Its been 15 months marriage life, 6 months we have been together in abroad where he spent most of his time in chatting with his parents and sisters over phone call, i was very close with my in-laws and they too, he will be good to me until he makes call to his family after ending the call he will beat me till i get scar and blood and he will get some medicines to cure my injuries then he will say this living place is not good for us so we will change asap, i believed his sayings and kept quiet without intimating to anyone, meanwhile i got pregnant after checking up pregnancy he pushed me down for not informing to his mom eventhough he knows my call to my mother in-law but she didnt picked up my call, at my 4 th month of pregnancy we came to India and stayed in his house, his total family was upset on my pregnancy didnt showed up their good face to me, my husband left me at my home and sent a divorce notice also filed a complaint against me as torturing wife, i went to police station with my parents there SI solved our problem SI asked us not to care for divorce notice, he gave a written statement that he will make a call to me and send money monthly as per that he sent money only for one month after that he didnt call me again he sent a divorce notice, he didnt even care about my delivery and my son is 2 months old, he is not attending any call and blocked me in all way of contacts, i dont want to give divorce, i want my son to grow with parents, pls help me for not getting divorce, i want to live with my husband so pls help me

sir already my divorce petition is granted decree by family court on january 2014 and also paid Rs-3 lakhs as permanent alimony to wife by the judgement of family senior judge and she is LADY JUDGE. Now again my wife had filed in orissa High court on march 2014- That it's a part of case and she is demanding additional money from me, tell me what to do and how much it will be by high court bcuz am single income source in my family and 4 dependants on me including myself. Also my parents are operated patient ( mother is heart operated and spinal cord and severe insulin dependant diabetic patient) father is also medicine and operated for varicose veins and my unmarried elder sister is also dependant on me. what will be done so that high court will give me relax. my advocate is asking me that how much money i will be comfortable to give her and i told my advocate that let the high court judge decide. i had already deposited all my parents health papers before to family court and after looking all the lady judge had given order to deposit rs- 3 lakhs and i had given also and my wife had also drawn the money but again she had filed. tell me please help me so that i will be helpful.

Hello Experts,
I have been fighting my case of DV,125 CRPC from last 1.5 years. Lower court had passed a interim order of 10K PM for her maintenance and I challenged it in the court and got a stay. Now the main case is going on along with 125 CRPC. My qeustions are
1. Though she earns almost same salary as me (shown in current for 26AS of Income Tax) do I still have to pay maintenance.
2. Can anyone claim maintenance in two different cases? Why I am asking is Divorce case which was filed by me which got transferred to her state of origin she can file for another maintenance case.
3. In her last evidence stage she was still claiming that she is unemployed. She was crossed by my advocate and she told the court that she is unemployed. Basically lying in broad daylight in court.
4. Will form 26AS issued by Income Tax hold good to expose her lies.
5. Can I file perjury against her now? What is the punishment of perjury?

Hello sir,
My wife is asking me maintenance and accomodation facility and has challenged me in court.My wife is a graduate and earning approx 8000(as stated by her) and stays with her mother and brother and her mother is also earning nearly 45000p.m (as stated by her 25000) and also her brother is working.My family parents and brother sister are not working and are financially dependent on me.i am the only bread earner.my father is paralytic.I stay in mumbai.I will not be able to pay 15000 maintenance plus 10000 as rent as per my wifes demand.Please tell me i will not be able to fulfill her demands.how do i do.

can a mutual consent divorce be granted if wife is 7 month pregnant, the pregnancy is because of family pressure...any judgments if its legally possible?

dear experts,
i lately realised that my marriage is void in the eyes of HMA1955, i had court marriage with my mother's sister's brother's daughter, now girl is staying at her parents house. i got below queries :
1) what is maximum time upto which we can apply for annulment from court.
2)what problem we may face in future if we dont take annulment and try to settle wid different partner.
2) how long its take to approve annulment from court once we have applied for the same
4) how much cost for entire procedure
5)girl might claim her sexual and mental loss due to marriage, which is now void by law. so how court will handle this things. will i have imprisoment.
6) it is ok if i started the procedure of annulment. or its good to be wait for notice from girls side.
7)i had to look after marriage expense and jwellary for girl. will i get it back

This is a case of wife deserting the husband for more than 2 years and husband filing divorce with family court.
Both resided in Hyderabad and wife has left to Kolkata. Case filed in Hyderabad and the wife is avoiding the summons by managing the postman. Wife doesn't have any demands and at the same time not interested for mutual divorce or to attend court. Case is unable to proceed further for non serving of summons. 3 queries related to this.
1. What are the options left if summons are not served.
2. For how long can the court keep the case running unable to serve summons.
3. Whether divorce is possible in such a condition.
Please give a solution

Sir, we were married for the past 17 years, don't have a child, due medical reasons in me. Now that my wife staying with her parents since February 2015 and not in conversation with me. But keep posting allegations against me within their relatives and friends commonly known to us. She is also either directly or indirectly creating problems with my profession. She trying to file divorce (not a mutual one). My question to you is
01. Under what law is she entitled to file divorce?
02. Can she file a divorce asking for settlement of property owned by me? Currently she is employed with a media house in chennai.
03. How long it will take to settle the divorce in court?
04. What are the precautions I need to take prior to her filing the divorce?
05. What are the fees structure if any for these proceedings in Court?
