Company refuses to provife PF Number

A pharmaceuticl company in Thane is refusing to provide a form for PF withdrawal. After having offered to go to PF office to fetch the form, company repeatedly declined to provide PF account number. It's 8 months since the employee resined . Company did not mention PF number on salary slip. Also, company has been refusing to issue a form-16 to enable me to pay taxes.

pension benefit

This is my family case........my grandmother is fighting for her right to pension, my late grandfather was servant under punjab government....later when punjab was divided and himachal emerged then he became servant of Himachal Pradesh (H.P. Road Transportation),Since the punjab govt. rules and laws continue to Himachal also till they are changed, hence the benefits of Punjab should extend to Himachal also, but in himachal the himachal govt in saying that they will give pension to only those employees who retired after 1995 while my grandfather retired in 1986 and i think Himachal govt. passed it's own Act on this issue in 1992. Please advice on what are the rights of my grandmother.....and what chances we have of winning the case.....and any caselaw or any other law that is for our benefits,then please highlight that. Any other advice on this issue is most welcomed.

how to get salary after my notice period

Dear All,



I am from chennai.I worked as an CTO in private concern.As per our company rules i issued the resignation letter with 3 months notice period.After receiving my resignation letter from thord day itself my problem is stsrted.



1.they disconected my net connection



2.strict order to the all employees "dont talk to CTO(me)"



3.started insulting me for all the small things.



as the CTO of the company....after the resignation letter they insulted me a lot.Managenent forget i am the base for the company and i only bring the team to the company.



they started complaining about me to the all other employees.



after one week My boss purposly started unwanted arguement with me and he said "if you wants to go out from the company you can go out now"



i am totaly upset and went home.

after that my friend told me they opend my system checked the all files and changed the passward and loced my system.



and my hr called me in the same day said "dont come office from tomorrow"



and i am waiting for my salary for the last one month.there is no reply from the management and from the hr side.



i have all the proof(copy of the resignation letter with three months notice period,mail proof for all my communication with hr).and also they deducted PF for almost 16 months.but till now company is not started any pf account.



please guide me how to get my salary?please send me your commends to my mail....

PF & ESI Deduction at Source

Dear Sirs,

Does the PF & ESI Acts allow deduction at soucre ?

Case: A company engaged a Contractor to do some work. He engaged his 9 workers at the company's premises for the same. He DOESNOT HAVE PF & ESI registration. Can the company deduct the PF & ESI from his payment & deposit the same on his behalf ?

If yes, pls quote the section/regulation no. or case law etc.

Gratuity

Dear Sir,
I need a clarification regarding Gratuity. In our organization we take Group Gratuity Policy with LIC. They mentioned that Gratuity is calculated under Projected unit credit method and they said that every year a sum of amount has to be paid towards premium.
Actually premium is paid if the fund value is less than the required level. But our fund value is more than the accured gratuity liability.
My query is
1. any premium to be paid even if fund value is more than the accured gratuity liability.
2. whether any contribution is to be paid every year. Whether it is compulsory or it is a minimum payment made to LIC or whether it is to be paid for not lapsing our fund.

Refusal to give relieving letter

My hubby was wkg as a VP in a proprietary tdg firm. After having been into job for 7 yrs, he started looking out for own business opportunities. His boss learnt about his this activity as 2-3 other colleagues of his were also involved. The boss forgave everyone but took away the team of 20 people reporting to my husband from him. My hubby resigned from the job. Initially they were not accepting his resignation so we mailed the resignation, dropped 1 copy at the office, surrendered the car and mobile one day. Next day the boss called my hubby and gave him an acknowedgement for the handover of company assets. Told him that it was nice wkg with him and the relieving letter will be sent once the Admin Guy comes back. All this happened on 6th May, 2010.

The company policy says that 3 months notice period is to be served but due to their job role, any employee who resigns is asked not to enter the premises immediately.

They are refusing to give the relieving letter. On following up, they are threating to send legal notice.

My questions: How to get the relieving letter? What is the legal course of action available to us and is our case strong enough?

full and final settlement

sir,
i had been working in a service oriented co for the last nine years. due to some argument i was asked to leave during the discussions with my md.

i later resigned voluntarily and served the notice period. i was only asked to sit in one place and not doing anything.

i received my relieving letter. but my full and final settlement is due.i.e two months salary + gratuity + bonus.

during the year 2008 i had cleared import shipment by paying excess duty of rs70000. later as per law we can file refund at customs.

this particular job is not mine.

now the company is telling that untill refund of rs. 70000 is not got they will not settle my dues.
what should i do.
