I want legal suggestions for my sister:
My sister got married to a guy in arya samaj mandir and got registered by Marriage registrar. After 2 months she realised that the person is fraud and not a good person. Now she ran away from his house after informing police to her parental house.
When I gone through the certificates and boys documents I found that it was registered in court on 27 dec. and Marriage was taken place on 26 dec in arya samaj mandir.But my sister was at home on 26th dec. And ran away on 27th dec. for that I have MPR copy ( of 27th dec).
When I gone through the documents of boy I found that he has not completed his 21 , he is underage in two documents that is his license and his voter ID. But on adhar card it shows he is 23 years old.Boy doesn't have any other documents as per my sister is saying.
Also he had 1 witness of his own and the second witness was arranged by arya samaj advocate.
Boy is illiterate and my sister is graduate, she is 28 years old and elder than boy
Address which was mentioned in his documents also not true, he was residing on that given address 3-4 years before. I have sent a registered letter on that given address it was return back (on the top of that letter it is written respondent is not in this address). Later my sister told me the boy doesn't reside over there from last 3-4 years.
Marriage was solemnized in Gaziabad arya samaj and we belongs to Rajasthan.
Please give us legal advice, is this marriage nullify.Please guide me...

I am a banker. I want to know about Muslim legal heirship for following . Mr. A has died. A had 2 wives, both deceased now. Mr. A has children from both wives. Who will be the legal heir for Mr A's deposit account in bank? Pls reply.

Hello experts,
Today I got a call from womens cell, stating that why am I not attending the meetings for mediation, to that I very politely responded that we are not getting notices for the same, last notice we got was some 3 months ago to which we reponsded in writing with all the medical proofs attached with the reply, after that my wife had filed for a DV case, and now the womens cell officer told me that we will file an FIR.
My background on why we cannot attend any mediation 2000 kms away from our place.
I and my father are physically disabled person suffering from a rare brain disorder, I have all the medical proofs to prove me and my fathers disabablity, I told the officer regarding this issue, he told its time for an FIR under Sec 498a and 407,
My wife had already filed a DV case to which we will be filing our reply in the next date.
Experts please advise what next can happen in this case?

Dear Experts,
My wife lodged FIR against me in JAN 2015 which was cancelled by DSP and after cancellation my wife continued giving application to police against me and all time police refers the same statement of cancellation.
During the cancellation Police did not lodge FIR u/s 182 against my wife now she has given 8 applications to police against me and all investigation reports say "all her applications are fake".
now she is continuing headache for me and I want to lodge FIR against her u/s 182, but Police says it could done only when the Dowry case was cancelled by police and it is only by the desecration of police not mine.
How can I get this case lodged??

i had asked opinion on below issue .
had earlier asked my query and had got expert guidance from your side ..
Now i had a meeting with local advocate to discuss the issue .
following were the issues and his comment
1. should we wait till the opposite party to file a case so they will have burden to prove the allegations made by them .
As per advocate ---- if they file it ,burden will be on us to disprove it from initial stage
2. should we file compliant under crpc against wife and her father for fabrication of documents and against mother in-law for assault as we have strong evidence for same
As per advocate we will file complaint to CP and to state law minister and than they will tell police to take cognizance .
My query
is the opinion /comment given by advocate genuine and should i go with this .

