service agreement

I joined company on 30oct 2014,after having sat for six months company sends me to abroad for training recently company came with a policy of two year bond or two lakh rupees.however before sending abroad it took an undertaking on official pad that i will sign the bond after return. Please tell its validity

Salary not provided

Hello,

I was working with Navigant technologies based in Gurgaon i left my job in april 2015 and this is my pf account GN/GGN/OO34/039/0326 as on salary slip but when i want to check balance it shows that your account credentials are incorrect. I asked with HR they told that in June first week it will be correct but still there is same problem HR not receiving calls now so please advise me what to do.
Also they are not giving me fnf salary of 1 month of notice period.

Bonus & pf act

Respected Sir

I am jay bhogaita, I just recently switched my job my previous Company is not giving me salary of month of May 2015 & June 2015 as they are saying I had to give notice period of 45 days.. If I do so then they will give me salary... So legally they are right ??

My question no. 2 about Bonus & Provident Fund :-

I joined my last company in August 2014 I worked there still June 2015 now they deny to give me bonus of 8 months as they are asking about notice period so are they Right ??

As per rule if salary is below 15,000 rs per month they have to give provident fund and my salary at there 14,000 per month... I asked my PF number they answering same without notice period you can't have....

So they are legally right about salary, bonus & PF holding ?? Or can I complain my previous contractor company to principal Employee ?? Please Answer me Sir...

Urgent & most imp -relieving letter not issued

Hi All,

PLEASE HELP -

My X employer ( say Company X) is not issuing relieving letter & My Present employer (say company Y) wants the same.

My Terms of appointment with X employer was to serve 90 days notice period which i didnt;

As per appointment letter of X company conditions -

By 90 days’ notice served in writing by either side immediately after completion of probationary period , or by payment of basic salary in lieu of notice if management approves , or unexpired part of the notice period or remaining absent for a period of 90 days on account of ill health ,accident or disability or any other reason without being sanction, being medically unfit if same is certified by qualified medical practitioner appointed by co & without notice or payment in lieu of notice on your being found guilty of any gross default or misconduct or for non-observance of any rules of the company ,or terms of employment.

I left Job in Mar'15 & Joined Y employer in Mar'15.

Im ready to buy out Notice period, further my 50 Leaves are accumulated.
But They are not ready to issue relieving letter .
X employer has made my replacement in April'15.

My Present employer ( say Y company) had issued me appointment letter on basis of written declaration on blank paper that i will submit relieving letter in next 2 months and now they are threatning to terminate me.

Pls advise legal position how to obtain relieving letter.

Taking wife on official tour.

I am a PSU employee. Recently my office nominated me to attend a seminar/conference in South India. I want to take my wife on this tour. I am bearing all expenses in respect of her stay and travel. I have enquired from hotel they will be charges us tariff as on double occupancy, which are slightly higher that single occupancy. I will be claiming only single occupancy charge from my office.
However, recently I confirmed this from a finance person, he told me that on account of stay charges only half would be admissible to me.
As our TA DA rules are silent on such issue, please guide in light of Central government rules, as wherever our own rules are silent, we follow CCS rules. Please guide.

HRA POLICY

I am employee of SAIL, ASANSOL resides in quarter as no HRA for our institution (HRA AMOUNT RS. 1832 AS ON GRADE) & my wife is in state government health (HRA RS. 1452 AS ON LAST PAYMENT) stays with me, her organization stops her HRA as she stays with me, is she able for taking HRA?
Please reply me urgently.

Bnonus & incentive denied

I have worked with XYZ BPO company for 2 years & resigned in Apr'15. I have been denied certain monetary benefits(refer below) due to resignation which I think on moral & ethical grounds are wrong:
1) We are entitled to receive bonus for the last calender year in the month of march i.e. for the FY 2014 it is due & paid in the march month salary I also received the same but due to some computation error it has been paid less to me as discussed with HR. There has been a revision in the Bonus took place in April salary not only in our process but across the organization but the same has been denied to me Since I have resigned in April. Ideally on moral ground it should not be denied since I was not in notice serving period in march which is the bonus payout month & if something went wrong in the computation I am also entitled to get the same.

