My friend is an accused in a Section 138, NI Act allegation. The first hearing was in August, 2015 at which he was given bail. After that there has been no hearing at all. So far 5 times dates have been fixed. But when he goes to the court there will be no hearing as no magistrate has been appointed to hear the case. It is not known how long this will go on. My friend is sure that the case is false and he can easily come out of it. But how to expedite things. Is there a higher authority in the court itself to whom my friend can complain? Or can he complain to the High Court?

Regarding rights of women in ancestral property there are two S.C.judgements. One is Gandhi koteswaramma case of 2011 and the phulavathi case of Nov. 2015. Which one would be followed ?
When the amended law says women become coparcenors at birth like men how does the date of amendment and father being alive at that date make any difference? It's not so with men. Pl.clarify. Some fathers live till 100 some die young. How can that factor be relevant? Has any women's rights group challenged it?
Dear Sir(s),
we are a company, For one award Ceremony we paid participation fees plus service tax, which was not due, the Organizer collected service tax amount from us, without having any valid registration for the same, now only they realize after one and half year , and when we claimed the amount paid as service tax, not due , they are giving several excuses for non -payment and avoiding it, we have sent a notice to recover it, under IPC 420,
Do we have other option also to recover our amount, like intimate to Commissioner of Central Excise and Service Tax with the evidence for proper legal action, we have only account entry for the payment, they have not issued us invoice, in spite of demanding several times.
We have email correspondence for the same .
Kindly help us

The valu of my flat as per ready rackner....is Rs..41 lakh...as on today....so if I gift this flat to my father...
How much would be the registation charges for registering gift deed ?
Any stamp duty ?
My grandfather had 2 properties.. 1 two storeyed building in salt lake in kolkata and another in south kolkata.. he had made a will which states that my grandmother will stay with her sons (my father and uncle) in the salt lake house and my aunt will be the owner of the flat in south kolkata..
he further mentioned that in the ground floor my father will stay with me and my mother and in the first floor my grandmother will stay with my uncle and after her demise my uncle will b the owner of the 1st floor. Now my grandfather passed away in 2015.. my father is not willing to stay in salt lake now. We have planned to give it on rent and stay somewhere else.
But my grandmother is saying that by the will we do not have the right to give it on rent but merely have a right to stay here. She claims to have the ownership rights and my father has a possession right only. She says she will be the owner of the entire property in salt lake. Further properties is salt lake are taken from the govt on lease. She further claims that the lease which was in my grandfather's name will become that of my grandmother now.
I want to know whether her claims are right or not.. just because it is written that my grandmother will stay in the property with both her sons gives her d ownership to the entire property? Because it is also mentioned that my father will stay absolutely in the ground floor.. if in boh the cases it is mentioned that they ( my grandmother and my father) can stay in the house then who will get the ownership to the ground floor?
The gift deeds were registered in 2009 at udaipur sub register office, udaipur gomati tripura 799120 and applied for mutation from my uncle's part.my grandparents raised an objection against the mutation appeal.Accordingly authority (d.c.m)postponed the mutation till now.the next date fixed for the hearing at s.d.m.'s court on 30 th january 2016.but my query is that if there any provision of law to get back my grandparents property.that advise of the local lawyer there is no chance to cancel the deed as it was given and sign by the owner of the property.another lawyer told that the date of suit a case to cancel the said deed were over.according to him case must be registered with in 3 yrs from information of knowledge about the deeds.the witness are making.the deeds are sign by a commission mentioning that the commission was hold our own residence but it was false. All the matters are making
I am charged under 3(1)(x) of sc/st (poa) act and 294 B. But the said offences was not done by me.
In addition to that, I have done Intercaste marriage, my wife belongs to ST and me belongs to MBC. Can the said offence is applicable to me.
Whether the witness 1 statement alone enough for convicting the accused?
In complaint, seven names were mentioned but in the chargesheet excluding all names only my name is alone mentioned in order to extract money from me?
This case is purely civil in nature? but misusing of the act occurred in my case and the criminal colour was given as mentioned by the Supreme court as "Legal Terrorism".
Kindly suggest me.
