My Fiance is from Goa and I am from Chennai. We are planning for marriage registration in Bangalore under Special Marriage Act since both of us are here right now.
My fiance’s paternal grandfather had left a property for his children and this is under litigation. The problem is with respect to the percentage division of the property. My fiance’s dad is currently fighting for this.
a. Is it true that if we get married outside the state of Goa – my Fiance and me automatically lose the right to this property or fighting for this property after his dad - Does Goa have separate Portuguese/Goa property act? Or can we get married in Bangalore and it does not make a difference with respect to the succession/property law?
b. If we have to get married in Goa, does the Special marriage act apply here or is it a different act for inter-religion marriages?

Sir,
After a lot of cruelities from the one spouse, if other spouse prayes for RCR is it presumed to be condonation of earlier cruelities.

Please refer to my early query, I have approached High Court for investigation in Jan. 2011 and the local judiciary has come to know about my complaint. Hansi Court Magistrate Ashwani Kumar Mehta has now treathned me to punish for my courage to complaint against them. In my case though evidence is yet to appear in the court but before any evidence/argument the judge has given clear indication of my punishment through third person. I wish to ask upto what max. period he can imprison me under IPC 498-A, 323, 406, 452, 506 IPC

My frd had been staying with her parents since last 3 years , her husband has filed divorce case in 2005. and the court has ordered to give maintance of rs 2000. now my frd wants to prepare passport in her old name but, her parents has removed her name from the ration card after marriage.

Dear Sir,
Father was worked in central Govt. (Railway employee) retired and expired in 2002 left his wife, 3 sons and 5 daughters. All sisters and brother are married and living separatly and presently mother is getting his pension and giving his one son only. My question legally the other sons and daughters can claim that pension to share all of them or mother can do whatever she want.

There are affidavits to a court in mutual consent divorce.
However the court passes only a decree " dissolving the marriage".
1)What is the status of affidavits filed but ,not mentioned n decree?
2)Are the affidavits binding on parties,
3)If a party does not comply with conditions in affidavit , but not a part of decree,, will it amount to contempt of court?

I had asked a query that if in both birth and passport name is correct.
However in high school they have added fathers name, ho to reconcile?
Experts advised that immediate reconcilliation be done.
My question is which document is final and on whose basis others need to be corrected.

Dear Experts,
Can a husband be asked to pay maintenance for a wife for a past period when he sent her to her home and filed divorce and the process is carried out in the family court , when during such time she incurred medical expenses for her pregnancy ? Can the husband be asked to reimburse the amount spent by the wife for her delivery and for her baby - on production of the actual medical bills ?
If the wife is working at present but is asking for the reimbursement of expenses from her husband for the reasons stated above - is it permissible?

Yes the understanding of yours is absolutely right.
What i want to clarify is the following by stating the original facts:
Wife was sent to her parental home within 6 months of marriage when she was 3.5 months pregnant (November 2009)
Within 10 days of sending her home husband filed petition for dissolution of marriage (November 2009)
She delieverd a baby in April 2010
Wife was unemployed from her wedding till January 2011
All her expenses and her baby's are being taken care of by her parents
Till date (June 2011) the case is going on at the family court
The case is in the enquiry stage
Wife has submitted counter affidavit to reunite with her husband by has explained elaborately and denied the allegations with sufficient valid proofs
Can the wife claim maintenance for the period from november 2009 - january 2011 - Atleast for the medical expenditure for herself and the baby
