regarding the licence

sir, please give me a advice.
1. what are the documents required and what are the procedures needs to follow to take licence under shops & establishment Act in karantaka, and what is the validity of that licence , after expiry of licence what is the procedure to renewal.

2 . why it needs to takes licence under shops & establishment Act, eventhough company is registered under comapny Act.

compensation

under what provision of law a co. whose employee died during course of business. liable to pay comensation where no t.u. formed.
how much compensation normally given by the co if person died during course of business worked 2-3 years, salary 3500/- excluding p.f.
the jurisdiction of which court applied in theese cases if died outside delhi office but working in Delhi

LORRY DRIVERS RESPONSIBILITY

Sir, I have seen your learned counsils answer. This puts me a question as - suppose the lorry driver is an employee of the company - the n what is the situation ? Secondly - coming to a daily situation - we engage a Taxi- We do not / cannot ask every time wether the drivers is having a real license ? / the vechile is insured & it is cutternt etc. Suppose some thing happens - if the above is missing - then what shall we do . You can read about the court in Tamil Nadu - is taking poessition of the Government Busses for not giving the compensation to the dead victims / legal heirs.This is because the Govt busses are not insured. If this is the case for the Govt bus - then imagine for the poor chap who travels in Taxi ?

Lorry driver's security

The police booked 338 IPC case against this lorry driver though he is not at fault. The lorry is owned by a transport company and the driver is not on regular rolls but he was working for the company for more than 2 years as on the date of accident.

Except obtaining bail for him the company do not support him in any manner. After the accident, the company forces him to leave the employment.

This driver is fighting against charges made against him in the courts of law past 2 years and likely to get acquitted.

Now the question is - Do this man has any legal remedy from his employer in terms of compensation - for his unsecured employment? Do company do not have any responsibility to atleast support this driver until his case is over?

regarding premature retirement benefits

respected sir

i served for 5yrs and 11 months in govt service and then resigned to join cpsu with prior permission and noc from the employer, now after 1&1/2 yrs they have not settled my dues, the account is not clear abt the eligibility of service and retirement gratuity, as i have read in swamy diary i am eligible for both, so kindly confirm abt the dues and also advice me wht to do for early payment of dues.

A Private Company suddenly kick out a worked employee who has work with company last 12 year as I T Encharge ( not given any notice & Salary without work).

What he have take legal action thought our advocate.

Full & Final settlement problem

I was resign in month of oct-2008 . Due to my Mothers health problem i was able to work for only 15 days . Since from oct-08 i am requesting to my employer for releiving, When i calling to HR they are advising to contact Business Head, where as when i am calling to Business head they are advising to contact HR dept. I already requested HR that i am ready to pay if any dues are there but HR is not repling properly. they also not giving me any experience certificate.

Please note that i had clearance form sign by all other dept, HSE, Admin, IT , Schools etc.


CAn any boday is there to advise me how i can get my releiving document & Same time how i can withdraw PF
