Sir,
i had gone through your several posts and i m very much impressed with your logics and way of answering. This is the reason why i m sending you this mail in my hours of crisis. My Grandfather was serving as a teacher and
he had four children, two sons and two daughters. My father is elder amongst all sibling.since my Grandfather was working as a teacher , so he use to come home town occasionally. In the absence of my Grand father ,my
father was performing the role of guardian(KARTA OF A HINDU FAMILY).My father had performed all his duties and responsibilities with honesty. He never used any means to get personal property. As a KARTA of a Hindu
family he had done the rituals of my Grandfather and Grandmother, done the marriage of both his sisters and brother(my uncle),built a house on ancestral land and supported whole family by all means(my mother was
a teacher and she had paid for all those things).Even my father helped my uncle financially when he was studying(now he is a professor in a college). My father sold some pieces of land at the same time he purchased
some pieces of land also, when my Grandfather was alive(he done all these things with the permission of my Grandfather only and all purchased land is registered in the name of my Grandfather only). Now the situation
has changed and my uncle has filed a partition suit in the court of SDM and made his both sisters shareholder in the ancestral land(Although sisters are not in the favour of taking any share as they are satisfied with what they
got during marriage and they are in the favour of my father, they can give it in written also).
NOW MY QUESTIONS ARE:-
(1)My father has not received the partition suit notice filed by my uncle because he was not available that time(although my father has a copy of that).what happen when he will not receive notice again and again??how he can
avoid to receive the notice???
(2)My Grandfather`s Grandfather had 120 acres of land and he had two sons (one my Grandfather`s Father and one more).60-60 acres of land were divided between my Grandfather`s father and his brother.my Grandfather was
two brothers and each of one got 30-30 acres of land.but all the partition was done verbally and not by any court also there was no written agreement made.Till now even mutation was not done and all the lands are in
the name of my Grandfather`s Grandfather only.In this situation how partition will take place??will it start from my Grandfather`s Grandfather???
(3)My uncle wants to get 1/4th share in the land which my father had sold when my Grandfather was alive(with my Grandfather`s permission only and sold land value was used to purchase other land).
Is it possible that my uncle will get share in that sold land???
(4)My father`s both sisters are not interested to get any share in any land. They are willing to give it in written also.but my uncle had made both of his sisters share holder without their knowledge.in fact by doing this
he wants to pressurise us.How my father should go ahead in this case???
(5)What remedial actions should be taken by my father in this situation??From where to start and to whom he should approach??
(6)We want to settle this matter first through talk and then by court.but my uncle is very egoist, he does not want to talk.he wants to pressurise us by partition suit filed by him.how the process of partition can be delayed
(so that,He can come to know the practical thing)s???how much time we should take to respond his notice???
(7)My uncle had occupied the house built by my father on ancestral land also and not willing to give our share(land is registered in the name of my Grandfather`s Grandfather only).what course of action should be taken
in this situation??
Thanking you and waiting for your precious reply.

Dear Friends,
My father and his brothers passed one decree in 1979.unfortunattly that decree is not registered at Sub-Registrar's office to claim partition as per Decree.
Yesterday I visited Sub-Registrar office to pay registration fee in order to claim partition as per decree, but that officer refused to register he said 35 years are passed and he dont have rights to register that decree. Now I am blank actually I know only this process that decree registration and claiming partition in revenue office.
Please advice me how to get claimed partition before 35 years in a decree.
Is any way to register said decree of 1979 by paying late fine ?
Is any legal way to get order from court on that decree to revenue department for partition ?
Is it necessary to register each decree at sub-registrar office in any time frame ?
Please help me your words are more valuable for me.
Regards,
Ajit

A candidate had been debarred form a university for a certain period. later he completed the degree. and took master degree too. does this makes him unfit for the government job? There is a question in attestation form "Have you ever been debarred from any Examination or restricted by any University or any other educational authority / institution ?" what should we answer here?

Respected Sirs,
My husband was implicated under false charges in a sexual harassment case by our neighbor who is a retired police official.
The retired police official has made illegal construction and we followed the due process of law and got the civil suit awarded in our favor. The authorities have undertaken only partial demolition and to prevent the filing of the execution petition, the retired police official has made an FIR using his connections. The sections are: 354 (c), 354 (d) 506, 509.
1. The police did not call us even once for any investigation even after seven months of filing such FIR.
2. On our own we went to the local PS and requested them to close the FIR. Though, they agree to close the FIR, they are not doing the same.
3. We made a formal representation with full details to the DCP of the area and requested for early investigation and closure of the FIR. No action by them.
4. We also filed a petition in the local court and asked for the status report.
To this, the IO has replied that the complainant has given a statement under section 164 before a magistrate and the investigation is On. But in reality, nothing is going on and we were never called to the PS till date.
Kindly clarify:
1. Our understanding is that only the accused gives the statement under 164 to the magistrate. Whereas the complainant has given. What does it mean to us?
2. Can we request for the copy of the statement made by the complainant under 164?
3. Is that the complainant wants to withdraw the FIR and hence they approached the court for the same and gave a statement under 164?
4. Can we go to the high court for quashing of the FIR since it is more than seven months and we have solid evidence to state that my husband was not even present on the said incident stated in the FIR?
5. The retired police official is in property business and undertaking illegal construction elsewhere also thereby misusing his past positions by influencing the local PS. Can we request the court for stopping of his pension?
6. Understand from reliable sources that during his service there were several complaints against him and was even suspended. Can we request the court to get those past details from his service record? - just to present the court that he is a habitual offender of misusing his authority.
7. What is the maximum time limit to file an execution petition in a Civil Suit?
Our sincere thanks to this forum of experts for their excellent help to the general public by taking their valuable time.
My apologies for the inconvenience caused.
Thanking you all,
Mrs.Raj Gupta
PS: Some gentlemen asked how come Tripathi becomes Mrs.Raj Gupta - Tripathy is my fathers surname and I am married to Shri Raj Gupta.

Myself Rajeev from Pune. My brother has obtained the POA from my Father & Mother by cheating them. POA is for the property that was purchased by my grandfather. Grandfather died without any will. Property is divided by all the legal heirs. I am the son of one of the legal heir.
The POA is registered.
I checked with mother and asked her whether she has signed such document, but she denied. She stays with my brother and hence she may not go against my brother even after she get to know about it later. Now I need to check with my Father. Even he stay with him. My brother manages all their expenses. They both trust him. I have following question on this.
1. Can I lodge a police complaint against this?
2. May be they both or one of them is aware about it but they are under some pressure. Not comfortable to tell me. What should be done about this?
3. Can my brother dispose off some properties of my grandfather using the POA?
4. What is the process if I need to challenge the POA?
Consumer forum complaint against telenor(uninor)
Hi All,
In recent past I faced a small issue with my Internet service provider (Telenor India).
I have emailed my concern to their customer help desk team and also to appellate authority. I have sent the screen shots of issues I faced while trying to recharge my mobile for internet offer ONLINE.
Initially they did not responded for 2 days. In anger I have used a single word (IDIOT) against them in a email. (I have that email copy with me)
Now the issue got side tracked and they replied me saying that I have hurted an women employee(whereas its not true). and the main issue got side tracked.
I have copy of screen shots about issue i faced and also emails I have sent and also remainder emails.
1)In any way can you guys help me to win over Telenor India. Even though amount is very less I want to teach a lesson that they have to improve their services.
2)Can filing a complaint in Consumer forum website help me with this ?
3) Any other thoughts/suggestions ?
