My rights

Hi,

I would like to know my rights.

My father passed away in 2002. I am the eldest son in the family of 2 children. My mother and my sister (6 years younger) has not been sharing matters relating to financial and legal issues with me and my family. I married in the year 1999. It was a love cum arranged marriage. My mother was not completely in favour of this marriage. It was an problem everyday. Post my father's death I and my family was treated like an outcast. I would not be kept in loop for any matters relating to the house. When I realised this I started asking things openly. But it was very cunningly potrayed as my ulterior motive. I just want to know my rights as a son. We stay at the house my father built. My sister is married and settled. She was given a dowry of 10 lakh from my father's money. She was also given to take the job in my father's company as he died in service although I was entitled for the job.

I am a syrian christian from Kerala. I have not been making a hue and cry about my state as it would disturb the famlily. But now I feel that I should know my rights along with my mother's and sisters. What does the law say? Does the house come to me. What is my share in my father's property and finance? Please advise.

Thanks,
Saju

Hearing dates

Dear Experts,

I filed a divorce case against my wife under desertion and cruelty grounds at Tis Hazari court. My case is in Evidence stage now with my evidence date given after 3 months i.e 1st Dec, 2011

Hearing dates are 2-3 months timelag. My question is that if the case is filed in other areas like Rohini court, Saket court or Dwarka court, Does Judge give the same timelines for next hearing or it can be early.
What can be done to schedule early hearing dates?

Kindly let me know.

Query regarding hindu marriage act amendment 2010

Hi,

Can I get divorce after 1 year of marriage under the new amendment to the Hindu Marriage Act 2010; Unretrievable Breakdown of Marriage. I am not sure whether my wife would be ready for mutual consent divorce after 1 year. So If she is not ready for mutual consent divorce, can the new amendment help me in any way whatsoever. If Yes, then how can i proceed with the same.

I have just completed 10 months of my marriage and not willing to continue with my marriage as my wife has left her matrimonial house since last 6 months without any reasonable cause because she is very lazy of doing household work and because of that she fights with me all the time. I have got the necessary evidences for the same as I had sent two legal notices within the span of 6 months to her asking her to come back but there has been no reply from her, no phone calls, no meetings, nothing. I really am not willing to continue my matrimonial life with her.

Please suggest me. If not possible through the amendment law then are there any other legal actions that I can take to come out of this trap without absolutely no waste of money in terms of compensation to her. Though, I am ready to spend money for hiring advocates but absolutely don't want to pay my wife anything.

Thank-you in advance.
