Friends,
I have a query as under:
"A Ltd is a company engaged in the business of importing food items and selling all over india having registered in Delhi.
Are the following labour legislations are applicable to A namely:
1. payment of Wages Act 1936
2. Minimum Wages Act, 1948.
As per my analysis, the business of the company is not manufaturing, mining or plantation and the company is registered under Delhi Shops & Establishment Act 1954. Hence both the acts namely Payment of Wahes Act and Minimum Wages Act shall not be applicable to A ltd.
Please let me know your views.
Thanks & regrads

In Tamilnadu there is a special act called TN Payment of Subsistence allowance Act,1981 by which subsistence allowance as per the act can be claimed under this act.But I have a citation wherein it is held that subsistence allowance as per the standing order can be computed/claimed u/s 33(C)(2) of ID Act. ie 56 FJR 310(South India Cooperative Spinning Mill vs V.C.Mariappan and another) Kindly give me the full decision of this citation
When once termination order is set aside by the Authority under TN Shops and Est.Act,it follows he is entitled for reinstatement with back wages though this relief is hidden in the set aside order. And hence petition u/s 33(C)(2) of ID Act is the only recourse to compute the money value of the back wages and to decide the gainful employment or otherwise during the non employment period. But a claim was filed in Labour Court, the Court dismissed the claim stating that termination order is only set aside and there is no order for reinstatement with back wages. Any citation for computation of money u/s 33 (C)(2) when termination order is set aside by Authority under TN Shops & Est.Act.?
I have one citation 1981 Lab.I.C 493.But details such as name of the party, court, judge and date are not available .Also the decision is not available. Any body can give full decision of this citation please.
Please suggest whether an organization exempted from payment of bonus act 1956 are having any obligation to implement or consider the demand for bonus by the contractors workers as a principle employer.......

Dear Sir,
I am working in a Private Limited Company at Ajmer since last 22 years. Now I have been transferred from Ajmer to their Kolkata Office from September 2012 and they withdraw the DA that i was getting in Ajmer office. But they do not mention about the withdraw of DA in the transfer letter and as per letter all the remain terms and conditions are remain unchanged in the appointment letter dated 05.10.1990 (which stands for DA.
Please inform if it will affect my final gratuity and pension calculation. If it effected then a huge loses i have to face. Please send your valuable advise/information.
