Dear Experts,
Our company is a BPO/Call Center and work 24/7. What I understand is, there is a permission given by Election Commission of India, to NASSCOM in April 2011 which mentions below:
"Sub-Sec(4) of Sec.135B of the Representation of the People Act, 1951, provides that the provisions for grant of holiday does not apply to those employees whose absense may cause danger or substantial loss in respect of the employment in which he/she is engaged.
My query is as per above permission can we work on the day of Lok Sabha elections by providing 4 hours of permission to employees who can cast their vote and come to work. We do give Off to out station employees who want to go and cast their vote. We also want to work with those employees who do not have voting power.
Kindly share your views.

i run a company..my employee left organisation and didnt return laptop and phone having information..He also mailed other employees of company blaming company that company dint follow policies and procedures..can v do something on this also..
which sec of IT act apply? circulation of emails comes under which act? pls guide..require blessings

When getting Bills from the Developer, what one has to check that invoice is correctly raised with breakup and there will no future liability to the owner of the assest on a/c of delivary the construction project to contractor /developer?
what are the laws are applicale?

hi,
I have been working in a company for past 2.5 years.at the time of joining i have given bank guarantee for 2lacs for 2.5 years from sbh on fixed deposit. In the next month it is expiring.my doubt is after bank guarantee expired,how to claim my fixed deposit from bank?
do i need to take original bank guarantee letter from the company?
i have beneficiary copy of bank guarantee, is it not enough?

My uncle was working as a indian army sepoy in mahar regiment. He worked as sepoy for 7 years & 6 month and after that he left the job without submit any reason in his regiment office. He is not availing any retirement benefit from indian army. After aprox. 23 years of left job a letter for starting pension come to him.
I want to know that can my uncle is eligible for pension, echs card, canteen smart card or any other facility.
He is very poor. He willbe very thankfull to you for guiding him.

Respected Sir/Madam,
I am working in Central Government. I was eligible for the payment of Approximately Rs. 50000 in 2009. I made several communications to administration of my department explaining my eligibility for the payment and requesting to release the payment but the competent authority informed me two times that I am not eligible for the payment and he didn't release my payment. When I wrote to next higher authority about my eligibility and requested him to release the payment with accumulated interest, the competent authority,who was earlier denying, released the payment in 2013 i.e. after four years. I was not paid the interest of four years on my amount. The competent authority said that there is no provision of paying interest as this is the procedural administrative mistake. May I get the interest of four years from the department or erring officer on my delayed payment through Hon'ble courts? If yes, should I approach to Hon'ble Tribunals or Hon'ble High Courts?

As per current existing law in private sector Leave Encashment ,Bonus and Gratuity for employees whether it should be paid on Gross salary or Basic Salary. Thanking you
Dharna pradarshan by contract labour union not registered with the establishment?
Seniors,
a contract labour union which is never been recognised or registered with the establishment but duly registered with labour office gave notice to hold Dharna and strike out side the establishment. Copy of the notice is also given to labour officer and the Deputy Commissioner.
The contract labour union is threatening and demanding to take back all the employees who were dismissed or terminated by Contractor working in the establishment.
All these employees were the employer of the Contractor and not the Establishment.
Establishment is a Co-operative Society duly registered with Sub registrar and in collaboration with state Govt Providing Ambulance and Hospital Research services to the Govt Hospitals in the State. Its a non profit organization and is funded by the Govt itself.
Kindly advise the remedies available?
Can the establishment fight in Civil Court for injunction against the Contract Labour Union?
What can be done in this situation?
