Hi
Does Married Women's Property Act, 1874 supersede the Islamic Law of Inheritance. Basically, in case a Muslim man has taken an Insurance policy and registered it under MWPA, then post his death, is the maturity proceed treated as part of his estate and hence, distributed as per the Islamic Law of inheritance or is it treated as an exclusive property of the wife (sole benficiary of the trust created under MWPA) and hence, is not part of the Husband's assets/properties and need not be distributed as per the Islamic Law.

I am running a shop in Chennai for the past 23 years under a rent of Rs.2000/- per month. Rent is being paid regularly every month. My landlord gives receipt for rent paid only yearly (i.e. when 12 months are over he gives 12 receipts, waits for another 12 months and will give 12 receipts). In this circumstances, my neighbour tenant did not pay the rent for 2 years and is absconding. When the neighbour tenant was occupying his room, he gave one set of keys of his room to me for safe custody and also to attend phone calls in his absence. Now my landlord, is questioning me why i am in possession of the keys of the next room and came to a conclusion that myself and the neighbour tenant colluded to a plan agaisnt our landlord and he is asking me to vacate my premises and refusing to collect rent. I pleaded with me landlord that there is no misktake of mine in taking the next room keys, since i was only in possession of the keys, but not using the premises as my place of business or stacking place of materials. But he is very adamant to receive from my me and has given me 6 months time to vacate. Lastly, after a diligent search in full of Chennai city, I found the absconding neighbour tenant and spoke to him about the trouble by giving his keys to me and prayed him to meet our landlord in person, explain him the situation, handover the keys of his portion and vacate the portion immediately. He also met our landlord explained my innocence and handed over vacant possession of his premises. But still now my Landlord is angry against me and refusing to collect the rent (now 4 months has past) from me. Upon advice of a customer who is an advocate, i sent the rent through M.O., which the landlord refused and returned back. This shop is the only breadwinner for my family. I will loose my life if I loose this shop. What can i do in this situation.

Chennai Metropoliton Corporation was gifted 10007.25 sq. ft of land being 10% of land before developing the rest of land as multy storu building by Doshi housing as Open Space Reserved Area (OSR) as per Development Control Rules 17(a) created under Tamil Nadu Town and Country Planning (Amendment) Act 1973.Details of the same are given in Annexure IX to the D.C Rules which gives guide lines for such gifts. On the usage of the area the rule says “The space so reserved shall be transferred to the Authority or to the Local body designated by it, free of cost, through a deed, and in turn the Authority or the local body may permit the Residents Association of Flat Owner’s Association for maintaining such reserved space as park. In such cases, public access for the area as earmarked shall not be insisted upon’
The builder had made 178 flats in the remaining area but CMDA had not converted the OSR Area as park or handed over the same to association as per rules. I am a flat owner and since as much as 15 years had elapsed since the donation had taken place made a complaint to Department of Administrative Reforms and Public grievances New Delhi which in turn asked for explanation from CMDA through CM Cell Tamil Nadu. CMDA has since replied to my complaint it had conceded to my request to hand over the OR Area to the association but the ownership of land will remain with CMDA/Corporation.
On legal angle can I take the letter of CMDA as handing over of the land to the Association and the association can start developing as a park or should the CMDA initiate a deed of agreement with the association/corporation for the said purpose?

Cancellation of Notary GPA
I had given a Notary GPA to my brother to attend the court proceedings in connection with the eviction of a tenent. In the GPA the sale condition was also there because we were in very good terms with my brother. Now my brother is trying to dipose off the property on the basis of the GPA. The GPA was executed in the year 2003, and I am not sure about the date. I also do not know the name of the Notary because first I signed the GPA and then my brother got it notrised. I would like to cancell the GPA. Since I dont know the name of the Notary as well as the exact date of the execution, what is the procedure to cancell the same. Kindly help me.
Thanks, with regards
