Employer forcing me to quit

Hi,

I work in an IT company in Bangalore (have offices in Chennai/Mumbai/Hyd/Delhi) as a Project Leader for the past 3.5 years. My project got over by July 2nd week. My employer doesn't have a project for my skillset (Mainframe). So, our team is on bench for 2 weeks. Now, our employer asks us to give resignation. The reason he says is company has no mainframe projects. So, they can't put us in any project. My question is why the employer asks us to resign instead of terminating us? What are cons if the employer terminate us? What's the advantage the employer has by asking us to resign instead of terminating?

query regarding legal support

I am a public sector employee. During the time of my appointment with the organisation, I have signed the terms and conditions in which one of the condition was that I would not apply for any other job without prior permission fron higher authority. However I wanted to apply for other job and for that I wrote a letter seeking permission from the higher authorities . But they clearly sent back a reply saying that the permission is declined. is there a possibility for me ti go legally regarding this.

Illegal termination by mnc company vodafone

Dear Sir,

First I summited my complaint in Asst labour commissioner , result failure of councillation from Assitant labour commissioner but in this report I sin favour of me. Failure report is supposed to reach labour court cum indisutrial dispute...

Pls guide and suggest me what should I do?


I was working in Vodafone Jammu as Dy. Manager from June 2010. Till July 2011, every thing was fine . In July 2011, new Manager ( Sh Kulbhushan Dwivedi – Sr Manager ) joined . After joining ,every thing at workplace environment changed . This new manager was reporting to Network Head Sh Rajiv Bansal. And i was reporting to Sh Kulbhushan Dwivedi ( new manager).
Sh Rajiv Bansal and Sh Kulbhushan Dwivedi started to harass me.
1.My work profile was to work in office and field as well to maintain Vodafone network . I myself was doing my work efficiently and performing very well.
2.Sh Rajiv Bansal and Sh Kulbhushan Dwivedi forcefully sent me in field without any car and necessary tool to perform my work .they both asked my other colleagues not to provide car. They forced me to complete the work .i completed the work without any car and necessary tools required. I went by bus and completed the work but as per entitlement , company should provide the car and necessary tool. I complained this thing to HR Head ShRipudaman Gill But he did not do anything to resolve the issue . he only supported Sh Rajiv Bansal
3.In every meeting , network always abuses me and always say me to beat with shoes ( LAAT MARUNGA , JOOTA MAARUNGA) and Sh Kulbhushan Dwivedi was supporting Sh Rajiv Bansal
4.After my complain to HR , they both started to harass more and threatened me that they will kick you out from system as you complaint to HR .
5.My work place was at Bahu Plaza , Vodafone office. In retaliation they forced me to sit at Bachitter office to work alone without any team member or any necessary tool but my boss Sh Kulbhushan Dwivedi was sitting with team at Bahu Plaza office. At Bachitter office i was forced to sit approx `15 days and every day I was abused by Sh Rajiv Bansal( Sh Rajiv Bansal was not my reporting Boss). They were forcing me to give output but I told them that how can I give output without any tool. I requested them to have me sit with team, then I can give you output. In return they always use abusive languages. I was also forced to do work of an assistant.
6.HR HEAD was not resolving the issues.
7.One day Network Head Sh Rajiv Bansal therated me to spoil my career.
8.Due to continuous black mailing and harassment i went through severe depression ( in Dec 2011 ) and i got fainted at office and office staff admitted me to mental hospital Amphalla . I was there for 3 days. Company staff threw me at mental hospital and my wife has to be with at amphalla mental hospital .no one from office was supporting. I was unconscious .my wife called senior officers at Mumbai office and Punjab office , then only some one came to hospital for support as my wife was alone. HR Head Sh Ripudaman Gill ( HR HEAD) came to Amphalla mental hospital with 20 more office staff to misguide doctors . after that doctor were not providing proper treatment. I was not recovering , then my wife took me NOIDA for futher treatment .
9.I was admitted in Kailash Hospital Noida and was there for 5 days. I was recovering and i again joined office on June 16 2012. But my treatment was continued .anti-dipression medicine was continued.
10.Harassment was still continued but no humanity shown by Sh Rajiv Bansal ,Sh Kulbhushan Dwivedi and Sh Ripudaman Gill.
11.Hostile environment created by Sh Rajiv Bansal and sh Kulshushan Dwivedi. Sh Rajiv Bansal also instructed other team member not to talk to me. I was not getting support
12.I was mentally harassed here in Vodafone but i was performing very well.
13.On 21st Feb 2013, i was working as usual . at around 4 PM, 7-8 members of management (Sh Sidharath Das – Regional HR HEAD, Sh Ripudaman Gill – HR HEAD, Sh Rakesh Shalla- Operation Head, Sh Rohit Bhasin- Legal Head, Sh Kazmi – Corporate affairs , Sh Kamaldeep Singh – Admin, Sh Vakeel Singh – Admin and Security staff ) attacked on me and snatched my laptop and mobile connection . They said me to “ GET OUT FROM OFFICE” in seconds and they did not provide any breathing time.I was badly insulted by management and security guards at Bahu Plaza Vodafone office. This was insult of TELECOM ENGINEER. They Sacked me without any reason. This is first case in telecom industry( mental harassment, exploitation , insult and then sacking )


