i have a related query as well,
if i challenge whole of MTP act or only sec.3(2)of this act what shd b the grounds of pleading?
if i challenge sec.3(2) on d grounds of arbitrariness(Art.14) n right to privacy(Art.21) then how should i prove them?
n if i challenge whole of MTP on rt. to equality n rt. to life dn how shd i proceed??
i will b really greatful if u can take out some time n help me in my work.

respected sir,
i would like to ask,
a) is there any time limit for lease pendency to be filed.
b) just because the matter is in court
can this be only reason to file lease pendency.
the property on which lease pendency is filed belongs to my fahter and me from last 42 years even if the property huf.
c) can partition deed be made on simple paper. can it be applied after 3 decades for only one property out of five, the rest have been sold out.

Can a Society provide certificate courses. For example a society provided courses related to indirect taxes. whether they can provide certificate to their student. also tell me is there any govering body from where we get registration for courses realted toindirect taxation.

Hello Sir,
I recently booked an apartment. The builder has aquired power of attorney from a partnership firm and has gone ahead with registration. The building itself is nearing completion. The partnership firm was originally registered under the names of three sons in 1960. But the current partners are the 1st son and his wife.
We now got a Court Notice from the Legal Heir of the last partner who retired from the firm in 1987 (This partner died in 2007). We are not sure whether the builder has the retirement deed and settlement deed for the 3rd partner.
In the year 2006, the builder has also given a public notice saying that he wants to buy this peace of land and that the sale certificate issued by the Goverment is lost. But no one has claimed it then.
The question is how strong we are, as the flat owners in this case?

My uncle purchase land in Thane Dist.nr Taloja .S seller is a local resident he have possession of land till today my uncle purchased said land from sellers sons in 1999 and regiserted in 2006. while trasfering on 7/12 uttara we come to know that someone who had purchased the same land in1968 and registerd the same, nobody knowns about it.1985 the seller becoame old and he can not do any farming so he had distributed is land on his son nad noted with Talati, that time also no one taken the objection. Then first purchser filled a case ,he won,then we appealed and won, then case gone to konkan bhuvan and first party won and immediaetly he had transfered his name on 7/12.Now they are asking the possation.Second purchser had possetion,compound wall and power since last two years boring and roof and office for fabrication work.What to do please advice.Filed a appealed in high court. or anything else also want to ask when we won asking for 7/12 transfer they refuse. now they transfer in 7/12 uttra immeditely with all settings donein office can we can do obection on that

I m writing this on behalf of my NRI friend in UAE(DUBAI) who become redundant(Terminated due to financial crisis)and also lost his full investment in freehold properties in Dubai. He had taken some bank loan and also credit cards to buy these properties. The banks had charged credit shield with his monthly bill and he paid everything in time till termination of employment. The banks had offered credit shield cover for involuntary loss of employment. He failed to find any new job there and returned to homeland after expiry of his employment visa. He could not sell his property as there was no demand.
Now he is getting threatening phone calls/ house visit from collection agencies saying that the credit shield is not applicable and bank is asking for the entire loan settlement with immediate effect. The bank have started legal action against him in UAE
He is still in search to find any job there and seeking to settle the outstanding once the market is steady to sell his property.
My question is, for the time being what are the legal implication in India for this case, if he stays in India. Is the bank can take legal action against him in India? It is very unfortunate that all these things happened to him and he is one of the victim for economic recession.
