Sir meri wife ne 2 December 2015 ko 498a ipc 323 ki fake complaint di ti. Jo women cell me 21 dec ko jhuti sabit hone ke kaaran band ho gyi.meri wife ne fir 29 dec 2015 ko dobara ipc 498a ipc 323 ipc 361 and ipc 506 ki mere khilaf complaint ki hai.or ek mediacal certificate jo 17 november 2015 ka hai attach kiya hai.kya meri pehle wali complaint jo jhuti sabit hui ti vo is complaint me meri kuch help kr skti hai.sir main janna chahta hu ki agar me cruelty ground par divorce case file karta hu to kya divorce ko liye meri wife ki sehmati jruri hai kya.agar meri wife mujhe divorce na de to kya mera divoce nhi hoga

Interim maintenance to working woman

Presently my son lives in Singapore. His wife lodged sec 12 DV Act complaint against him in Saket Court Delhi. The Court has ordered for grant of Interim Maintenance to the tune of Rs.100000 to her and 40000 to their son despite of the fact that she is working andd earning more than Rs. 65000/ pm. Brief facts are:

Before marriage which was solemnised on 15/2/2005 at Bikaner Raj, both husband and wife were working in Banglore. After marriage they continued to live there and lateron sifted to Singapore in June 2006.A male child was born to them on 9/5/2009, in India.
Due to matrimonial difference, wife came to her parental house in Delhi on 22/6/2011 and started working there . On 1/12/2012 she lodged sec 12 DV complaint.
On 22/5/2015 the MM ordered interim maintenance by converting his singapore income into Indian currency and ordered almost 1/3 of this as interim maintenance without giving any consideration to his genuine expenditure, parental liability and cost of living in both the countries. The complaint number is registered as No CC 1488/2012 in the court of MM Shivani Chauhan , Saket Court Delhi.

My son went into criminal appeal no 181/2015. The appeal was under arguements for four dates of hearing. on 2/11/2015 the ASJ , Lokesh Kumar Sharma ordered for paying 50% of child maintenance in the form of FD in the name of child , which has been done.

Strangely the woman has approached H C Delhi vide Crl.M.C. 5058/2015 and the court has stayed hearing of appeal next date is 3/3/2016.
Do not know what next . please advice

Inter religion marriage

if a girl is a hindu and wants to marry amuslim boy, does it essential for her to convert herself into muslim region? or they can marry under special marriage act? do such inter religion marriages have validity under indian laws? is nikah must for marriages?

Husband is staying away from his wife and two major children since two years.
Can he sell his residential property in which his wife and children stay, without their consent?

MCD & DV

Dear experts,

I am in confusion situation now. Me and my dear wife separated 2.5 years back. Wife filed DV on me & my family. JMFC court granted 2k interim maintainance. After too many rounds of discussion decided to go for MCD. Alimony is fixed. partly should be paid @ time of MCD petion and rest at time of end. Meanwhile all counter cases should be withdrawn. My question is it wise to pay partly in MCD first motion. And give time to withdrawn DV. will it not back fire. Or shall I pay in alimony in DV pl suggest. Have a good day

H.s.a 2005 amendment.

Regarding rights of women in ancestral property there are two S.C.judgements. One is Gandhi koteswaramma case of 2011 and the phulavathi case of Nov. 2015. Which one would be followed ?
When the amended law says women become coparcenors at birth like men how does the date of amendment and father being alive at that date make any difference? It's not so with men. Pl.clarify. Some fathers live till 100 some die young. How can that factor be relevant? Has any women's rights group challenged it?
