Recording on mobile phone

The length of the title would be much longer to make it appropriate query.

However what I want to know is this.

The conversation between the consumer forum president and myself is recorded on mobile phone.

The conversation is as below:

If I given orders in favour of you, tomorrow morning 500 complaints will come and fall in my forum. I don’t have time to finish the pending cases. If 500 complaints come and fall in my forum, who has time to read all those complaints? The government should open another 10 forums in Bangalore itself with the existing 6 forums to dispose of student grievances. He also said that even his son failed and his son applied for revaluation. Neither his marks increased nor decreased, so what can be done, nothing he told. I pleaded further that let him please help me out. He told why should i help you? Whether you pass or fail or go to some other court is your lookout, not mine. He then asked if I have any citation. I had one, I gave citation stating student is consumer and revaluation of answer papers come under consumer forum.

He after two more dates dismissed my complaint giving following reasons:



My consumer forum complaint was dismissed stating that I have challenged the evaluation system of Bangalore University and Bangalore University College. By going through the reliefs sought for the complainant and the pleadings, this forum finds that this case requires detail trial by recording the evidence of both parties as if it is a regular suit, this forum being empowered with summary trial only, thereby all the questions involved in this case cannot be adjudicated in a summary trial. Hence the complaint is dismissed. The complainant is directed to approach the competent court of law necessary reliefs.

My questions are:

The entire conversation between the judge and me in recorded on my mobile phone. While the other two judges did not speak on all the dates. Only the judge sitting in the middle spoke.

The judge simply did not want to entertain my case fearing that all students like me will come and file complaints in consumer forum.

Now can I go for appeal in state consumer forum using the above conversation recorded on mobile phone?

Release of mortgage

My aunty took loan from a person by mortgaging her housing property. She died about 10 years back. Her son came to know of this only when he wanted to sell the property, that the documents are with this lender.

As he could not approach the lender, he approached an advocate for release of the mortgage. Honorable court gave a verdict for payment of the loan amount along with interest (amount & interest specified by the court) by a specified date (20-05-2018).

Now the question is if he pays the full amount as per the verdict of the Court, will he get the Property documents from the lender or he needs to approach the court to obtain the documents? What action he needs to initiate to get the de-mortgaged documents from the lendor.

What actually the judge told me was:

This happened in 3 dates. Fourth date my complaint was dismissed. Although I had searched for another citation where it is told that Supreme Court has not completely barred any student from approaching the consumer forum with a grievance.

What he gave in writing is as below:

My questions are:
Now can I go for appeal in state consumer forum?
What is competent court of law?
Do I need to pay fees again in state consumer forum?
Do I need to make 3 sets of copies for 3 judges in state consumer forum plus one copy each for each of the opposite parties?
Or a simple letter stating the above would be sufficient in a appeal letter asking the state consumer forum to look into the matter?

It was informed through written statement by College authorities in Consumer complaint No..... (Please reproduce verbatim all the CA statements made by them)

Information solicited:

1.Please provide documents / data -the basis on which above statements are made in a consumer forum against the applicant.
2.Please provide the name of the concerned employee that drafted or agreed for the draft .
3.Please provide relevance of those personal allegations in Consumer complaint which was filed on deficiency of services as written statements gives wrong signals that Colelge need not provide services, if there are some other false allegations against the consumer.
4.Please provide certified copies of those remarks / office notes showing action taken on those complaints / allegations by college authorities till now.

False Signature on Resignation form

Hi Sir/Madam

I am from Satna (m.p.). My father used to work for a Cement Company (nearly 30 years). My family lost him due to negligence of the hospital. My father was fighting for the case of his false signature on Resignation Form which he didn't sign and during this he lost his life.

He filed the case against one person who has forged the signature. The company has thrown out that person for some other reason and he is no longer working with them.
Also the company is now asking us to take back the case oresle they will not give the PF and Gratuity.
On the PF form it's written that the reason for asking the PF is resignation which my dad didn't sign and was fighting for it.

Also, the police is not submitting the case file and forensic report to the court due to which the case is getting delayed from past two years.

Please help and guide me for the same.

Forcefully Dispossesion when stay order is in operation

Sir,
Civil suit is pending in court, court orders to maintain status quo,But respondents dispossessed us from suit property.
We file contemp petition under 39(2) which is pending.
Now We file application under 151 cpc for restoration of possession with the main suit,while argument on our application under 151 cpc court prefer to argument on our pending civil suit.
My question is which case should be argue first application under 151 cpc Or civil suit.
Is there Any judgement delivered by upper court.
Help me

Suspicious/Fraudulent Activities happening in my Company

Respected Sir/Madam,

I work as a Travel Consultant in a Backoffice located in Thane of a UK based Travel Agency whose main office is in UK.
I joined this company in Feb 2018. But after joining this company I found thay they are involved in doing lots of fraudulent and suspicious activities.

