Non compliance of judgement

What are the consequences if the defendants refuse to comply with judgement pronounced and what is the meaning of judgement reserved will the judge pronounce the judgement in next sitting ,our matter posted to 15-8-2018 which happens to be a national holiday please suggest what may happen in the above context

Suit for declaration

i moved an application in civil suit for withdraw of suit with liberty to file fresh suit and also suffered the statement in the court. but the court passed the following order

"in view of statement of the plaintiff and application, the suit is hereby dismissed as withdrawn"

then i filed fresh suit on same cause of action. the opposite party raised the objection that the specific order regarding liberty to file fresh suit has not been passed.

whether silence of the court amount to grant of liberty or not. what are your views if negative then what should i do now if positive then cite some law.

Exparte orders passed in consumer fora

Sir and madam,

My fan wiring burst and that is why I filed case in consumer fora.

My case out of 6 parties, one is fan company owner by name crompton greaves. Another 5 parties are, 1 seller who sold the fan. parties 3, 4 , 5, 6 are KPTCL officers and workers. KPTCL is Karnataka Power transmissoin corporation limted.

Part 1 and 2 appeared but did not file any reply for 90 days.

On 90th day one advocate appeared and told he will file vakalath and objections.

I gave a memo stating that as per NCRDC guidlines and supreme court guidelines only 45 days maximum time limit for opposite party to file reply from date of issue of notice.

Here is HON SC guidelines

"The Supreme Court held that the District Forum can grant a further period of 15 days in addition to the 30 days (from the date of notice) provided for in section 13 of the Act to the opposite party for filing his version or reply and not beyond that. It was held that the view expressed by the three Judge Bench of this Court in Dr. J.J. Merchant & Ors. v. Shrinath Chaturvedi [(2002) 6 SCC 635] would prevail as the judgment delivered in this case holds the field. .Supre"

President taken the memo. But also told advocate filed vakalath already.
vakalath he was filing on 90th day. but did not file any reply.

In the memo I mentioned it is wrong in law to accept vakalath form on 90th day and should have passed exparte orders.

President told 3,4,5,6 are exparte. 1 and 2 file objections.

Now should I file execution petition for exparte orders issued against OP 3,4,5,6?

Meanwhile yesterday same advocate filed vakalath form on behalf of OP 3,4,5,6. and also filed a applicaotin asking to set aside exparte orders of OP 3.4.5.6.

in his set aside applicatoin OP lawyer says, OP 3,4,5,6 were gone on leave, all notice was in cupboard and now they came to know about notice.

How to tackle this?

Should I give execution applicaiton for exparte orders passed for OP 3,4,5,6?

or file objections to application given for setting aside exparte orders agaisnt OP 3,4,5,6?

Can father bought agriculture land in favour of his son

As I already discussed the fact is My father has one Son S and 5 married daughters A B C D E. Among them B, C and E demand partitions in agriculture land which is inherited from my grandfather's death to my father. This agriculture land is self acquired property of my grandfather. And my father is alive. B married on dated 15 May 1993, C married on dated 02 June 1994 and E married on dated 15 November 2007. Now advice me they have any right for the partition of agriculture land even my father has alive.
....My sister's B, C and E filled case in court against me and my father. They also include other agriculture land which is bought by my father in favour of me when I was minor (15 yr of age). My question is can this my agriculture land (bought by my father in favour of me when I was minor) is ancestral property.
...I took advice of my local lawyer. According to them (lawyer) my agriculture land is ancestral property..pl advice me.

Second marriage



Myself and my husband both of us are belongs to Hindu . We got married in temple. But we not registered. I have proof of marriage invitation as well as marriage photo. Due to personal reason I went to my parents house. Meanwhile he married someone in register office. After 1 year only I came to know about the register marriage. When I asked him y did u married secondly without my permission . . . What he replied is our self not registered. If u file a biagamy case against me means I know how do handle. At that I didn't have any proof of his second marriage. So I asked via RTI to the particular register office. After 6 months only I received the copy. Then I went to all women police station to file FIR against my husband. But they won't file. So I move on to Chennai high court. They order to all women police to file FIR. They filed FIR under IPC 498A, 494,406 and 109. I submitted all the evidence in court. But his lawyer repused. Then I got all the evidence via RTI with the sign of all women police station SI . Becoz when I was leave him my husband file a complaint with my marriage invitation and marriage photo. In the argument section my husband told that he didn't married me. Now argument over. Before order in court Web site they posted no defence evidence. Evidence closed . Argument over. I wanna the meaning of this. If I get justice. . can I nullify his second register marriage. Or injustice means how can I move further . . . Myself public prosecutor handling my case.

Is probate grant mandatory

Purchasing a property,
Link doc shows ( unregistered will) property is inherited to two sons from thier father. Their father is no more..
But the will is neither registered nor notarized. Infact will is written on a plane paper dated 21/06/2011.
How to proceed is probate grant required?

they drilled planted agricultural land

sir we have a land in that we farmed cotton. 3 days back some people in my village came and drilled all plant with tractor. so i have complained in ps but they just filed a case u/s ipc 427 and gave them bail what to do please suggest me.
