Death of nominee

A person makes a will leaving the monies lying in various bank deposits/accounts to a welfare organisation as he has no children. some of the deposits/accounts have his wife as nominee. On his death bank refuses the claim of executors & trustees of the will in respect of deposits/ accounts where nomination is there,though the nominee gives a letter that payment may be made to E&T as per will. Payment is made to the wife who is the nominee. She deposits these monies in her name.she does not utilise any of the amount. She has not made any nomination in her account. She has not made any will. She too dies shortly thereafter.
Who can claim the money? The Executors&Trustees
named in the will or legal heirs of the nominee? or the welfare organisation who is named in the will to receive the monies?

Qwashing of fir

respected sir my bhabi filed a false dowry case on my father and brother,and police registered am fir,now the matter is on district court and my father is on interm bail and my brother is in australia

now today the megistrate called both families and tell both families for compromise and both families agree to compromise and my bhabi tell the megistrate that she is willing to live with husband.
the megistrate agree and told both families to join and give my father permanent bail.

my qwestion is that what is the next procedure to qwash f.i.r

Hybes -corpus case judgement

Dear Sir,

Please note below judgment for hybes - corpus case.

3) Respondent no 7 is present before us. we have interviewed her in chambers. she is dispututing the claim of the petitioner that she is lawfully married the petitioner,as stated in the petition.

4) it is not necessarry for us to examine the contentious issues betwwen the parties, since it is habeas corpus petition, and respodent no. 7 has appeared before us, who asserts that she is not married to the pettioner, coupledwith the fact that she has no intention to have any kind of relation with the pettioner - much less to go along with him, we cannot force her to do so, the pettioner would be free to take recourse to such other remedy as may be permissible in law on the basis of his asseration that he is lawfully married to respondent no. 7. all question in that behalf are left open, to be decided on merits.


kindly advise in this case what action should be taken.divorce is neccessry in this judgement. i have to give her any alumany in divorce application. kindly advise so i can take proper action.

Reconciliation

Hi Experts, My case is in Family court.5 summon sent.6th summons- his lawyer appears. But he is not coming.what will first happen when the husband appers for hearing.will we get chance 2 talk? is der any hope of reconciliation. I hav cm 2 knw frm his frnds- dat he still loves me..

Divorce petition

Sir,
I am residing at Moradabad (U.P) born and brought up from Kerala, I married in 2003 from Kerala, but I left her in Kerala next year 2004 and I filed divorce petition at Moradabad, she counter filed it in Supreme court and court ordered transfer of case from Moradabad to Kerala, now after 6 years district court of Kerala dismissed the case. Rest case of maintenance, 498a are running in different courts in Kerala still.

I want to file the divorce case again at Moradabad, but they will try to get the case transfered again to Kerala. So, my question is, is there any way OR if I file the case in Allahabad High Court, then is it possible to get the case transfered from Kerala High court OR they will have to approval the Supreme Court again.

Please advise ?

I need ur kind help,a case u/s 125 crpc,petitioner (wife) evidence closed.RWs on next date start,in petitioner evidence forget to tender some documents related to husband `s salary like salary slip etc.have any provision that pertioner tender exhibits even after closing of evidence.Please provide me detail it is very urgent.

Wife not staying with me since last 10 months

Sir

I got married in June 2005 and we had a son from this arranged marriage in August 2006. We were staying jointly with my Parents till January 2010. Due to frequent conflict between my wife and my mother i decided to stay seperately and took a rented house in February 2010. In the rented house we both also had frequent verbal quarrels of normal nature .Our sexual relation was very rare all the time. We stayed there for 9 months and she left that house for his brothers wedding in August 2010 and did not come back since than. We tried all our ways to call her back but they did not respond. When i called my wife last she told she will not come back as we were not getting along good together. In July 2011 we sent a legal notice asking her to come back in 15 days , but in reply they gave all wrong allegations like dowry , harrasement etc. After talking through the mediator who had arranged our marriage said that are not willing to give divorce nor they will send back my wife and son. They want to mentally harras us. My wife is not interested in getting married again nor she want to come back.

In above scenario what should i do . I am mentally upset by all this and want to start new life. Can i file petition for mental cruelty now or should i wait for 2 years and file for desertion. Which is the best way for me . Please help Sir.

Plz help me in getting my childrens

my husband wants divorce and i dont i m here on my brothers home and my parents hav expired we are from poor family and my both childrens daughter 10 yrs old and son 4 yrs old are with my husband they are demanding home and money for business otherwise they are telling me they are not ready to accept me. i and my brother are not able to meet there demands . so now what should i do. in 1999 my mother married me and she spent 15 lacs on my marriage. now how ll i get my childrens with me and what is the procedure to take maintainance or the money which my mother hav spent on my marriage.from past 12 yrs they hav torched me for money and till date they are demanding the same.
plz help me sir i m helpless.
