Because of bad relation with my husband , i have fall in love with a guy . and my husband saw few messages between us and he told me to leave talking to otherwise he will spoil my image and spoil my family . As my parents are very old and i don\\\'t have brother . I got scared and i left him and i even stopped talking to him . I came back to him but then i realized he wanted to take revenge , from last 6 month he has torturing me physically and mentally . He don't even allow me to go out anywhere . But now he started beating me. I want divorce from him . But recently i visited advocate and she told that he has your messages so you cant do anything , he will spoil your career and he wont even give you divorce . I don't know what to do now ? is there anyway i can get divorce from him. Plz help me

I very humbly request the honorable experts to kindly be patient if there is repeated query. I think more time is wasted in mentioning 'repeated query' as would have been simple if replied or ignored.
Sometimes it is encouraged to have second opinion and repeat the query if the questioner is not satisfied with reply of one expert, So request very humbly to bear and understand.

I applied for custody of my 7 year son staying with my wife. The petition was filed in my home city X. My wife applied for transfer of the case to her home city Y in Supreme Court and got a stay on proceedings
till the next date of hearing in August. DV case is also running in city Y. I want to apply for interim custody of my son during summer vacations. Is it possible to apply at this stage ?

Dear Sirs,
Have to file a Petition before the Family Court in Mumbai for (i) Restitution of Conjugal Rights (ii) Maintenance for Wife and unmarried daughter (iii) Attachment of property of husband from selling, transferring, alienating, creating third party interest etc. (iv) Transfer of half of the property in the wife name, against the Husband who deserted the wife for the last 10 years and living with another women.
Following are my doubts:
1. Wife is living in Mumbai. Husband is working in Gulf but when he comes to India, he stays with his paramour who. stays in Kerala. Husband does not contact the wife or give her or her daughter any financial assistance. Husband is having properties in Kanyakumari Dist., Tamil Nadu. There is reasonable apprehension that husband will sell property which is solely in his name only. My question is:
i) Can the Wife pray to the Family Court to issue an order for attachment of properties? Or
ii) Can the wife pray to the Family Court for an injunction restraining the husband from selling, alienating or creating 3rd party interest etc. ?
iii) Can the Wife ask for 50% of the property to be transferred in her name?
iv) What is the difference between attachment and injunction in respect of property in the given context.

The stage of Petitioner’s submitting the evidences is only after the reply is received from the Respondent. If no reply received at all the case is ex parte.?

Dear sirs,
I filed the divorce against my wife on august 2013. now, i think i withdraw my divorce case petition. how to withdraw, and any reason must tell the court. My wife is illegal connection with othr person, i mentioned the petition. Now she didnot attend the court till now.only one day appear iin court but not tell anything in words she give divorce or join to me.please help me.

False 498a and 406 on me and family. FIR done 3 weeks ago. AB obtained. Currently case is at Charge sheet stage.
I recently came to know that my wife had already filed DV at court 6 months ago (even before her dowry complaint in CAW cell). Four dates already over for DV. But i have not received any summon so far for DV. I have changed my address since 3 months. Next hearing is after 1 month.
My queries :
1. Why summon is not reaching me (she knows my new address and work place address) ?
2. Is she not sending summon purposefully ?
2. Can summon not coming to me even in 6 months can harm my case ?
3. Can i just appear in court on the date of next hearing ?
