Presently I am jobless now. My wife files a execution case against me for collect her due maintenance. On this ground I was getting punishment one month jail. What is my next step for avoiding more punishment for that said case because I have no money to paid maintenence?

Can police take me to police station forcefully when I asked for a time till next morning as it was late night when they called me to appear in police station. Can police detain me overnight at police station without any reason.

My name is Ramesh.I and my wife are living separately for 2and half years after I left her to her parents home when her bad and insulting behaviour became intolerable.during this period many attempts were made for reconciliation and also made offer for MCD.when nothing helped I approached local lawyer who suggested filing divorce petition on ground of desertion and mental cruelty.my question is should I follow his advice.it is now impossible for me to live with her.please advice.

Hello , after battling for 4 years I have been awarded RCR and my wife's petition of divorce was rejected basis no grounds . However she has gone for appeal in HC with same reasons .
My daughter is 7yrs and wife is not giving me clear access . Daughter used to come home for almost 3 yrs but now since past one year she is under constant threat or pressure supervision. Neither is my wife telling me about her schooling though filed in Family court . What should I do to further also to know about her schooling.

In 2011 wife files 498a and Dv act on husbands. Husband family got AB on 498a but police gave charge sheet and in 2013 district court ordered husband to pay monthly 15,000 rupees to wife as maintenance Under DV act.
But in 2016 court acquitted husband and others from 498a case as the cruelty is not proved. Now my question is.....
1.Can Husband file for divorce as 498a acquittal.(they are hindu)
2.If Husband get divorce , can he apply to court for dismiss the maintenance order Under DV act.
3.If maintenance order is not dismissed than if wife seeks maintenance from other law like 125 or Hindu marriage act than Can it be defended by husband on the fact that maintenance order is already passed.

my 3.5 years daughter is with me ..i file my divorce in 2015 dec at that time she was with her mom at jan 2016 my wife was admitted to a mental hospital santulan at bali nagar by my father in law
then i take my daughter back with me
after 3 months he filed a comp in women cell that i kidnap my daughter so they settled that my wife wants only visitation due to her mentally problem ...my wife sign on a plain paper and give it to me that she wants only visitation rights and write on it
mera ibhhas mentel hosp me ilaj chal rha hai mein sirf bache se milna hi chahti hu
proofs i have
1.she use very abusive language i have whats app chat record
2. dd no of model town police station complaint by her neighbour in which it was written by duty officer that
ladki pagal hai sbko galia deti hai
3.ibhas mental hospital file no treatment record
4. phone recordings of doctors that she has bio polar dispoder
but when she files reply she file interm custody of child
all say that custody given to mother but my daughter dont want to go to her mother can i win by this proofs
can i demand apply a mental check up of my wife to court before giving my custody to her .
plz muje sahi ray de ki case agar 1.5 years aur chal jae to kya 5 saal wala issue khtm ho jaega
ek pagal ko jo mental hosp reh ke aa gya ho custody mil skti hai

interm pe case kitna lamba khich skte hai arguments ko

Me and my wife were registered our married on October,2015. As we are not socially married we stay separate till date. My wife's parents created a lot issue to agree me for mutual divorce. When I agreed for mutual divorce then they are saying that this registration is not valid as we did stay together. So I just want to know that is it really so??

498,420.467,34 pending against my husband,conditional divorce is taken( MCD)that only after fullfilling consent term divorce is granted,but family cout judge gave MCD decree with consent terms are part of decree.Past 4 years my husband was not fullfiling consent terms( though consent terms were to fullfill the in 20 days after filing consent terms) ,only in last year he fulfilled 2 consent terms partially.1) he deposited money in court but in year 2016 march
2)he relinquished his rights to child in shared matrimonial house( barring 5 instatlments all payments done by me)
All these time lawyer is telling me not to taken any money for education of child from husband ,though Consent term is there.
what should i do ?as as soon as he has changed lawyer recently ,who happens to well known to judge ,when talking to judge ,judge took his lawyers name & said oh this is ----lawyer case ,i will be strict with you if you don't file compromise in 498, its my oral order to file compromise in 498,420 case within 30 days.
But there is arrest warrant application is pending for education fees as per consent term.
One of the term was only after these consent terms were fullfilled i will withdraw criminal /otherwise cases.
pl guide why this pressure on me for withdrawing criminal case first ?

High court have authority to passed divorce order
Shall v move d hmop case from local court to high court?
Hmop case is pending in Chennai subcourt now .Our marital home is chennai.so my hubby filed hmop in chennai.but am staying in my parental home .My jurisdiction is within madurai high court.
1)Shall v transfer hmop Case from Chennai subcourt to madurai high court? Or can v only tfr from Chennai subcourt to hometown subcourt?
2)High court have authority to passed divorce order?
