Proceedings

Case was filed before Assistant Labour Commissioner / Conciliation Officer which was completed within 3 months in 3 proceedings and sittings as both the parties attended the case regularly. Labour Commissioner did not sent sanction and directed the Assistant Labour Commissioner that since the case was comploeted in 3 proceedings / sittings which should be in 5 proceedings / sittngs. As now again notice shall be sent to both the parties which will take time and I an unable to approach the Labour Court without reference of the Labour Commissioner. Please clarify that is there any such rules that proceedings should be done in five sittings and not in three sittings. Can I approach the High Court for such an act that early disposal of case cannot be done. Please advice.

Case status

Sir, When we Checked the status of our case in High Court website, Posting Stage is shown as INTERLOCUTORY and Status as ADMIT. My query is what do they mean?

Mental harassment on women at workplace

I work in HDFC bank
I am facing a mental abuse from my branch manager, who is forcing me to leave the job.
Even though I am on incubation period only he has made my life a living hell.

What to do for getting leave

Hello sir.
I am a government bank employee. I want to go on tour for 10 days and i have done all my reservations of train, air and hotels amounting Rs. 50000(approx). I have applied for PL before 1 month of journey.
My management rejected my application and saying that in your branch there is only two staffs then how can i give you leave.
Now what should i do for my loss of reservations etc.
And in future what should i do to avail my leave.

How many number of leaves can be accumulated by an employee in a private organization ( Maximum ) which can be encashed at the time of leaving the organization . I want to know is there any maximum limit .

Employee does not serve the notice period

Hi

Our company ask for 1 month notice period on the resignation. One of our employee put resignation on 18 June, 2016 and stated that he will serve till 1st July which are 14 days. Company had not very good experience with this employee so they release him on same date without any document. Now the employee is asking for salary for first 18 days as well as the experience letter as he has joined somehwere else.

What does the law says that is it advisable to give him salary as he refused to serve 30 days notice period? Do we still owe him experience letter?

Settlement is due

Hi,

Recently my employer asked me on June 20th 2016 to resign within 10 days as company was under some financial trouble. I asked them for settlement under Bombay Shops & Establishment Act as company is registered under the Bombay Shops & Establishment Act.

Owner agreed to pay me June salary along with one month's salary as compensation and agreed to avail my balance leaves (10 days) under settlement period.

I resigned on June 30th, CEO assured me to pay June salary before July 5th 2016, and balance in the month of July itself. Now its 17th of July and I even didnt get my June salary. On every message to them CEO always replied "sure".

Let me know what can be done here as being a service person I would be in deep trouble if I didnt get my dues on time, I have pay various dues i.e. card bills, rent, school fee etc.

What could be the best way for a quick settlement?

I would also like to know - can any company hold your past month's salary for such a long duration?

How much time they can take for settlement?

Please suggest. Thanks in advance.

Conversion of contractual staff

Is it possible on the side of state government to remove any particular contractual staff of a department from the process of regularisation or left out at the time of cabinet approval and thereby post creation of the said contractual staffs which has different categories of post?

Regarding Direct Recruitment.

Sir,
In a Central Govt. office method of recruitment ( As per Recruitment Rules) for the post of Statistical Investigator Gr. I for 142 posts is 50% by Promotion and 50% by Direct Recruitment up to December, 2014.

From 1st January 2015 the Recruitment rules were changed and the new Recruitment Rules is 100% by promotion. After this the Department has made restructuring to the cadre and posts were increased to 425 I. e. (+383).

The department has given promotion to the employees by considering RR 100%.
But now department has sent 17 posts to UPSC for Direct Recruitment. Department is saying that these posts are backlog year vacancies and governed by old RR which is 50-50. I am in que for promotion for this post. By this DR recruitment I miss my promotion.

Sir, kindly guide me whether the old RR will apply after notification of new RR.
