Foreign company threatened for legal action

Hello, One of the foreign company from Singapore has offered job. Initially I accepted their offer and send signed scan copy of offer letter. Later i realised that salary offered by them is not sufficient to live & survive in Singapore. So i have not joined, and later i denied. Now company is demanding one month salary amount and threatening for legal action against me, so i am worried about it..

Show cause notice

hello experts, can i issue show cause to an employee without showing any evidence against the employee ? the matter is like, we got information from the employee that she indulged in misconduct in the office. we have no other evidence other than the statement from the employee herself. so based on her own statement can we issue show cause notice to the employee ?

Notice period buy out

Hi,

This is regarding labour policy and buying out notice period, my wife is working with a finance company. The work environment is very poorly managed and there is lot of stress, the stress is that there is no limitation on working hours, the staff are expected to go home and process files till mid night, expected to work on Saturday's, public holidays and Sundays. The manager is openly saying that he doesn't want female employees and giving mental torture by humiliating people.

My question is how does it work when employees work for more than 9 per day

and other question I have is, the company offer letter is clearly says that employee can buy out notice period without any clause. But the management and HR are not letting my wife go and are expecting to complete 2 months notice period where as she has an offer with other company and willing to serve only one month and ok to buy the remaining period.

Need your valuable suggestion on how to tackle this, the managers are verbally humiliating and playing around with her.

Changing the nature of duty

HELLO SIR.. THIS IS GAURANG..WORKING IN A CENTRAL GOVT DEPARTMENT AS AN OFFICER...ACTUALLY MY DESIGNATION IS NOT RELATED TO FIELD WORK IN MY DEPARTMENT BUT I WAS FORCED TO SEND AS FIELD OFFICER IN FOREST. AS THIS DUTY DOESN'T SUITS ME DUE TO SOME PERSONAL REASON...CAN I SAY NO TO MY DEPARTMENT REGARDING THE SAME AND WHETHER IT IS A VIOLATION OF CCS RULES...AND I ALSO CAME TO KNOW THAT MY SENIORS IS PLAYING OFFICE POLITICS WITH ME, SO CAN I MOVE LEGALLY IN THIS MATTER..

Calculation of bonus using the annual profit (urgent)

Is that the annual profit of the pvt ltd company is relevant in the calculation of the bonus? if yes then please provide the complete details regarding the calculation of the bonus using the annual profit figures, you can assume the annual profit 48 lakhs.

compassionate appointment

Hi,

My father was working in Dempo dairy industry ltd Asangi. Which is unit of Karnataka Milk Federation (KMF), he died while in his service.

Now I am his elder son want to apply for compassionate appointment but when we asked in Dempo dairy about compassionate appointment they are informed to us that KMF has remove the compassionate appointment.

Since we do not have any other source to run our family I want to get my father job, kindly suggest to me what I need to do.

Advice: full and final settlement pending for long time

Our full and final settlement has not yet been made by the company. It's the habitual practice of that company. whoever demands strongly for the full and final settlement, they will threaten by sending legal notices. Further, the company will not support and fails the employee verification process for such employee.

Last time few employees have been tried to file a police complaint for the delay in salary for the period of almost 3 months. Then they've been terminated immediately and notices were sent to them as the company name and fame have been spoiled and demanded to pay 25 Lakhs to the company as compensation.

It's been more than a year. All employees are feared of getting involved in unnecessary disputes with the company. We all held non-managerial positions.

1. Please let us know whether it is possible to file Winding-Up petition for recovery of salaries under the Companies Act 2013?
2. If yes where to file High Court or National Company Law Tribunal?
3. How long will it take in Winding Up petition?
4. Please mention if there are any alternative processes for effective/speedy results such
(a) Labour complaint
(b) Writ Petition
(d) Criminal Complaint
(b) Civil / Summary Suits etc.

Full and Final Settlement

I worked in Philips Healthcare R&D,Pune from 7th November 2016 to 31st March 2018. In January 2018 company has taken restructuring decision and my post was redundant. They gave me time upto 31st march 2018.
I have took lease car from company in January 2017, which I gave back to company after lay off. Now hr is asking me to pay for the car and they are not giving me my layoff amount and full and final settlement money.
What should I do.
