Regarding old claims.

One of my known is an employee of Government of Rajasthan and he applied for Encashment of Privilege Leave three times in three years (one may surrender 15 days for encashment every year as per Rajasthan Service Rules} but due to mala fides the Head of Department sat on the applications and did not provide the same.Now
The HOD has changed, Can he ask for said claims again ????
Meanwhile his accumulated Privilege Leaves more then 300 days were lapsed as per rules because his above claims for Leave Encashment of 45 days did not considered by Head of Department concerned during his tenure.

Please advise.

28.98% weekly off and national holidays

Sir,
As a rule principle employeer has to pay 28.98% weekly off and national holidays for security personnel deployed. Is this right? If yes, Then can i get GO Notification please.

Offer Termination

Dear Sir,


I got offer from a software company, I got selected and company offered me immediate joining in one day. I quit my job and ready to get join. But suddenly on the date of joining my Grandmother expired suddenly, I informed the company HR and ask him for 4 days extension, after 3 days without any notice company terminate my offer. I suffered a big loss of money and till yet I did not get any job.

Suggest me what would I do.

Urgent help needed

Hello Sir's
I am working as a HR in a organisation in NCR.
We have certain cases of absconding employees for which the management has decided to pursue legal options.

We need to first start with sending legal notices to such absconding employees.

Hence I am requesting your help as I need to give an estimate to the management as to what would be the cost of sending such legal notices to absconding employees.

I just need an approx figure if its not asking too much.

Would be very grateful for your help.

Esi pf compliance

We Have Contractors Who Are Complying For ESI/PF . My Query: If We Get A Person For Service For a day to Repair Is He Required To Be From An Organisation That Is ESI/PF Registered. Eg Getting An AC Mechanic To Repair For Few Hours, Machine Repair By An Engineer Or Installation Of A New Machine Where The Supplier Has Less Than 5 Employees & Not Registered Under ESI/PF, These services May Be Required At Site Once In 3 /4 Months For &1 Or 2 Days .

Query regarding gratuity eligibility

Hi Sir/Mam,

I had worked with a MNC which works 5 days a week. My joining date was : 08/12/2011 and last day was: 24/07/2016 so the total time period would be: 4 years 204 Days.

As per Gratuity law the minimum eligibility criteria for me should be 4 years and 190 days. But my company is denying that and saying you must have completed 5 years.

Could you please confirm whether I am eligible for gratuity or not. If yes what action I can take against the company.

Regarding acknowledgement of my resignation.

Dear Sir/Ma'am,

I have resigned from my present employer as on 1st Aug 2016 on Mail, Its a Public Limited Company having corporate office in Mumbai . As per my Appointment Letter or Offer Letter,I have to Serve a notice period of 90 days from my resignation date. I am working in this company since 14th July 2014 and after one year of probation period last year i got confirmed my service and transferred to Gurgaon Branch Office. Now I am serving my notice period. I mentioned in my resignation mail to my manager that i will be serving my full notice period of 90 days and request to release after that and marked a copy to HR Dept and HR Head.

But my questions are-
1) My Manager has not given any acknowledgement mail to me about the acceptance of my resignation. Please advise me whether there will be any problem or not at the time of my relieving. By chance if they create any problem how to tackle?

2) What are the documents i will be required to collect at the time of relieving or joining in my new company?

I am seeking an early release from the company which has a 1 months notice period (I want to get relieved in 20 days and ready to buy out the remaining notice period). Reporting manager is not agreeing with it. What can I do in this situation? In the contract with employer one of the term is that they can terminate without assigning any reason by simply paying salary for due notice period on the same analogy can I pay them for the remaning my 10 days of notice period please help

Court's order

The labour court granted reinstatement without back wages.Emoloyer complied with the order.Can workman file revision(under M.R.T.U. and P.U.L.P. Act)before Industrial court. Even after accepting the reinstatement.
