Trial Procedure

Trial has just begun in a case before the Chennai City Civil Court. The Plaintiff has introduced a witness and marked certain documents through him. The defendant objected to a certain document being received in evidence. Ignoring his objections, the document was marked. When the counsel for the defendant persisted with his objections, he was informed by the judge that the document will be marked subject to his objections. But, no written endorsement of the defendant's objection seems to have been made by the judge. What courses are open to the defendant?

IPL Matches

IPL cricket matches is a big distraction to many especially to student community. Government took a decision last year to even shift these games to South Africa due to security reasons for the sake of general elections. How come it failed to realise the welfare of student community and importance of Public Exams for Std X and Std XII when these matches are conducted just for the sake of minting money by the Capitalists. Why can't Courts intervene and take Suo Moto action instructing the IPL organisers to consider postponement of matches at a later date for the sake of student community? Experts to offer their opinion

Rape Laws

Rape Laws to be made gender neutral and IPC is proposed to be amended where the term Rape is to be substituted by Sexual Assault thereby benefiting society Gays in particular. By enlarging the definition of Rape which is covered under Section 375 of IPC. I want the experts to share their experience in this regard and analyze the social consequences that would emanate from this amendment. Will it pave way for reduction of sexual crimes in the country?

consent of parties on an agreement

1.state govt enters into an agreement with private managements of professional colleges regarding various fees etc and the agreement is not published.i.ie only the govt and the management is having a copy of the said agreement.

2. There is a published document/instructions by the govt, wherein the guidelines regarding levying of penalties for discontinuing of studies from such instituitions are stated clearly and they are absolutely contradictory to the one mentioned in the "agreement" as in 1 above.

Now from the legal/student angle, which is legally enforeceable, since the management has not obtained the consent of the student for implementing the terms of the "agreement" by taking his signature?

Erection of Wooden Partition & Cabin without permission

Dear Sir,

I have erected a wooden cabin in my shop in Mumbai without the permission of landlord. Is erecting wooden cabin and wooden partition requires permission?

The landlord has sent a notice to allow inspection and take photographs of the same.

Can you please advise whether erecting wooden partition and wooden cabin (without permission) can give the landlord the right to send us the notice for eviction?

Compromise on complaint

One customer filed a false complaint against 2 out 3 directors of pvt limited company accusing them of selling their flat without his will. Later on we produced the resignation letter signed by him before his flat was sold. At that point he withdew his complaint in writing and gave a written letter to the SHO of the concerened police station and matter was settled. Now after 10 days we came to know that a FIR is filed on that complaint, I want to find out
1) if a FIR can be filed inspite of the fact that complaint was withdrawn
2) since the flat were built by the company, which has 3 directors so is it possible that a FIR can be filed only against 2 directors and not the third one.
