Temporary worker is employed in our Company-service industry for 2 months-
1) Will he be entitled to benefits such as ESI & PF? If yes, can he challenge his termination of service after expiry of his period of appointment viz. 2 months?
2) How many leaves shall he be entitled for these 2 months?

A few days ago I had already sought the advise on this topic. But, as I had not explained the facts and circumstances of my case, I could not get effective guidance by the experts.
My case is that I was absent from duty as on the date of enforcement of revised pay rules and retired from duty during my unauthorised absence period. Departmental authorities had accorded me the sanction for fixing my pay in revised scale and the payment of retiral benefits computed based thereupon.
The Pay and Accounts Officer, suo moto and unilaterally, has authorised my pensionary benefits taking into account the actual pay drawn by me, immediately before the date of commencement of my absence, in the old scale.
In a similar case the HC had quashed the action of the PAO and upheld the sanction of Department. The Division Bench of the HC too had confirmed the judgement of the Single Bench. The entire benefits, as per the departmental sanction, were paid the petitioner in that case upon his filing Contempt Petition. As such, I had requested the PAO for revising my Pensionary Benefits by extending the benefit of the judgement of the HC which covers my case from all four corners. But, PAO had informed me that as it is decided to file SLP before the SC against the judgement and order of the HC I cannot be extended the benefit thereof.
Now, the operation of the judgement and order impugned by the PAO in the SLP filed by him came to be stayed by the SC I am adversely affected by the Interim Order of the SC.
Therefore, experts may kindly advise me as to whether I may become intervener in the said SLP.

Persons selected for post on contract didn't get required marks in written and interview as per policy of recruitment. 50 marks were required but no body got more than 41 marks. Also they were regularised just after one year. We were regularly appointed after three months of their regularization. Can we claim and will be granted seniority above them.

Hello,
I'm a permanent teacher in Delhi government school,employed since 5 years.
I'm facing several health issues and want to apply for EOL(Extraordinary Ordinary Leave) for 1 month on medical grounds.I'm under the treatment of a homeopath.I can't go to a MBBS doctor as allopathic drugs do not suit me.
I very well know that the medical certificates of homeopaths are allowed in case of medical leaves.
However I wish to know,if the govt department accepts medical certificates of homeopaths to grant EOL on medical ground.
Please advise urgently..

Our union leader is workmen director of our bank
I am clerk and working since 3 years in remote area and my batchmates have already transferr4to their preferred places i have noticed that our union leader interfere too much in transfer related matters and make management do what he wants
I want to know whether i can oppose him ? And if yes what precautions i have to take to fight with management and union as i hve got injustices in every manner ....

Let me introduce myself first, my name is Dhaval patel earlier I was in arise solution (a recruitment firm/agency) I had worked for 11 months in this company as a HR Recruiter/Recruitment Executive. i have been associated with this from 12 Jan 2015 to 27 Nov 2015.My LWD was 27 Nov 15. I left this organization due to some personal issue without serving notice period of 45 days. Now according to them I am absconded from the company and I will not be able to get any PF and other benefits. In the month December only i was having conversation with Mr Niraj From Arise Solution first he told me that you can consult with PF office directly and I am not bounded to help you regarding your PF.
Before ten day I visited PF office at ahmedabad they told me that I have to submit forms to PF O office with the sign of my last employer post this I had visited arise solution but again they told me you have to pay to the company amount of 34 days as you had not served notice period. I told them I was not having situation where I can serve notice period but they clearly denied me that until and unless you will not pay this much of amount of 34 days I will not sign this form you can go anywhere where you can.
Now the concern is this my CTC was 13500 per month and PF amount is near by 3000, so if I have to pay near about 15000 to get 3000 its not feasible for me
As they have not send me any letter of warning nor for absconding and according to me if any employee is not responding then and then only you can declare him as a abscond and you can not declare him without sending any show cause notice or warning letter.

My wife was got topped in competition exam held by District Consumer forum, Mohali for the post of clerk. after the test the authority scratch the said post due to the post was refilled due to demotion of the person who was earlier promoted. after 2 month one vacancy was being vacant again at same forum but on that post the said authority have not selected the candidate from the said merit list. in the mean time one post of clerk being vacant at district forum, fatehgarh sahib. the authority selected their own person at there and transferred him to the district forum mohali. then what should us do for this. can we file CWP in high court to get the said post.

Sir, I am employee in District consumer forum, nawanshshar Punjab and i have been transferred to mansa whict is about 230km from the said place. I belong to the district cadre. I have been transferred due to that i Have been filed R.T.I to seek some record from another district forum regarding recruitment, thats why they have transferred me. I am under probation and completed 1 year of service. My wife is working in judicial department and posted at the same station where i was working. I have 2 year old child and my mother is senior citizen. my father is expired. I am single male in my family. Now the higher authority is harrasing me by transfer and pressuring me for resign. what should i do that i may be re transferred to the earlier station. please help me.

Transfer to other department
Sir i am working in consumer forum, mansa and i want to change my department and want to go to another department. can i go to another department through proper channel. i want to go to judicial department from consumer forum. i am on regular post and working from july 2015.