Facts in Brief 1. My-self Dr and married to Dr in 2006 ( arrange marriage) 2. Stayed with my parents in their house 3. My mother-in-laws undue interference in our married life 4. Tried to discuss with wife and my father-in-law but all in vein 5. 1st baby born on 2009. delivery done in our city .Mother-in law stayed with us for same. Stared fighting on simple issues like burning charcoal for heat for post pregnancy ( IV light already available at home ).Before taking wife to their home for rest Mother in-law threatened to file 498a and left off. 6. we had no contact with them for next 3 months. 7. in 4th month we got call from police saying 498a .306, plus some more sections filed against my wife and her parents and brother by parents of their daughter in law who committed suicide . 8. we kept part from them till judgment from court came .( 3 years period gone) 9.her Maternal uncle intervened with assurance that her mother will now stop undue interference in our life .So bought her back and started cohabiting back 10.learnt that she and her father made duplicate birth certificate of my daughter at municipal corporation at their place when i was having the original one ( when BC from one municipal corporation is issued ,can other issue the same ? ).kept quite thinking whatever it is , at least I have my daughter with me. ( admitted my mistake, should have asked about 2 BC to clarify them )now have filed RTI to know what documents they have submitted to get same 11. interference from her mother still carried on .by 2013 next baby girl born 12. quarrel happened between me and my family with her regarding same . 13. left parents� house and look other house on rent and started living there with wife and kid as did not want any fight to happen in future 14. aggression and fights from wife and mother in law increased and started fighting on any irrelevant things 15. by the time renewation of degree date was due for which we require to attain CME and collect certificates ( points) and submit same to medical council. 16. wife did not attended and got her friends certificate ,erased her name and wrote her .made me to sign on her part saying if i don�t do the same she will hang herself and me and my family members will be blamable for same .so had to sign 17.had to visit her village for some work .she handed over the certificates and told to get color Xerox from there. 18.visited her parents� house and told them what she doing is wrong but instead they supported her 19. same fabricated documents submitted to medical council 20.told her to accept the wrong she had done before they catch you for same. 21. instead she fought and made to go out of house. Than called up on cell and said she is committing suicide and will write me and my family members name on suicide note stating we harnessed her . 22. ran back home ,had to break the door as she was not opening the same and found her sitting and playing mobile games. 23. stopped talking to her from then and just lived in the house for sake of my daughter 24. her parents came and said me that this marriage is over and to leave the premises and they will live there . i can meet my daughters whenever i want . 25. already bugged up i left the house and got another rented one for myself and started living there 26. visited on every alternate day to meet daughters 27.one fine day mother -law called and started giving bad words saying my daughters are ill and where i am.i was in clinic with patients .so told her the same and also told to speak properly.instead she banged the phone 28. annoyed with this i went at their place ( which was earlier my house ) and asked clarification as to why .she stated yelling and tried to assault me by hitting me with her hands . ( wife was not present there at that time ) 29.left the house and than never visited back there. 30 .as i could not bear the wrong done by wife , i filed complained against her in medical council for submitting fabricated documnets 31.i am not allowed to me my daughters my query.. 1.should i file application for visitation rights or for custody of children . 2.should i file divorce petition and is yes on what ground .or should i wait for them to file the same as i will have strong ground for divorce when their baseless allegations ( if any ) proved false. 3. can i take part in person during cross and argument stage . 4. Can she file 498A now. Hi, This is lata. Resently my brother got married in last year Dec. After their marriage a very next day my brother's wife ask my father to give his ground floor flat to them. We are middle class family as my father's income is very less .The house of ground floor is on rent for extra income so that they can survive their life. When we deny for the same. Her behavior got sudden changed she is getting batmiz day by day. She even not talking to my poor old mom proply. Her mother called to my father and giving threats that if her daughter demands will not filling by u will sue you all in court. Wife of my brother is charging a false allegations on my parents that they are harassing her with the stupid reasons. For making her points rights. My father is heart patient. My mother is also bp petient. They both old and love my brother very much. They Are emotionally attached with him. Now according to my brother's wife they got separated. So that my old parents can give whatever she wants. My brother is very afraid she will give fake statments towards him and my parents. So he is doing wherever she is saying. Is there any way to come out of this. I can't see any way out my parents are very old. And we are avoiding the court case. Can we take leggal support against false allegations from her. Pls suggest.

So you mean to say I can file either in Andhra or Bangalore. But I have over heard that since I have got married in Andhra I have to file divorce their. Can you pls help me out.

My wife does not want to come abraod
Respected Sir, I got married on August, 2014. We had a baby boy. My wife left me five months back, but I messaged her that I will give divorce If she doesnt come to my home. It worked. she was with me for 20 days. Then, I moved to abroad. Before I moved abroad I have made arrangements for her passport, went to passport office, due to unavailability of marriage affidavit could not done. I have also arranged same document to her but she is not taking appointment passport. Now, my wife went to her parents home and does not want to come to abroad, where I am currently working. She is also started working in Govt organization on contract basis near by her parents home. How can I bring back my wife here,? if not possible. On what basis I can apply for a divorce? If she does not agree?, Whether she can claim any of my parents property.? What are the document I may require for this. Please help me in this regard.