For Example: From our Backoffice we handle flights/airlines fare quotation enquiries, seats availability, make reservation for UK and Indian passengers on call and collect all payment details on call or thru email. But after collecting payment or charging the passengers debit/credit card they dont issue their Tickets and almost in all cases they issue tickets only one day before the departure date of travel of passengers and if any passengers calls requesting for their Electronic Tickets copy then they fool them by sending them just the Itinerary Copy of their trip. Some of them who dont have any knowledge about all these things gets fooled but some of them who are intelligent they tends to argue and insist us to send the correct tickets. But inspite of receiving the payment the Directors of this company who sits in the UK office force us to tell lies to customers by giving some reasons to give them a hope and try to convince them that they will receive their E-Tickets very soon.

Example 2: If a Passenger done the booking 4 to 6 months in advance from their travel date and made the payment thru Bank Transfer or thru Debit/Credit Card and as usual after receiving the payment they just send the itinerary receipt and later on if the passenger wishes to cancel their reservation or do some changes then as we handle UK Point Of Sale so they Charge 275 british pounds per Passenger as a Cancellation Fee and 225 pounds as a Date Change Fee per Passenger plus fare n tax difference if any. But in reality these Charges will be applicable on passengers whose tickets are already issued and not at all on those passengers whose tickets are not issued so the entire money goes in the management's pocket.

Example 3: When a passengers make the reservation and does the payment by personally visiting our Slough and Lester offices in UK so at that time they collect the payments and issue tickets and give them the tickets printouts but as soon as the passenger leaves the office or on the same day they Void the E-Tickets and issue the fresh tickets with new ticket numbers one day before the passenger travel date. They does all such fraudulent practices bcoz they knows that if a passengers does the flights bookings 3 to 4 months in advance then there is a possibility that he/she might need to change or cancel the reservation before the travel date and this means the company will get bonus income and they wont have to share it with the airlines concerned due to non-issuance of original tickets.

Example 4: If a passenger has done the booking and later on due to some reason opt for cancellation then they dont give the refund amount of their tickets easily and keep irritating the passengers by repeating the dialogues that our agency have not received the refund amount in our account from the airline side thats y we are unable to give the refund to pax but in reality it takes max 3 to 4 weeks to process refund but they makes us inform the passengers that it will take 12 to 14 weeks to receive the refund amount. And inspite of the fact that they receive refund from the airline the Agency's Management staff choose to delay the refund amount to pax.

Right from the time I have joined this company I have came across lots of different above given scenarios where the management has laid guudelines to cheat the passengers by making its staff tell lies to them and we have to obey their orders without objecting to it. My Travel Company is an Iata recognised Agency and they have the Ticketing Authority of only 2 Airlines that is Jet Airways and Air India as these 2 Airlines operates lots of flights especially between UK and India and their Flights Tickets price are Cheaper than other Airlines who operates either only one flight a day or very few flights per week. So as per the management we are instructed to offer and give first preference to the passengers for AI and 9W flights options for their fare quotation enquiries and if pax agrees to the quoted fare then our Agency management gets to fool lots of passengers by implementing on the above given scenarios tactics.

In the last 3 months Me and my Colleagues have attended Calls of different passengers who went to the London Heathrow and Birmingham Airports by carrying the E-Tickets which they collected from the Agency office at the time of doing the payment but after reaching the Check-In Counters they found that their tickets are not valid for travel means it is a Voided Ticket so these type of passengers gets angry and frustrated and contact us demanding for clarification regarding y their tickets were voided and issue/reissue fresh tickets for them asap..!! And some passengers even gives bad words and says that your travel agency are involve in some suspicious activities and we will report to Police or File a case in Court against the Company for their actions.

I have earlier worked in other Travel Companies as well and I know that companies always keep a profit margin on the amount of flights tickets they sold to passengers but I have never witnessed such type of cheap fraudulent and suspicious activities in my professional life journey till date which I have seen and experienced by working in my current company. I feel so pity for those passengers who have became victims of this company's cruel, unethical, unprofessional practices which they have been doing it consistently to reap the benefits and manage their operational expenses. And just in case if any passengers report to Police or file a case against our company then will our Office be raided by Police and can they arrest the entire staff for the company's fraudulent actions..?? or being a responsible citizen shud I upfrontly report to Police about whats going on in the Company..??
I am very much confused and willing to switch my Job asap and join a good ethical company.

So I would like to know the expert opinions, views, feedback and legal advice for my above given scenario.

Seniority between reserved and general category

Sir,
I joined as regular specialist doctor through upsc from waiting list general category with marks 62. Another candidate joined before me from regular selected candidates OBC category with marks 48. His date of joining is before me and was from first list. My date of joining later but marks more from reserve waiting list.
Sir, who will be senior?
I have read that even from waiting list the seniority is decided on basis of marks obtained in same upsc test.
Will be grateful for your answer.

Pay protection in contract to permanent job

Sir,
I joined Delhi Gov as doctor in 2009 on annualy renewable contract. I was on contract till 2015. i was regularly getting annual increments and pay scale. During my contract job i got selected through UPSC and i gave a technical resignation in same hospital same post .
But on joining through UPSC as Specialist on same post, my pay was started again from basic start. So, I lost all the increments.
I gave a representation for pay protection 3 months after joining.One representation i have given recently.
At the same time some doctors were not selected on regular basis and continued on contract. Their pay remained higher than me with all increments.
After 7th pay commission my pay is approx 20k less than those on contract.
My question is - 1) Am I eligible for pay protection?
2) How can those who joined with me , but did not get regular , get more pay than me?
