Way to build socienty by Developer

Hi,

I am from Kharghar, Navi Mumbai. One year back I have purchased 1BHK in gaonthan plot(12.5 Scheme). I have Occupancy Certifcate for the flat.

Main thing is that there is no tripartite agreement between Land owner, Builder and CIDCO. Due to this society is not set up yet.

At the time of purchasing the flat it was said that society work is in progress.

Now is there any way to make the socienty as all the flat owners are ready but Developer is not respoding propely. Earlier he told that Society work will start in Jan 2010, after that he postponed to June 2010.

Thanks

dismissal

calling upon all friends in lawyers club conversant with CPC for an answer based on precedents and ratios-

when a suit is dismissed for non-appearance of the plaintiff under order 9 rule 3 of the cpc, the plaintiff may either file a restoration under order 9 rule 4 or he may file a fresh sui.

now if he opts to file a restoration petition and the same gets dismissed/rejected, can he after such rejection resort to the other alternative of filing fresh suit?

i would highly appreciate if friends can look up and offer me the right position of law and also a decision

Customs matter

if "Z" who introduced "A"(CHA) to "B" (Importer) for clearance of the goods from the port. Clearing activities done by "A" (CHA). The Department found undervalued imported goods and department enhanced the duty.

Now department alleged that "Z" was acting as a front man of CHA firm and also alleged that the "Z" had cleared some consignments of identical goods as Director and had full knowledge that non declaration of crucial parameters like model numbers will have a direct impact on the value of the goods. Also alleged that the "Z" have advised not to mention the model numbers.

Under What ground "Z" save himself...kindly suggest me the grounds.
