Order to pay 1800 pm as interim held against my client in 125. After order my client revealed that he is paying 1500 interim under h m act. What to do now.

Dear sir,
I had booked a flat with lodha builders in mumbai about 1 and half years back. While booking they had ensured me that I will get the loan for the property. But due to some fault from builders side the loan was not sanctioned. And after 6 months I was informed about this. After that I tried to apply loan in different banks but most of them due to agreement expiry over 6 months period rejected the file. And now finally I have been informed that I have to pay the penalty about 24% anually of the property value to the builder. I don't have this much fund with me.
I am now looking to cancel the registration of the flat. Please tell me whether I will get the money refunded for registration and stamp duty cancellation ?

Hi,
Planning to buy a plot and there is discrepancy between possesstion certifcate and the Title deed.
1. Possession certifcate issued in 1981 by hosing society, shows property as 2800 sqft with NS-70ft and EW-40ft
Where as
2. Registered Sale deed from society to the owner/allotee shows the property as 2800 sqft with NS-40ft and EW-70ft, which is in essance correct dimension.
How important is that these too matches.

Dear experts,
Please advise on the following queries :
1) A workman's lawyer is delaying or not interested in preparing affidavit for
worker evidence stage despite getting all the relevant evidences from the
worker, then can the workman himself prepare the affidavit in plain language
explaining purpose of each evidences and submit it in court and to the
opposite party? Note that uptil now two dates have gone when he has
assured the judge for submitting this affidavit.
2) In law is it possible to prepare this affidavit with the help of other lawyer
by paying him fees seperately for the affidavit and how much will it cost
approximately to get this affidavit prepared from him?
3) Can we complaint this matter in front of the judge that despite giving all
documentary evidences the workman's lawyer is betraying him (may be he
must have joined hands with the opposite party as a result of greed) and
helping opposite party in delaying the case further?

I am not in talking terms with my wife and her parents. She is residing in her brother's flat with parents. I have no address of the flat.I also do not know the address of the school where she teaches.But I can spot the location of the flat and the school physically.I have the address of her ancestral home(they now dont live here) with documentary evidences such as marriage certificate.Can I take ex-parte divorce sending summons to her ancestral home.

An inspection was carried out at the premises where the contract labour is deployed. Irregularities found...such as Wage Slips not issued...tho it was issued etc etc. They issued show cause notice to which reply of regularising the irregularities was sent to the RLC. Yet , they prosecuted. Case never came up on the table of the court, only dates were given. Went on for 18 months and then lost the track of the dates in Dec 09. Today i come to know from the labour office that NBW is issued. 1) Whats the way out of this ? 2) If its revision petition , in how much time the revision petition needs to be filed. 3) Where do we file this petition ? I do not know when they have issued the NBW. Pls guide !

My husband bought one property in my name.Later husband asked to return the property to his name. But due to the shortage of money Power of Attorney executed by me in his name.We are having two daughters and one Son. My Husband wants to give property to the Son.But I like to give all equally.Now My Son and Husband is going to execute settlement deed in Son's favour.How can I avoid it?If I cancel the power the relation between my and Husband shall collapse.So what can I do?
Whether I can inform the register office to stop the registration of settlement deed?If cancelling the Power how can I do that with out their knowledge?

Que. Does Execution Petition U/S Cr.P.C 125 also proceeds like any other Petition like sending summons to husband and then husband comes for hearing and case goes on few hearings and finally Order is passed or the process is immediate in the first hearing itself?

what amount to denial of title by the tenant, if the land in questing is alloted by the government to the land lord on the lease cum sale agreement , the land lord had paid the entire dues to the govt, the issue of sale deed is pending, at this point of time the land lord want to vacate the non residential portion of the building for his personal accommodation and the age of the L.L IS 84 years, at this juncture he want to settle the property to the his daughters, whether it can be done and the stand taken by the Tenant is whether amount to denial of title i need explanation form our team.
