Employment bond

i am currently working at a premier coaching institute as a faculty. I have signed a service bond with company for 3 years. they have taken 2 postdated cheques worth of 10 lakhs. i joined the company in june 2014. so its been almost 6-7 months i am working there. now I want break the bond as i dont see my career in the company. but i am afraid of the bond as they might take legal action against me if i leave the job. plus i came to know that employment bond is illegal in India. i am going through a lot of pain as i dont know what to do. please give some advice

Threats of suspension/transfer to govt. teacher

there's a govt school in delhi where i work as teacher for 3 yrs.

my vice principal has always been biased against me and disliked me from the very beginning.
even though i worked pretty well and students are quite satisfied with my teachings.
i had once complained against 2-3 teachers' misbehavior who are close to her.so she started pressurising me to take a transfer to another school which i refused.
this made her furious.now off late she has been issuing me letters and show cause notices over very reasons like not checking notebooks on time,reaching class 10 minutes late,etc.she always tries to show she manages the school v.well.she yells and screams at me publically even in front of students,staff,IVth class employees etc over minor errors.off late she has been threatening she'll get my transfer done or get me suspended.all the teachers support her because she's too lenient with them and lets them do dadagiri with me in school.

once or twice replied to her boldly that she must maintain my dignity atleast in front of students in front of whom she has no right to shout at me.
this infuriated her and made her even more verbally aggressive.
a few days later,an important file which was under my custody that showed accounts of money distributed to students through their class teachers got stolen.she's issued a letter over that as well.

few days later,a set of answersheets that i had checked also got stolen.

i keep replying to her letters thru speed post,and that's making her even more furious.
there are bigger mistakes and blunders committed by all other teachers which she always ignores.they never get any letters and show cause notices.some of their mistakes/blunders are:

1. selling jewellery,kurtis,cosmetics in school to colleagues occasionally

2. coming school at 7:30 to 7:45 even though reaching time is 7:15.but marking attendance as 7:15.however if students get late,they are made to stand for 20- minutes more separately in the ground as "punishment"

3. not going to class for many days or going very late

4. making students cheat in exams

5. standing in groups during assembly and gossipping even though teachers' diary has clearly stated teachers are not to do this.

6. few teachers(who are favourites of principal) sometimes go to nearby shopping centre to do their household shopping,return and then show their purchases in staffroom.

7. gossipping loudly in staffroom.

and many more things..

please tell me is there any way i can stop her from getting me suspended or transferred??whom shud i approach?i have no contacts in education department.i am a needy person with no extra income.my parents are retired with no pension,whom i support all alone.

PS- i am yet to be confirmed as permanent teacher.

Epf contibution limit 1800

R/Sir,
I am working as a teacher in a private unaided cbse school since 10 years and getting salary 23000.as per epf rule our management was giving rs.780 as epf contribution. now pf limit increase from 6500 to 15000 so our contribution must be 1800 by us and by school. but school management deducted only 1100 (780+320) as per new contribution, saying that it will deduct on basic salary not total salary.
so tell me that can we get 1800 epf contribution according to law or not.

Pls advice.....

I am working in a private company from last 6 years.i was appointed on contract basis for 6 months after that no contract was made.now the company is thinking to remove me.
Can i demand for any compensation or any amount as per laws?
every year the company issues me TDS and it is the only legal proof i have that i have been working in the company.

Pl encashment to non confirmed employee

i have one query regarding the PL encashment of non confirmed employees.

1. if i left the company in my probation period, can i eligible for pl and their encashment in f&f statement.

2. if yes, please specify the required tenure.

Payment of pf esic

Our company provides technical manpower to Organizations. The Organization(x) we were providing skilled manpower to has appointed another reputed company(y) and henceforth they will be dealing with us. We were previously paying PF & Esic for the workers. But now the y company insists that they will pay the pf esic and deduct from our payments.
Who is responsible for payment of statutory obligations
1. we- who are providing the manpower or y company?

Are managers part of management or union/association

Dear Sirs,

I shall be grateful if my following query is resolved.

We have a Manager who is President of the Staff Welfare Association of our establishment. The Association is affiliated to IFTU (Union).

I wish to know if Manger can represent Staff Association in the capacity of elected President of SWA and work against the interest of Management.

Are Managers part of Staff Welfare Association or Management.

Any precedent or reference to this effect shall be highly appreciated.

Non payment of prp for part year

I have resigned from NHPC in Sept 2011 after working for 13 years. NHPC had a PRP scheme and they had introduced a pension scheme in 2012 in accordance with the DPE guidelines.

1. NHPC refuses to pay part year PRP from Apr 11 to Sep 11 although the DPE guidelines nowhere debar employees on such count.

2. NHPC refuses to transfer employer pension contribution from Jan 07 to Sep 11 to my present employer's pension scheme which is a type of Employer Defined Contribution Scheme(EDCS). DPE guidelines clearly provides for such transfer where the succeeding employer has an EDCS type pension scheme.

Eligibility of pesion on resigning with a request to release from bank service with pension

I submitted my resignation on 19.12.2013 with a request to release me with pension benefit from Bank's service while working as Manager in Scale-II after putting in more than 33 years of service on medical ground giving 3 months notice which was accepted by authority at Circle Office with effect 16.01.2014 and was released from service on 30.04.14. I had submitted my Pension payment proposal from the Branch where I was working as Branch Manager 09.04.2014. Authority never asked any medical documentary evidences from me to show that I was medically unfit. They even did not refer me to medical Board.
I approached my authority in writing several times at Circle Office to release my pension but never replied to any of my letter. Finally on 24.09.2014 Head Ofiice, PF & PENSION Department informed me in writing that I do not qualify for Pensionary benefit as I have resigned.
Under above circumstance Kindly advice me my future recourse, my legal stand for eligibility of pension and also let me know the limitation period for filling WRIT petition with High court Kolkata if I am finally required to approach court for the same.
