Validity of an Agreement

Hello,
1). I sold my property in 2007 to Mr. X, sighning an agreement concerning details of property and payment options.And received a major amount of payment within a year(not full amount yet).And no major clauses written on the agreement.

2). Now, in 2007 Mr. X sold or gave the possession to Mr. Y without my concern.

3. In 2007, the property was registered in my fathers name
In 2013, I got registered the property in my name through HIBA (as per MUSLIM law)

Does the agreement Still Valid?
Can I take my property back or not..???
Plz Help.....

Myself Kathiravan i'm persuing 3 years LLB at Venkateswara university, Tirupati. Now i'm in final year. After completing my course i would like to practice on company law. Kindly guide me what are the steps i have to do and is there any additional courses available to specialise in this particular field. What is the scope of Company law.

Properitorship firm continuation

D/sir/Madame,
My father was expired and after that my mother takes the charge of properitor as my father has given a adhikaar patra in his liftime to my mother, on basis of that my TIN no. is same as alloted to my father is now ammended on my mothers name. Is the firm continues as it is with all the work experience, turnover and such other credentials. please advice me I really need a positive response for existence of work

File 497 adultery

Hi,

I want to register 497 case on the person whos had physics relationship with my wife. I have only proofs as call details from mobile bill and one call recording audio where my wife confessed the act to that person. That person comes my home frequently as i am working outstatoin and comes only on weekends. In my building there is cctv cameras where the person easily track about the day and time. but when I asked to get the copy of cctv video , owner not showing any interest to give. If i register the complaint at police station, can police help me to get that cctv footage and is there any other evidence require to the court to prove adultry had happened..
Plz help me, i have been married on 21 may 2008 and we have one four years daughter.i m in depression ,i couldn't understand what should I do.

Regarding parking rights of a flat occupant staying on rent, in a co-operative housing society.

Dear Sir,

I have a particular issue regarding Parking in co-operative housing society.

I live in a rented flat in a 13 storied building in Kandivali (west) in Mumbai. I own a four wheeler Car. The landlord stays in Europe, and have given power of Attorney to his father in law staying in Ghatkopar, Mumbai, who signs rent agreement with me every year.

My society (Building A) is in a larger premises having four other buildings (building C, D and E).

There are 51 flats in my building, out of which only one flat (i.e. mine) is on rental basis and all the others are on ownership basis.


Each building has its own internal parking area where they have demarcated parking space. plus there is an access road connecting all the buildings, on both sides of which, parking spaces is there. The four buildings viz. A, C, D & E have formed an Apex Body which has taken up the ownership of access road and have distributed parking space within four buildings recently. Accordingly, my building (A) has been allocated four car parking to be given to its members.

Now the issue is as follows :

the society of my building (A) every year conducts a draw / lottery for allocation of parking space in its 'own' internal parking space (where approx. 27 parking space is available compared to more no. of cars). However, the society did not include my car in the lottery citing that I am staying on rental basis and all the other people on ownership basis have objected to inclusion of my name. I did not object at that time; and placed my car on Access Road where parking so far was on 'First Come First Serve' basis. If I didn't get parking, I had to park the car on main road. Similarly, for all those who didn't get parking in lottery system, parked their cars on access road if available; or else outside. but most of the flat owners had two cars; one allotted in society parking area and other placed on access road.

Recently, the four buildings made an apex body (of A, C, D & E). and took up the road and distributed parking amongst themselves as mentioned above. My society has been allocated four Car Parking Spaces. In my society (building A), there are five excess cars including mine (Excess cars are those cars which didn't get parking space in lottery system in society's internal parking area).

Ideally, the society was expected to further conduct a draw / lottery of these four car parking space, to accommodate four out of five cars including mine. But once again they did the same thing, i.e. excluded me because of my 'rental' status and distributed four car parking spaces amongst themselves because of which I had to keep my car outside the premises ie.. on road on first come first serve basis. All these four cars are second cars of their owners. whereas I have only one car. I had requested the society to consider my car in the lottery of atleast access road if not in the society's parking space; but they did not consider the same.

My question is :

1) First of all, can society allocate its own parking space (internal parking) through lottery system or it has to be on first come first serve basis? Even if society has allocated internal car parking through lottery, can they exclude tenants (ie. families staying on rent)? Don't rental members have equal rights on society's resources? Can society discriminate against families staying on rental basis while conducting lottery system? shouldn't the car be considered as the car of Flat no. xxx from which the society has been getting regular maintenance?

2) Regarding Access Road : Can Apex body of four societies distribute parking space on Access Road amongst four buildings against collection of deposit? or the parking on access has to be on first come first serve basis? Also, even if it has allocated parking space amongst four buildings, can my society allocate parking through lottery system or the parking on these four spaces have to be based on availability?
Next Most important question is : Can my society exclude me from lottery / draw of four car parking space allocated to it on the access road, & thus distribute amongst four members? Can they discriminate against tenant?


I would request you to kindly guide me so that I can protect my rights as a tenant having equal rights to 'use' the common resources of the society. I am ready to pay the parking deposit and monthly charges.

I would be greatful to receive Experts' opinion (with relevant section of any act, if possible). and what further actions can I (& should I) take?

regarding transfer of property in blood relation

Hello Sir, my father Mr.A and Mr.B were 2 brothers. Due to some dispute my grandfather had to leave his native place without taking concern in his father's property part. According to Will of my grandfather, I am the owner of a shop property, my mother is the owner of a house property. The will had been submitted into the court and we are not available with the hardcopy of that Will. So how can I sell that property in my name.

Also my mother wants to tranfer her property in my name. What is the procedure to do that?
Please suggest the way out as I am badly in need.

Regarding balance payment to builder

Dear Sir,

My case is pending in District consumer forum against a builder. He threatened us and locked the flat and did not allow us to inspect the flat. Now when I have submitted an IA for appointing an Advocate commissioner in consumer forum judge has dismissed the petition and directed the opposite party to handover the keys for verification of the flat. Keys were handed over to me in the court and we have verified the status and found few works pending in the flat. We are going to submit a memo along with photos with all pending works. I have to pay a balance of approx 5 lakhs to the builder but would like to know what other precautions to be taken while taking the possession of the flat in the forum. we have already made a statement that we will take the possession with pending complaint once we are satisfied with the completion status but the opp party counsel made his submissions that the flat keys will be handed over only till the full payment of 5 lakhs is done. The judge is also saying that release the 5 lakhs and take the damages if any once the judgment is finalized. The handover is delayed is delayed by 1 year. how to handle this situation.

Unregistered sale deed executed before five years. Vandee was not present. His agent has signed behalf of vandee. Agent does have power of attorney. 21 names was on 7/12. Only 3 persons have signed also they have signed as a power holder. Total signs are 11. When agent has signed in place of vandee that three persons have seen. At that time they does not have raised any objections. Now vandee and his agent has cheated them. So they want to go for FIR on forgery. But they afraid for that any malafied intention will be raised on them by police inspector. Or a police inspector

My Lawyer arrested while attempting bigamy

Respected experts,
My lawyer whose services were being utilized by me in a service matter (IAF) has been arrested for denying to marry a lady just the day before marriage - by not turning up at the marriage venue - citing inability to marry as he's already married.
Newspaper report further added that he's received a notice from his first wife. He & his family members had duly attended all previous functions. He's been booked under IPC 406,420,500 & arrested.
My question is:
1. Should I change my lawyer? He himself is in a soup - so he might not take enough interest in my case. His credentials do become quite shaky with such a development.
2. Any way of asking for a refund of money i'd given him as advance fees to take up my case. (He's only read my case. Not filed any petition / case in court yet).