Dear Sir, I am unemployed now because of Vodafone management and no source income . Still i am under medication of anti –dipression medicines. My life and career is spoiled by Vodafone Management and Sh Rajiv Bansal and Sh Kulbhushan Dwivedi. I tried a lot but i am unable to get new job as Vodafone spoiled my career ( due bad spot by Vodafone on my career). Now i have responsibility of surviving my self and my family and my condition is very serious. I have to pay home loan EMI’s, insurance premiums and tuition fees of my kid. My future is dark now. Vodafone spoiled my career and life.

Whether retired govt. pensioners will be medically dependent?

We are the employees of a central Public Sector Undertaking. In a judgment Supreme Court of India in M. P. Ojha case dated 18.12.97 (1997 Supp (6) SCR 654) Court has observed that retired Govt. Servant is wholly dependent on his employed son irrespective of his pension amount.

Our corporation’s medical rule is for dependency as under:

Family:

For the purpose of these Rules, family includes employee's wife, wholly dependent parents, children, step children and legally adopted children, wholly dependent upon the employee and does not include earning or married sons and daughters.

Note: Dependent parents

The term 'family' includes parents, provided they are wholly and exclusively dependent on the employee and are permanently residing with the employee under the same roof. A married female employee may also declare her parents as dependent on her provided they are wholly and exclusively dependent on the employee and are permanently residing with her under the same roof.
An exception is however made if the dependent parents have to be away for temporary periods, the limit for which has been fixed at 3 months in a year with prior information to the office. However, any exceptional cases should be decided on the merits of each case. It is clarified that reimbursement for regular treatment at a place other than the place of posting of the employee in respect of dependent parents shall not be admissible, if prior intimation of their absence is not available in the office and reimbursement shall be restricted only for hospitalization obtained in emergency. Further treatment in such cases should be obtained from the regular place of stay only. Such parents whose combined monthly income exceeds Rs.9000/- shall not be viewed as dependent. The Corporation reserves to itself the sole right of deciding whether or not parents are wholly dependent.

My query is that whether our corporation is bound to treat the parents (who are retired Govt pensioners) as medically dependent irrespective of Govt. Pension amount. If yes, then as our corporation is not following the Supreme Court order what should we do now?

Died in natural climity in kedarnath where to file case for compensation

hi friends,
i would like to ask you this question reply that my relative who was drive and went to Kedarnath with the bus and he died along with his helper and some passendgers in natural climities on 16-06-2013 at Kedarnath and he was on duty in bus that time. the bus was alos fully first party insurance.
now my question is where the legal hairs of my relative file suit for claim. whether the insurance company is responsible to pay claim to my realtive or only file against the owner . where file case to claim the compensation

Salary hold after resignation

Dear Sir/Madam,
Very Good Afternoon,
My Name is Kunwar Ajit Singh, I was Working with Haiko Logistics India as Deputy Manager Sales at New Delhi Branch. I Joined Haiko on 1st July 2009 and and I resigned on 16th Apr 2013. After my Resignation,Company has hold my 16 Days Salary , Which is 36,589 Rs. + My Bonus 10,000/- . I am doing continuous follow up but no one is responding me . I have all mail communications related with that subject. Please advise me any solution by which I can get my salary.

Non receipt of full & final settlemnt

I had worked with a company near about 16
years and I have left the company and resigned in 2004. But company has not yet settled my A/c.
Please advise, how can I force to company to pay my dues

Minimum wages act

WHAT IS THE MINIMUM WAGES TO BE PAID TO THE SCHOOL BUS DRIVERS AND CONDUCTORS AND AYAHS IN TAMIL NADU. ARE ALLOWANCES ALSO TO BE PAID IN ADDITION TO THE SALARY, AND IF SO CAN IT BE INCLUDED TO ARRIVE AT THEIR NET SALARY.

90 days notice period without making salary on time

Dear Experts,
I am working in a IT company.
I am depressed due to the salary discontinuity made by my organisation.

The company is not giving salary on time since from 1 year.
Sometimes the salary get after 2 months as well.

In my offer letter we have 90 days notice period.

Now due to the salary issues, I want to resign from the company.
But the problem is when I will put my resignation the company will surely not pay me salary on time or even they will delay it.

I have family responcibitity. I want to leave this organisation as earliest.

Do I have to serve all the notice period even delayed salary?

Please suggest what labour law states for such a scenarios.
