Section 80 IB

Whether sales tax remmission amount forms part of "Profit Derived from Industrial Activity" u/s 80 IB

Where tax remmission is=
Output Vat + CST payable - Input Tax
(only one percent of the amount derived from above formula is to paid to the department and rest is retained by the concern) that mean 99% of VAT liability is absolved.

DOOR OBSTRUCTION

My building construction is in such a way that my neighbor entry and mine faces each other, secondly the space between the two door is hardly +- 3ft. We both have security iron door. My problem is that my neighbour keeps his door open due to which it obstruct our entry and exit every time. Most of the time my door gets bang to his door. This has been happening since they started residing in our premises. We have already made complaints to the society and to our neighbour but they are not ready to close the door. They insist on keeping their doors open, giving us irritation and intention of making a fight.

I have suggested them to keep the door close
I have suggested them to change the direction of their opening, which I cannot change to the building structure.

I don’t know how to resolve this.
If any one can suggest

NBFC

Respected Sir,

We want to incorporate a Loan Company (Private Ltd), NBFC (Not Accepting Public Deposit) which will not be "Systematically Important."

The Main purpose of this NBFC is to finance his group companies. It will accept ICD from other companies

In this regards we have following queries.

1)A Loan Company-NBFC( non accepting Public Deposits) can give a loan/ICD to Group company?

2)A Loan Company- NBFC( non accepting Public Deposits) can raise ICD from other companies / outside Group companies ?

3)What is the definition of “Group company” – from perspective of a Loan Company NBFC.? Is there any relevant section / clause under the RBI Act / any other relevant Act/Rules?

Private Limited Company and proprietorship firm

Can a Private Limited company have proprietorship firm, as one of its division or concern, one of its director being the proprietor? How would be the liabilities of propritorship firm dealt?

498a-prevention-urgent

Respected,

What are the points one should keep in mind to prevent 498a?
Can a person intimate the police station before hand regarding this act if he feels that she might file a case under the 498a provision?
Do police investigate before filing a FIR in this case?
Hasn't been there any virus challenge against this biased law?


Kindly help me through by answering the above mentioned queries.

Terms of Settlment of IPCT 498A and Divorce

Hi! I am an Indian student from Brisbane, Australia. I was married to a completely unknown girl from my community in December 2006, which was our 4th meeting in the life. We stayed together for 8 days. I came back to Australia for my studies. My wife refused to come along with me to Australia and started living with her parents. For more than a year I tried to contact her but no luck! Finally, I sent her divorce notice in April 2008. She filed 498A with false complaints in June 2008. Now in December 2009 they want settlement. Their lawyer has sent Memorandum of Understanding (MoU) with a demand of Rs. 4 lacs. We are willing to pay and get rid off them. What should be terms of our settlement?

prisoner's human right

I would like to know wheather a prisoner can attend marrige cerimoney of his grand daughter? A has been senctioned 2 years jail from district court. During case period he was in jail for 13 months. After he made appeal in high court and got bail in 1994. After 15 years the high court rejected his appeal in nov 2009. Now once again he is in jail at the age of arround 68 years. He is suffering from more than two or three dieases. Now in 2010 feb there will be a marrige ceremoney for his granddaughter. Can he get ten or fifteen days bail to attend the ceremoney? where to apply for this? what is the prosidure? Please guide me.

On going through some of the answers,i feel there is a need of little more details and clarity.

please do remember that these are being read by ordinary indian publics too.

then only it becomes a "true forum" or "interactive platforum for lawyers & Indian PUBLICS".

May be in a hurry to answer as many queries as possible with in a short span of time? Or may be because many of you are expert practice lawyers and as such you may not feel this as an ordinary layman like me?
