Review peition

Order is anounced in District consumer court , can it is possible to file review peition due to misunderstanding or overisight of the document evidence ? thank you .

If the judgment is passed by the trial court/forum/tribunal/commission, then the aggrieved party can file only an appeal agaisnt the aggrieved orders and not a review petition before the same court

Of course you can file a review application with the consumer commission to correct an erroneous judgment under the Consumer Protection Act, 2019. This application, often called a review petition, is used to address errors apparent on the face of the record, such as mistakes in applying the law or factual errors, and must be filed within a specific timeframe, usually 30 days from the order's date, though this can vary depending on the specific commission.
The 'error apparent on the face of the record" refers to an obvious mistake in the judgment that does not require extensive argument to understand.
Check the specific rules for the relevant commission, as the time limit for filing a review application is generally strict. For the National Consumer Disputes Redressal Commission (NCDRC), it's often 30 days from the date of the order.
The power to review is a limited one, intended to correct obvious mistakes rather than to re-argue the case.
A review petition is distinct from an appeal, which allows a higher commission to review the entire judgment. You would file a review to correct a mistake in the original judgment, while an appeal is for when you believe the overall decision was unjust or incorrect.

Section 40 of the Consumer Protection Act, 2019, grants the District Commission the authority to review its orders. The provision states:

“The District Commission shall have the power to review any of the order passed by it if there is an error apparent on the face of the record, either of its own motion or on an application made by any of the parties within thirty days of such order.”

Under the provisions of Consumer Protection Act 2019 , Consumer Commission have power to review it's order sought Motor or on an application filed by any party within 30 days of order,if there is apperant error on face of record.

dear sir , for your information : this is home construction but builder is not done properly , all low quality . and comissioner report is done the same all loops are reported . Order is as below

1) the opponent party should rectify all the defects within 45 days with full satisfaction of the complainant .
2) has to 20,000rs to the complainat .

but we wanted the amount instead of this builder rectifying this because we lost respect , trust and confidence on the builder . he may harm us while rectifying and we are already living in home .

when filled the complaiant before the Honrable district cout comission , after 1 month they came to home to rectify defects and we denied it given the police complaint to avoid destrcution evidence till court order comes .

and the copy of police complainant is submitted to district comission .

so judge assumes , the we complianat has denied the rectification untill the court order comes as clearly stated in the police complaint - judge mentioend this in the order .

but for just sake of showing or providing this information to district comission court that they came to rectify the defects , we just submitted the police complaint copy to district comission court . we actually needed the amount/money componsation .

Does this comes under " Error apparent on face or record " ? please help sir , thank you .

You are aggrieved by the judgment delivered by the consumer commission hence you may have to prefer an appeal against the district commission before th4e state commission.
You first scrutinise your complaint and the prayer where you sought for the relief and if the consumer commission has not accepted your prayer instead given the judgement based on its own interpretation then you may have to prefer an appeal against the judgment

Please note that Review is a limited remedy and it is seldom that judicial forums admit such petitions.
