Keeping original documents as security and holding back

Dear Sir /Madam,

One of my friend's employer had taken his School and college passing original documents as security.

Now my friend has resigned from that company without serving the whole notice period. The company says that it will not return the original documents unless he serves the whole notice period.

According to me its illegal. Can you please advice what further action my friend can take ?

Regarding appearing in upsc exams

Dear Sir,

Presently I am working in UPPCL as assistant engineer in uttar pradesh.I have intimated in written to my HOD that I am appearing upsc pre exams 2015 but still he is not giving me any leave in appearing in the pre exam which has been scheduled on 23rd august.Instead i has fixed my emergency duies on 23rd august too.what to do sir.Kindly help me out.

Maternity leave

A lady took maternity leave from the company but before the completion of the maternity leave period, she joined the service for 20 days. Now she wants to avail the balance maternity leave. Do we have to provide her that? Can section 18 of Maternity Benefit Act be used here?

I am working as assistant engineer in uttar pradesh power corporation limited,uttar pradesh gov.I have intimated in written in my department that i am appearing for upsc pre 2015 but my boss is not giving any leave or station leave permission for appearing me in pre exams .they have fixed my duties even on sunday i.e.23rd august.what to do sir,whether can i get any legal support.

Technical Resignation

I worked in AIIMS DELHI for 3 years as a STAFF NURSE and technically resigned from there and joined in same post in JIPMER puducherry.Can my pay protection be availed with last pay certificate alone or copy of service book from AIIMS DELHI is needed for it.Whether my service in AIIMS will be considered for promotion in JIPMER.Should one complete probation for availing benefits of technical resignation .

Noc to apply for upsc exam: psb probationer

Am in probation for 2yrs in the bank. Already have applied for UPSC, stating that concerned dept has been informed. Oral discussion with immediate superiors only suggested I conceal the info as of now. Also I have applied for leave citing medical reasons on lines of my superior's suggestion for next week. NOC is required only at the interview & the undertaking is to be agreed upon with the Commission about informing the present employer after applying, so should I inform the bank before prelims(considering that I've applied already) or after applying for Main or only when the NOC is reqd.? Kindly advise.

Procedure

A writ was filed under Art.226 before a single judge and the same was dismissed against a settled law.

If I go for a review and get dismissed again, can I go for an appeal under 227 before bench or I will have recourse only under 32 before the Supreme court alone?

Please advise me whether to go for review or appeal.

Departmental inquiry - regarding.

I am a Central Government Servant governed by CCS (Conduct) Rules. I am facing both Criminal Case filed by CBI and Departmental Inquiry. All the original documents relied in the Departmental Inquiry are now with the court custody. The Investigation Officer of CBI has attested the photo copies of the documents and forwarded to the Department with an instruction to initiate Regular Departmental Action. The same Investigation Officer of CBI has been cited as a witness in the Departmental Inquiry by the Department. In the above circumstances, please clarify whether a witness himself can attest the documents (he is not author of the documents eg. bills of a particular shop) and mark as an evidence by himself in the Departmental Inquiry. Since he is the Investigation Officer who has filed the criminal case in the Court, can his witness be treated as biased and cause prejudice to the delinquent employee? Thanks in anticipation.

As per my ctc statement gratuty is the part of my ctc. Does company bound to pay ex gratia of gratuty if i seperate within one year.
