good morning
I have approached court for divorce and custody of the child, wife has filed for MC u/s 125 crpc (after divorce petition) but she has never appeared in court MC process and court has issued NFT which is going to happen next monday. In her MC application she has mentioned that she is unemployed but in fact she is working somewhere but i am not sure whether she got the job before or after filing the MC. so far there is no order for Interim maintenance but am paying for the child.
I have filed counter in MC stating she is employed somewhere.(I do not have documents to prove this but sure she is working) and a copy of the MC she has filed before in High Court to transfer divorce /custody petition . she did not even produce high court order before family court to move files to court near to her residence , finally i have done that . is this a contempt of court ?
I would like to pursue the case against her , though her MC may get rejected if she do not turn in the next hearing.
under the above circumstances may I request your feedback on my queries please
1. when the court rejects MC due to other party absence, does that mean my argument -my counter is accepted by the court , can I base that to apply for further legal action
like defamation /or what other case can be filed against her for lying and mentally torturing me and my mother by stating false charges,
2. Do I have opportunity to State before court in next hearing(NFT ) that she is working somewhere and required further examine ?/ asking her bank statement as proof for fund transfer from my side.(paying for the child now too) she has claimed i have not paid anything.(does this apply if she do not appear ? )
3. If her MC gets rejected due to her absence do I have still scope for perjury against her ( but I do not know when she has got job but sure when high court order came she has job.)
4. is perjury is applicable only to her or also against her relatives for conspiring to state false things to get undue advantage.
5. If i gets her employment details before next hearing which is NFT , can I submit the same on the same day of hearing stating perjury (if at all )
if i gets after court dismissing the MC, can I still produce the document and request for perjury ?
7. any other suitable remedy under the law to prevent such kind people harassing people like me
8. Can I seek information from her employer about her employment status , after MC gets rejected is there any legal issue in that.

My friend take Notarized divorce dose it legally or they have to go through court and have to file and take dikri.

I am living in jamnagar at registered co.op. housing Society. Society had collecting maintenance charges on monthly basis, and it is paid by us time to time .
In 2012 Society had collect rs. 35000 per flat (total 36 flat) for renovation of all the the 3 buildings. I had paid rs.10000 as first installment after that renovation of my flat is not done properly so that I had protest and not paid remaining renovation fund. What ever maintenance charges was paid by me that the had consider as my part payment and they charge 1.5% compounded
interest monthly, my demand is that to complete incomplete renovation of my flat and I will pay my un paid part.
Now Society is giving me notice to pay all the dues with 1.5% compounded
interest monthly or otherwise we will cutoff your basic services like water supply and swiper service. Municipal water connection on my name and municipal water tax paid by me. Water connection is in common water tank.
In this situation can they cutoff my basic services? and what action I have to take? Please guide me.

In a case where a single girl child's both parents had died and she cannot locate the registry papers of her house, what is the procedure to get the papers and also what Is the procedure to get that property transferred on the girl's name.
The property is under the name of her mate mother.

1- If a person or his/her lawyers submit a wakalatnama with incorrect/misleading information, does that wakalatnama is valid in the local or high courts.
2- My ex wife has field a similae wakalatnama in local and in high courts. Her signatures appears on the documents but the date which is on the documents and her signature. She wasn't even in India at that given date.
3- Also her father who is also a witness in the dowry case, is filing papers/documents/affidavits on behalf of her daughter. She is NEVER in India but her father is harassing me by filing appeals/motions etc etc. Can he do that? I don't see my ex wife ever giving him any written authorization to do anything.

Sir, my friend belongs to schedule tribe. He got married in 2011. His marriage was without taking dowry. His wife started to create nuisance and problems in his family, like senseless fights with husband, relatives & in-laws. She has been living with her parents for last 3 years. In the mean while, she filed complaints against him, his parents n relatives in police station like under section 406. Later the police after investigation found that the alleged complaints were false and filed just to harass my friend and his relatives. My friend n his relatives did their best to reconciliation between him n his wife, but all in vain. Since my belongs to ST community and he can't go for divorce under Hindu Marriage Act, he went to his community elders as per custom prevailed in his community. After hearing from both sides n making numerous failed attempt for reconciliation, elders decided for divorce. They gave their decision in written to my friend. This happened few months back. He consulted few lawyers, he was informed that getting a decree of divorce from the court in his case is not necessary as he belongs to ST and divorce are done based on their customs only.
Now my queries are:
(1) whether my friend has to go for any kind of decree from the court even when hindu marriage act is not applicable to him?
(2) if yes, then how and what should be the approach for it?
(3) if No, then what should be done so that false cases against him like dowry etc can be avoided, as the probability of filing false case by his former wife always be there.
(4) whether can she file maintenance case against him even after customary divorce? (5) whether cases like dowry , domestic violence can be filed after divorce?
Sorry for the long list of queries. I have to ask these queries as my friend has been receiving threats from his former in-laws n wife of various cases & due to this he is mentally very disturbed & depressed. He already suffered alot since his marriage.
Please advise over the queries above at the earliest.