2) We also entitled to receive certain client bonus on completion of 1 yr of service with the client which I already completed on 19 april(Resigned on 1st april). This client bonus is covered by the agreement with the client & not as per organization policy. There is nothing in the agreement so far as I know that it can be denied if a person tenders the resignation notice. It simply states it is to be paid on completion of 1 year with the client which I already completed but the same also has been denied to me.

Please advice me how to proceed further on this since I don't have much funds to proceed further on this & I am bound by the arbitration agreement with the employer.

Non payment of salary

Sir, I worked as a faculty in an Engineering college for more than 1 year. Due to irregular payment of salaries, I quit the job after intimating them the same as I have my own personal financial conststraints. At the time of leaving the job, The college has to pay 4 months salary to me. I used to go to college regularly for collecting my salary but they are simply saying next week/next month etc. Thus 1 yr has passed and till now, I didnot get my salary. Please advise me how to collect it at the earliest. The Engineering College is located near Ibrahimpatnam, Rangareddy Dist, Telangana.

Public interest litigation

I have sent a letter each to Chief Justice of Supreme Court and Hon'ble judge Shri Vikramaditya Sen requesting them to treat the letter as public interest litigation. SBI has suspended some officials including myself for last 2 years without any charge-sheet. They have not even replied to the appeal. They were waiting for the retirement of GM who has retired now.

Can it be considered by the judge?Can I know the fate of my letter? I was inclined to fight through an advocate. But financial condition right now is not in a good shape. I had offered Rs10,000/ and another 40,000/ in case he wins the case.But he told that the minimum fee is Rs40,000/ for filing and further fee for subsequent appearance. He advised me to go to High court where fee is low

Not giving Relieving Letter and Not Allowing to Leave Compan

I have been working with a software company in hyderabad since December 2006, i have got a good opportunity to part of a prestigious organization in JULY 2010.

I have submitted my resignation and offered to serve the notice period of 30 days. But the my managing director is a bit aggressive person, who was not ready to relieve me with 30-days notice period. 30-days is the usual notice period. but my MD is an arrogant person, who have not much respect for employees, he considers like "i pays him" kind of attitude. So he threaten me like, if you talk much about 30-days noticce period, He will make me stay with 90-days notice period and so that i will lost my chance to move to another company. The reason he says is he wanted me to start a new project and after finishing that project only i can leave. I was senior employee in the company, qualified good enough, and he treated me like a slave after submitting my resignation.

He didnt even replied to my resignation mail or acknowledged. Wantedly want to harass me.

So i have no other option other than taking voluntary relieving. So i submitted voluntary relieving and left.

Next day when i went to office to collect my belongings, he told me to get out. He asked me "Why did you come, came for stealing anything, what did you steal like that?". I was totally disappointed and left the office. I was been working there for 3 and half years and he didnt even respect my sincerity and how efficiently i have been working. And called me a thief... and asked whether i came for theft. it was such a disappointing experience i have.. He forgot all the work i have done for the company. How much contributions i made for the organization growth. he started treating me like an enemy...

He never replied to my resignation mails. Never answered to my calls, and mails asking for RESIGNATION and RELIEVING letter. For my future purpose, i want RESIGNATION and RELIEVING letter.

How can i obtain it. Is there any legal ways to obtain it. I was been working there for 3 and half years, how can i leave those experience behind.

How could i comfront him. Any laws or labour court where i can raise a complaint..

He is a rash person, when some body going against his will. He will consider him as an enemy and do everything to destroy their career. so many people has faced this in the past. He have wealth, so he is trying to treat every one with it.. He will bribe the police and top officials and frame up fake case against the person etc.

So is there any labour provisions, i can file a complaint against him and the organization for not providing me experience letter. I never acted against the rules of the organization or never done anything wrong about the policies of security etc. His problem is i was a milking cow for him, and he couldn't like me to moving to other organization.

please advice me.
