Sir , An employee raised an ID over his dismisal. During the pendency of the Reference he died and his eldest son was substituted. Now the Labour Court has passed an Award holding the dismissal was not justified and the subsituted legal heir is entitled to recive all the back wages. Now can the other legal heirs claim their proportionate share in the back wages which is a property.

Dear Sir
Greetings
If any company called for D.P.C after 4 yrs or so in managerial cadre & does not give promotions to a well qualified ,proven experienced person, without assigning any reasons, then is it not against the fundamental rights to live the life with dignity? Is it not abuse/tarnishing the image of a person.?
Please advice ,what to do & oblige.?

Dear Sir,
There was a judgement in the Hon'ble High Court of Rajasthan regarding the punishment to be given to the other persons involved in the crime.
In general during the enquiry 4 persons' names did appear but punishment is given to only one. I learned there was one historical judgement in Rajasthan High court regarding punishing the other persons involved in it.
Can any one please give me the citation of the case with names of the petitioner and respondent.
Thanks
Ali
A compromise under section 18(1) of the ID act has been done before a Notary.Whether such an arrangement valid since it has been done without the knowledge of the Labour forum created for this purpose.

Sir
I served in Border Security Force as Deputy Commandant for 07 years and 07 month from 1999 to 2007.
I have applied for service gratuity but BSF rejected with plea that my resignation was accepted without pensionary benifit and therfore I am not eligible for service gratuity.
Again I gave application mentioning that I am not asking for pension i am just asking for service gratuity which i am eligible for render service for more than 5 yrs. But BSF not replied.
Pl clarify whether I am eligible for Gratuity if yes what should I do.
