Hi,
I am working in Lucknow for a Gurgaon based education company. The company has been paying delayed salaries since last 2 years. I am getting around 30k in hand. We as employees have accepted it and are still working. Lately, I thought and working for such a company even after not getting paid on time is useless hence I restricted my working (Usually work from home as company did not pay expenses and salaries on time). Recently company officials visited the site and found a need to change the employee (ME) with another person as I was not giving my 100%.
They sent me a performance notice. My questions are as follows:
1. Can I file a criminal/civil case against this?
2. Is it ok to not work if I don't get paid on time?
3. Can company terminate me on performance grounds?
4. Is there I way I can get a stay on my FnF and stay on hiring of a new person at my place or stay on the work (The number of schools I used to look after) so that till the matter is sorted out, no one else can take charge of the clients assigned to me?
5.Should I resign or just wait for them to terminate me?
6. There are others also who are facing the same issue. They can come along with me however they are my reportees.
Till date I have not been paid for Feb 2014. Kindly help me on this as it is really important.

Hi,
I am working as a sr.engineer in a partnership company since 8 years. There are around 5 office staff and 5 shop floor workers who worked day and night during March period. But because of some personal issues I was forced to take leave for 4 days out of which 2 days leave was informed. But now he has suddenly terminated from a job without giving any advanced notice. And my concern is at the time of joining I was not given any appointment order. So kindly suggest how to proceed to lodge a complaint.

Respected Sir/Madam,
One of my friend has acute stammering/stuttering problem, he clears the written exams of several government/PSU jobs but fails to clear the interviews.
Is there any law in India which states that stammering/stuttering is a disability so that he can show this problem as a disability and thus can get reservation.
Please, help...

Hi..I am currently working as a Marketing Officer in a govt bank from the past 6 months and have signed a bond of 2.5 lacs at the time of joining. But the job profile of Marketing is not suiting me and hence I gave another Bank PO exam and qualified it now.The issue now is how to transfer the bond from current bank to the another bank which I am planning to join. Moreover, the new bank which am planning to join has no service bonds and hence rejecting any transfer of bonds.
The new bank says if I want to join their bank,I have to pay the previous banks bond and then join the new bank.Because they cant take the responsibility of bond since there is no bond in their organization.Since 2.5 lacs is a big amount, its not possible to pay.
I also read many clauses and articles about the transfer of bond
I sincerely request you to tell me the procedure and help me out of this.
Awaits your response,
Jina Dey

I am a Central Government servant and was suspended about 8 months for judicial custody exceeding 48 hrs. and investigation under process for a criminal court. The criminal case filed against me was put an end with the order of acquittal wherin it was stated that "the guild of the accused not proved beyond reasonable doubts and hence benefit of doubt extended to the accused." My department head has refused to regularise the period of suspension stating that the acquittal was given on benefit of doubt and therefore it is not a "honourable acquttal" and hence the suspension is justified. Please clarify whether the decision is in accordance wth law.

Hi,
I work as a Casual Compere at Gyan Vani FM Radio Network at Hyderabad on the frequency 105.6 MHz (IGNOU Educational Broadcast Division, New Delhi)purely on assignment basis for the past 7 years plus (infact right from its inception)
Past week I sent a mail to the Regional Director IGNOU Hyderabad and to my other friends to inform to our Asst. Station Manager (as I did not have the email id of her) about the inappropriate income tax deduction under 194J of the Income tax section (Any services beyond Rs.30000/-) is to be taxed. The Asst. Station Manager was charging for the entire amount (I got Rs.40000/- in a year and my taxable income is Rs.10000/- and not Rs.40000/- as the section clearly says it is beyond Rs.30000/-). So violating this the lady was charging higher income tax and setting a wrong precedent.
I could not take this and very politely and calmly I wrote a letter to my friends and Regional Director IGNOU Hyderabad (The Asst Station Manager works under her) to pass the attachments of the mail to her.
The Asst Station Manager came to know about it through the Regional Director and felt ridiculed and stopped giving assignments to me from there on.
I have been auditioned and doing the job for past many years. All I want to know and seek guidance from you 'How can she terminate me from the duties without assigning any reason?' Is this reason is sufficient to terminate anybody who are in the contractual position?
I am feeling so embarrassed and deserted over this incident that she(ASM) did not even bother to consider my seniority in the station (She had joined recently on contractual basis after her retirement). I am student and this was acting as my pocket money. How do I fight back on this please guide. Where and how should I lodge a complaint or get the redressal of my grievance?
Please reply!
Thank you and regards
PS: A copy of the letter written to the Regional Director is also attached!
