kind of expenditure we wil have to bear/how much (just an approximation)
Jurisdiction of 138 ni act cases ordinance status
Has The Negotiable Instruments Amendment Ordinance, 2015 which makes the jurisdiction of the 138 NI Act case to be within the city of payee bank passed in the Rajya Sabha yet? I need to file a cheque bouncing case. The payer bank is in Delhi while my bank is in Ghaziabad. Please inform.
