Marriage

Hi, I need a clarification. My friend aged 36 yrs was married in July 2007. Marriage is not registered in court, since the girl never interested to do so. The girl was suffering with arthritis, since birth and her parents didn't let the disease know to my friend or his parents. They have been separated for a year. Then with the intervention of some elder's they joined in Feb 2009 and the girl left the boy's home in Aug 2009. Since then they are living separately. My friend tried to call her an went several times to her house. but her parents always say she is in her relatives house and there is no contact between them till date. The girls parents never allowed her to speak or meet with him. My friend have all the medical certificates.

Now my friend is in love with another girl, Can he go ahead and marry her in a temple and spend his rest of the life happily??? Will there be any legal obstructions???

Please help as he is ruining his life without any reason.

Personal appearence in 125 crpc

my brother is in govt job and have only 15 casual leaves. his wife filed a case under 125 crpc for maintenance.he filed a application for exemption of personal appearence on each and every date and would appear at time of witness or when ever required. but the judge dimissed his application that there is no law under which relief can be granted to u. is there any case law/ citation where exemption from physical appearence is granted. if there is any case law/ citation please give me.

Whether the amended act in hindu marriage act section 13 provisions came into force or not? can any body give proposed date of effect?

Defending not liable to any of father debts

Dear Lawyers, I working in an IT industry and my father is doing the business at my hometown. He took so many loans from banks, kept his estates (including his inherited properties from his parents) in mortgages and loans nothing is left and i came to know that through his contacts he is trying for more loans and he got it. He is not telling to any one where what happened to that money including my mother and his mother too. Is there anything i can do in this part?.

So only thing i would like safe all my estates from him which i have earned through my job by paying EMI's and would like defend that "i not liable to any of his debts" if he is alive or deceased. Can you please provide some guidance on this. I am really afraid of future and i am married having kids.

Remarriage

Dear Sir

One of my friend has received the decree of sec. 9 and one year has passed but has not filed the divorce.Due to some unavoidable circumstances he got married.He is aware about the consequences and he knows that he can be arrested under the case of bigamy. I would like to know what is the remedy and whether he can get the bail if he and his family gets arrested?

While he was contesting for sec. 9 the opposite party never appeared and till date he doesnt have any clue about hteir whereabouts? He knows that any day he can be arrested if the opposite party files the case. Kindly suggest the remedy. My friend and his wife are living seperately for last 4 yrs.

In my case can i go for easy divorce now or should wait to completion of sec 9.

my marriage was solominsed on 6 feb 2003.with 2 childs.my wife always insisted for separation from parents and ultimately i got. separated.in 28 march 2010 my wife goes her parental home for delivary delivered my younger son their.everything was ok till may but when i said her to come back,she refused to comeback and said me to live there as gharjamai.i visited her many times but all is vain.in nov.2010 i filed a applicatin in session court under sec 9.on reconcillation she refused to come back and charged conditions .then she filed sec 24 for maintainace.which was decieded on 7 april 2o11.and on the same day she filed for d.v. sec 12 in her hometown.we visited trice in protection officer.there also she refused to settle the matter .report of protection officer is in my favour.now what should i do??? either should i continue sec 9.or go for divorce???in d.v case my parents and married sister are also involved...are they may be ommited.....?if sec 9 passes one year then is it criteria for divorce??please help me all of my work is ruined and i m in depression
