Dear Experts,
Que.1.In Order to avoid Delay, Can a Divorce Suit be filed directly at Supreme Court?
This Question I am asking because their is always a scope to challenge the lower court orders in the next higher court, in such a context what is wrong in opting for Supreme court directly Which would delay the process of justice!

i want to know
(1) how court decides maintenance under ipc 125 ?
(2) once fianlized, the maintenance value may change time to time, if yes, who can change ?
(3) for howmuch time i would to pay mainteancne as i am ready to bring my wife back and she neighter wants to come back nor wants to give divorce ? what to do in such circumtances ?

I have taken decision of customary diverse from my wife. The customary diverse will be made on Stamp paper before panch. So I need draft of customary diverse.
Can anyone give me draft of customary diverse?

Hi,
I had lent the money for a distant family relative (woman & her husband) in Mumbai in April 2008 to pay advance to rent a new flat, as they had financial problems. After 2 months, I had to go to out of Mumbai as I got job in my native place and they promised to return me in installments through bank deposit to my account.
After leaving Maharashtra, when I tried to call them, they purposely started avoiding my calls and ignored me. Even after a year, they had not returned 20% of the money. Last year,I got a chance to talk to them on phone along with my parents but these people changed their attitude & started to abuse my family in a very cheap and derogatory language. I had recorded all the phone conversations and filed a NC complaint at the local police station in August 09.
After a week, the Investigation officer(PSI) demaned bribe Rs 10,000/- from me to get them arrested and refused to do any inquiry without money. However after repeated requests, he took Rs 4,000/- from me to call them to Police Station. He gave them warning and got a summons notice signed by them. He also arranged for a compromise and asked them to start returning the money in installments and asked both of us not to keep any contact with each other in future.
At that time, I didn't take the case to court & showed sympathy to them as they were my distant relative and also I was out of Mumbai. At the police station, the lady threatened me that she will file a wrong case against me if I file a case in court...saying that I attempted to rape her and I tried to rob their house & other false allegations which never happened.
Later, I got a note signed by the woman & her husband mentioning that they owe me only some money as against the actual amount. They started to pay for 2 months by installments after the complaint and stopped paying me back. I have not tried to call them after this as per instructions by Police. We are a respectful family and well educated. Nobody has hurt us or insulted us like this before. These people have humiliated our family very cheaply, destroyed our mental peace and also caused an irrecoverable emotional damage for the mistake of trusting them.
Now, even though I'm out of Maharashtra, I want to pursue this case and have them punished legally for their offense.They have not paid back my money even after 2 years and abused/threated me & my family. I'm planning to visit the local Police station and get a FIR now.. I'm also confused since I cant trust the police as they seem to do anything for people who pay them money and also I'm not a local Marathi guy. These people who cheated me are dangerous and there is a woman involved who is threatening me to file false cases. I read an article on the internet which said that Indian Laws support women.
I do not know much on the Indian laws and need help on how to approach. Things I have as evidence:
1) Recorded conversation of all phone call threats and verbal abuse
2) Note signed by them mentioning they owe me money
3) Duplicate NC complaint copy from police station stamped with a complaint no. & date

i married in arya samaj but parents of the girl had kept her captive and lodged a case against me by her daughter thao i forcefully married her. the counsilor of the court tried her level best to make her negetive. my wife told the female counsilor that this case was forcefully done but five times the counsilor of the court didnt accepted her wordings.at the same time the girls mother tried to commit suicide and her father terrorised her to "go against the boy or i will also die" then she said to the judge that she dont want to continue the marriage. the girl is still with her relatives. iam not getting any support from the family coutr of bhopal. many of the court persons are under the influence of money given by her father.kyaa abhi bhi kannoon ko khareeda ja raha hai please help ne ansh joby mathew

In a family court case I have received a private notice, is it possible to take time in family court to replyto the private notice.
Should the reply be in terms of a counter to be filed in court. The notice is numbers with a IA number.
Please clarify.

Que.1.Why is that Courts are not sending Respondents Copy Along with Summons?
Que.2.What is the Process of Collecting the Respondent Copy (without any Lawyer)once the Petition goes to Court room ?
Que.3.Does the Respondent Get Time to file the Response after collecting the Petition on First hearing from the courtroom?

Actually my wife has filed 13(1) case for divorce HMA.
It was as per my and my wife's predecided settlement in lieu of lumpsum alumni.
But i have not received summons in this regard.
The date to file W.S.A. is given to us privately by girlside only by phone and a copy of the filed petition also given by herside privately.
If without summon ,I file W.S.A. the will further proceedings will be valid or not?
Is there any chance of cheating with me?

suicide threat by wife
dear sir,
I m 30 years old, Govt servant. I m in great trouble. I did registered marriage with a girl 3 years back. But we didnt start living together. She is living in her house and I at my fathers house.The reason is that I could not arrange to live together. But since last couple of months, she started to threaten me to commit suicide at my fathers house, if I dont start living with her immediately. She even dont listen my any request.
Now please help me, what will I do with her? If i start living with her, she may commit suicide at the slightest causes. Because, she had already started to talk about suicide. Should I file any FIR against her threat?
Please advice....
