Sir i am a serving soldier from 2002 and married on 2012. Now i have two children of 5 yrs and 3 months old age respectively. Now the problem is i want divorce bcause of so many problems and my wife is also agreed for divorce. My querry is what type of case or petition can be file and how to approach a suitable cost effective lawyer for a divorce which i get at the earliest. How much fees to be paid for lawyer. How many time taken for completion. My salary is near about 40000 so how much i will pay for maintenance or anomaly. My wife is not doing any job. Please give me a early reply

Hi as per leagal advice as stated earlier I have filed for RCR and child custody at my residential place. After that I tried to contact my wife through what's app then she started making allegation like she did house hold work cooked food and used derogaterory words for me and my mom. To make her understand I told her that your parents too used bad words to me I don't say anything then she threatened me of suicide and abused me saying that (tere pass he Kya beee jaaaa tu apne armaannn pureeee Kar )After that I stopped her texting and not contacting any more. should I take it seriously to claim custody of my infant daughter as I am scared that she might be under mental disorder and I am in better position to look after my infant baby as I have my mother permanent residance and joint family. She has taken transfer from our matrimonial home to her parental place and infant baby is being looked after maid as wife and her father working in bank and her mother living with her elder sister in Delhi

Dear experts, Good day, As we are gong on in Court under 13 -B against our arrange marriage, But my wife has been married to a another boy with whom she was having an affair before our marriage. She has withdrawn other cases ( 125-c, and 498- A) as per mediation center settlement, and I have paid her for 8,00,000/- Rs through some family sources. which has been documented in medication settlement too. But now without divorce, She marry a Guy in Feb 2017 with whom she was having affair earlier, We were staying separate since last 04 years . But regarding her marriage I do not have any proof in hand, but have whole information regarding the same verbally. I am aware about the person and his family and their residence to whom she did marriage as per Hindu Rituals and staying with him. In this situation what should I do, I want to take every possible action against the case, as It is very insulating and harassing for me face this. kindly advice for the same. What to do ??

I have married one year ago. Now I am applying for marriage registration to Block Development Officer (authorised for rural area) with all documents but with certain change. i.e. with an affidavit stating to change the surname of my wife (from before marriage to after marriage). But the BDO refused to accept the affidavit made under executive magistrate and only asks about voter ID and Aadhaar Card. Plz provide required law about my documention for changing the surname and getting registration certificate.

Exparte decree was given 90days back from ld court
Alimony has been continuing as usual since
2013
Now my wife demands ...My documents and my presence which is necessary at the time of admission of our daughter in school
I saw our daughter 3yrs back ...no connection with wife ,daughter
If I ignore her demand...will there be any legal step from my wife
If yes, how would I resist that nuisance

in a divorce case when last hearing is pending in court we ask form our lawyer to show the papers which is going to submit in relating to our case. but he refuse to show the papers.
we does not have any papers but we want to check what is the claims in the paper.
please guide me what is remedy available to us.

I have a girl freind she is a Muslim Nd we love each other but my family is not ready to accept her and they have selected another girl for me.
But we have done the registered marriage without telling to anyone and now situations has gone worst in my family they want to marry me to the girl to whome they have choosen
So there is any offence or what should I do ???

Sir I hv filed divorce against my wife who's a advocate n now my adv n her adv told me to withdraw the case or pay the intrm money I think that I should withdraw the case but confused sir expert's pls tell me the further consequence I will face

Appeal on interim dv maintenance order
I received an order for interim maintenance in Domestic Violence case from magistrate court in which husband has been asked to pay 50000/- maintenance per month from date of application ie (May 2017) and also 1 lacs towards initial school and admission fees paid for our 4 year old child.
Order has been passed by duly considering the salary slips and income tax returns of both parties.
This amount was to be paid in one month however on last date in trial court husband s lawyer sought an adjournment saying they have applied for a stay on this order and appealed in sessions court. We appeared in the date in sessions court on the appeal. We didnt get summons but still appeared. Judge has asked us to reply to their stay application and appeal by next date which is after the date in the trial court.
Questions:
Since there is no stay order yet, can trial court proceed with the execution? On last date trial court judge had told them that if they dont get stay by next date he has to pay entire arrears. My lawyer is going by this and hence didnt mention in session court that he must first clear arrears.
Can we file for execution in trial court during pendency of stay application as it would take another 2 months for the order.
The entire appeal and stay is only on grounds that DV allegations are false and no DV has occured.
They have not appealed on the interim maintenance amount. What are their chances of getting a complete stay?
