Hi
I m fighting an interim custody/ visitation case with my husband for my nearly eight yr old child.The child stays with me and wasnt given custody or vistation rights during mutual consent divorce.The was nearing judgemnt but the judge changed and the new judge has put the case in miscellaneous.
my last hearing was on 4 may 2010. The judge was changed a day before only so he ordered the next date on 17 July 2010. but meanwhile my ex husband has applied for interim custody for 20 days during the summer vacation and a fresh date for the above request hasbeen given on 14 may 2010.However I receive the court summon letter on 13 May 2010 at 19:30 hrs.
My lawyer has cited unavailability for tomorrow since he has prior commitments
Kindly advise:
Q1. What should I say when I present before the court since my lawyer would not be present.PS. He has advised me to take another date.
Q2. Is interim custody possible without the judgemnt being given--- since the whole case is about interim custody and visitation...
Q3. I m ready to givehim supervised visitation in absence of his present wife.( I truly detest her. Also I dont think my child needs to meet her.) once a month but he insists on meeting the child in presence of his wife. Kindly advise.

We got married in the year 1994.In the year 2003 i caught my wife cheated on me.We have lived away from each other for a period of 4 years. (2003 to 2006) and our daughter has been in custody of my wife.I forgot the past and invited my wife to my dad's house to stay together with our daughter. Thereafter we are living under one roof for the benefit of our daughter but there is note even a verbal communication from my wife with me for a period of 4 years (2007 to 2010) and no relationship whatsoever between us and our daughter living in isolation even after living with us together in the said period.My wife lives in the bedroom. My dad expired leaving a will and nomination form in my name but the society has still not transferred the flat in my name.Now my wife wants to go abroad and told me that she will move first to Dubai for a job at her Uncle's company along with her daughter.I have asked for a trial seperation and she has agreed.I need urgent assistance and guidance as to what I have to do.I am at the moment jobless and financially not sound.Please help.
I have got married under the christian marriage act in the church and both my wife and me are christians.Thank you

Dear Sir,
Please inform whether one can file Restitution conjugal of Rights Application at Patiala court?
Please inform in which court (Senior Civil Judge or Addditional Distict Judge) this application is maintainable?
and what will be the court fees?

I am 30 yr old house-wife and am married for last 03 yrs. Due to continuous mental torture at in-laws,I have come to my parental home 15 days back. Before coming, I have informed local P.S.(requested not to take action)and Panchayat.
I want to give my husband a last chance if he agrees(in written)to create a healthy & peaceful atmosphere for me and my baby.
Everybody is suggesting me to lodge at least a maintenance(Sec.125)case.My question is if I continue without any legal proceeding and hope for my husband to come good in future, can he do against me anything legally( except RCR)in the mean time?
Please note that I have informed LOCAL PS & Panchayat.

Hi this is shaikh my wife had filed a divorce application from lucknow and i had filed rcr under mohammedan law in mumbai as i never want to divorce her i want to forgive her what lies she had said about me becoz i love her, My family members then in november 2009 had accepted the summons which was sent by lucknow court any how i had attended 1 date and the next date is on 20 may 2010 i will attend the same as well,
Rcr summons had been issued twice 1 st time she refused to take it from the postman a remark mentioned on the packet 2nd time since then she is staying there informed by their neighbour but it is saying that the door is locked i dont know whether the postman gets the chai pani from them, now 2 dates in mumbai is already gone
My query is
1)Can i personally take a certified copy and give it in front of judge
2)What can i do to call her and her family here so that they will come for negotiation becoz her mother wants to get her daughter married after divorcing me.

i would like to brief you again.about my case.
i god married in may 2008 and it was an arriange marriage .we are nomal family having a borther who is staying seperately and father is working in lic. the girls family is not ok.they have 5 children.before marriage i just wanted to complete her education and take up job, but their family told that she is graduate .but when i asked her she told that her brother saw on internet the result of her and she was cleared but the fact that she was failed.i was not convicenced by this point.
i am working in stock market .before marriage i had a huge loss .after marriage just after a month i told her abt the studies and to take up the job but she ignored it , she thought we are forcing her to do the job and we wanted money.
due tot his there were heated arguments every day.even my parents used to tell her to compelte her studies ,she used to abuse them.she used to say that my mother is not educated then why i am asking to complete the studies.
there was an incident in sept 2008 my both hands were burnt and she was staying at her parents palce she neither came home .
in 2009 she made an n.c stating that we are forcing her to take up studies and telling her to take up job and earn more money.this was came to my notice in oct 2009.
she even went bqack to her mother palce and staed there for 6 months , she came back in oct 2009. i had even done consuling with mahila takrar kendra but it dint worked. once she cuther hand witha knife ,and i made a n.c in police station. once she even wrote a sucide note mentioning my parents name and even my brother name .i had bought this to the notice to the mahila takrar kendra as police are not entertaining family matters.
even after comming back she abused my parents even used bad words for my mother.
i have the recording of some of her conversation.she repetadely theretened to commit sucide if i dint listen.
i ahve taken a seperate room, where she came with me , but there also she is behaving in the same way.she is comming back at @11.30.not preapraning food.she says that she will not cook food in the utensils which are given by my family.
she says she will saty at my mother palce because she dint liked the palce.and the palce was not bought with her consent.
i want to know can i file a divorce petition and can bring a court order for not entering my palce as she is creating trouble in my work.
on what ground which i should file case and proof would be needed to make my case strong

couple got divorced and now wife is planning for second marriage. She has 6 yrs old child and the custody is with her. Will maintainence paid by her ex husband continue after her second marriage? If child does not want to meet his father what needs to be done?

1. I have divorced to my wife on 12 Dec. 2000. (MUSLIM)
2.She did not receive divorce notice by registered post, SENT BY THE QAZI
3. she has complete information of divorce.
4. GOVT. QAZI OF HYDERABAS HAS ISSUED DIVORCE CERTIFICATE.
5. AFTER THE DIVORCE, SHE FILE THE 498A. SEC. 4&6 DP.ON 07/07/2004.
