Divorce

Hi
My friend married a girl few years back and that woman cheated on him with other guys. So they headed for divorce. Mutual. All went well and their final hearing is next week. Believing things ll go fine and knowing the fact that girl s also in live in relationship with another guy, my friend found another girl and they decided to marry this March end. Marriage work s progressing. But now that girl says she can't come to this hearing as her father want her to wait until his arrival from abroad which may take a year.

Now my friend and his fianc� are in huge trauma. Is there any way this marriage can be held by taking NOC of that girl?
Ps: she mentioned to lawyer that she have no idea of reuniting as well. Its just the time factor her father wants to chk on the final docs as the mistakes where his daughter's.

Pls give an amicable solution.

My in-laws creating problem in my married life

I and my husband got married on 5th Nov 2018 in Arya samaj mandir as my in-laws were against it. He is 74 born and me 82 born.
We started leaving separately. My husband was talking to them and I was fine them talking to him but since then they were bitching about me. My husband was supporting so that was fine. I didn't know about my husband that he was alcoholic which I got to know later. He was not working for which he said he is starting a business and he is working on it. After marriage I got to know he is not doing any business but he started looking for job now it's been long my in laws interfering every time. They have taken our society's gaurd number and asking him for information. Everytime they do some or other CID on me. They asked my all details which I gave for there satisfaction bcz they wanted to do background check. They have taken power of attorney from my husband for his all property and taking rent in their account. We are leaving in rented apartment and expending from our savings. Now i am not allowing my husband to drink much and he is on medicine but whenever my mother in law calls him and bad mouth about me he start drinking and difficult to control. Last Dec on his mother's birthday she spoke about my character and Don't know what she told him so he started beating me and next day my medical was done. Police and my family and my husband asked for a chance so I gave him chance didn't report it but took from him in written that it won't happen in future in the same police station with that police station stamp and both of us signature.
Now since few days as I don't allow him to drink much and listening to his mom who purposed him to come and stay there alone without me on condition that he can drink there he started asking for divorce.
I love him and he also loves me. Bcz of parents bad mouthing about me and shortage of money he is doing this.
My in laws been to my home and had fought there saying they have money and power and will see me. They don't want their son to be married and want them back in any cost.
I want to know what can I do and what all laws are in my favor. I don't want divorce as I love him. I also know when I leave him he will be completely in to alcohol.
I don't want my in-laws property or anything else but my husband has few properties how can I claim for it as wife. My husband some time ask for few things like his watches and ring which kept by my mother in law in her locker but she denied even for health insurance too so we took another health insurance for both of us.
He has one house in Noida which is managed by my father in law and he is power of attorney for that flat and also taking rent in his account. Where we are leaving in rented accommodation and paying from my husband's saving.

They says that I married to my husband for money which is completely wrong.

Please suggest what I can do to take our property from them. How can I stop them interfering in our life. My husband at times doesn't understand and influenced by them.

What rights I have as a wife if he is asking for divorce as I never want this divorce and can't think of leaving without him.

My in-laws asking my husband to live with them without me. He is ready and thinking of going theee. What can I do in that case?

Please help me out. My father is no more and my mother is very old and stays with my brother. I can't tell her all this.

I am not working and depending on my husband currently.

Second Cousin Marriage

Would need assistance in regards to, whether is it prohibited or not if I marry my second cousin as per Hindu Marriage Act?
I would like to marry my father's mother's brother's daughter's son.
I would like to know whether such a marriage is legal or not.
Please advice with respect to the act and provide me with provisions.

Divorce

Dear Sir,
I get married in the month of July-18, at the time of finalize of marriage proposal, people from girl’s end verify the all facts of us i.e. salary, degree, bank statement etc. and same time they not inform anything about girls, just said that she is pursing graduation. So … asked girls that, whether u can read or write the English, she said yes and also asked you have any other problems, please tell frankly. Then she said that, no issue. At the same time, she cannot pounce the same word clearly, so I asked whether you have any problems then she said no, this is happened due to drink of cold water.
After marriage it observed that, she cannot read or write Marathi also, she cannot coke the food also. She is not able to do the calculation of small amounts. We tried a lot to train her but she is not capable to grasp it. One day she did very big mistake, she put her hand in the mixture and get injured.
We try to train her for 4 months, but she is not enabled grasp it, so finally we leave her at her parents house and told to her parent that, just train her on cocking and primary education etc.
After 2 months when we visited to her maternal home, we observed that she did not do any progress, so and we discuss with her parents,then told that, they not sure about , whether she will do the progress.
As she is not able to do the progress,it is very difficult to carry life with her, so in this case suppose if we apply for the divorce on the grounds that, they mislead us and not given correct information and she is not mentally fit. So our case will be stand or not.

Please guide is there any other option.

Unable to attend the allumony case i filed

I have filed for alimony in Family Court 2 Month back, but I could not go and attend the last 3 hearing due to some personal reason,what will happen if I could not attend the case I filed. Judge will continue the case or she will close it due to my absence or She will take any action for not attending the case which I filed.

Dear All,
What is the time limit for filing Divorce application from marriage date. Suppose party from boys has filed case for divorce first from in the court near to its residence, then can next party has an power to change it and apply form its residence. or they have to come to attend the same.

Possible to use this process in case of review petition

Section 114 of the code although does not prescribe any limitation on the power of the court but such limitations have been provided for in Order 47, Rule 1 of the CPC. The grounds on which review can be sought are enumerated in Order 47, Rule 1 CPC, which reads as under: Application for review of judgment (1) Any person considering himself aggrieved (a) by a decree or order from which an appeal is allowed, but from which no appeal has been preferred, (b) by a decree or order from which no appeal is allowed, or (c) by a decision on a reference from a Court of Small Causes, and who, from the discovery of new and important matter or evidence which, after the exercise of due diligence was not within his knowledge or could not be produced by him at the time when the decree was passed or order made, or on account of some mistake or error apparent on the face of the record, or for any other sufficient reason, desires to obtain a review of the decree passed or order made against him, may apply for a review of judgment to the court which passed the decree or made the order

Reg divorce and

Hi Sir,
I have applied for divorce. My lawyer asked fixed amount to finish the case. I accepted and paid 90% till now. Suddenly he is asking for more money.
I am unable to pay as my financial situation is not good. I need to appear in the court for giving " my statement" next month as my wife didnt appear in the court.
I am asking my lawyer to give the document to me and planning to arrange another layer. But he is saying all the reason in the world.
I am planning to appear in the the court on the next hearing. I am also planning to complain about my lawyer in the court for not giving the documents to me as he is asking more money.
If my lawyer doesnt appear in the court , is there any issue for me giving statements in the court(case status is "Ex-Parte Evidence")

Pleas give me some suggestion on this how to proceed further. I am struggling with out proper job and financially become weak.
For Any help on this , i would be thankful.

Divorce

The husband has received the summon while he was in India. Subsequently he has gone abroad. The Power of Attorney is appearing for the case. However, Family Court Judge has not accepted marked in the docket that Respondent [husband] called absent. The counsel for the husband has orally stated that they are going to file mutual consent divorce and seeking adjournment. The same is also recorded by the Judge in the docket. But even after five adjournments neither the petition for mutual consent filed nor the husband appeared. Whether, the wife may insist upon ex-parte order. Whether the Husband can contest the divorce petition even after the record of the Judge for mutual consent. The wife has filed petition only for divorce. No maintenance or alimony claimed in the petition. There is a girl child in the custody of the wife. The petition is being filed on desertion and cruelty grounds. Please guide. Thanks in advance.
