Whether D.V. Act has prospective effect or Retrospective

I represents the respondent..... the ptr & respndt living separate since 2002.. later in the year 2009 the ptr filed a case under D.V. Act since they are living separate since 2002 itself i want know whether the D.V. Act applicable to this case or not.... i will be grateful if any citation is provided......

About Divorce

Dear Sir,
My brother is working in Gulf Country. Last year he had got married and return back to gulf along with his wife. During his marriage we did not demand any dowry from them. Their life went very well for 4 months until they visit to dr for check up. After diagnosed dr said his wife not able to produce egg for fertility. For medical my brother spent almost one and half lakh in gulf. My brother advised his wife take treatment from our home town while visiting to india but she refused to take treatment in our place and demanded that she wants to take treatment in her home town. My brother allowed her to go for treatment in her home town.
When my brother left his wife at her home for treatment based on her wish and said take treatment then cure it and tell me I will come and take you to gulf. Then her family started to abuse, torcher and threatening him.
They asked my brother come for fertility test. He went for test and proved that he is capable for that and also dr. said he does not have any problem.
Now his in-laws are telling, if you are not taking your wife with you to gulf, we will put dowry case on you and your entire family and we will not allow you to go back to gulf.
Now they started to tell he has illegal contact with his male friend who is in gulf. My brother is crying like anything and said that he does want to live with this wife. He wants to apply for divorce. On daily basis they are telling new lies about him which is unfair.
My question is if he applies for divorce, in the meantime if they file for dowry case what will happen. My mother is 60 yrs old and suffering from chickengunya disease. My mother is totally upset about this issue and she wants to commit suicide. We do not know what to do? My brother met lawyers, they are also telling, if they file dowry case, your entire family will be in trouble so think twice before going for divorce.
If we go for divorce, how we can tackle this dowry case if they sue on us.
Kindly advise me asap because my brother should report the duty in this month end.

Maintenance

What would be lower courts doing in case Husband is not earning
If Still husband has to pay to her divorced wife?
if yes, how much it would be in rupess, can some one give what is the range the cour would look (like < 3000 Rs or ?)

Marriage with mother`s brother

The practice of marrying mother`s brother is prevalent in South India(Maternal Uncle). Are such marriages are valid and legal? is this relationship not under `PROHIBITED RELATION` under Hindu Marriage Act of 1955?

UNREGISTERED WILL

My father died having written an unregistered will in his own hand writing which runs in two pages, but he has not signed on the first page. Will is made in detail in the presence of two witnesses who have duly signed annotating the date.
How the will can be Registered now for smooth dispensation of its contents.
In order to get it registered, application was rejected in first attempt without any enquiry on the matter.

Marriage

Last 2 year ago I have married with my beloved Neelam in Durga Mandir, than we decided that we will go to our home separately and would try to convince our parents that now we are married but after 5 month of this marriage Neelam has gave-up due to strong oppose of her family, her father has done her abortion, and make strong obstructions with her, Now they are planning for her marriage. How can I stay?
I have only (1) Marriage albem (2) An affidavit of marriage (3)Friends, who were on marriage.

divorce by mutual understanding

dear sir/mam,
Actually we got married in oct 2009, so is it possible to take the divorce by mutual consent before completion of one year after marriage ? kindlly do let me know about the entire procedur... how long will this take ?
