Me and my wife are living separately. My wife has applied for RCR. I am not willing to join her. I am not willing to appear to court also.
My lawyer said that she may apply for dowry case and suspend my dad who is a govt. employee.
Is t ? We havenot askd any dowry from her. Hows to proceed for it?

i have read enough about the dowry act misuse and the poor husbands lodged in jails for no reasons. Until today(as i am typing this)when i am back after spending 19 days in TJ(Tihar Jail). In Short Story is that i did a love marriage(Nikah)at Nizamuddin Dargah in delhi July 2009.It was a simple love marriage with no dowry taken-not even a single paisa.After that some stories happened and my wife left me and filed a case against me in Delhi under 498A 406 & 3/4. I acted as a stupid and myself went to the I.O as he called me to give a statement. From There he sent me to jail from where i got interim bail and court forwarded the matter to mediation center.I also have a gut feeling that my lawyer has join hands with my wife. I belongs to Bareilly UP. Now my humble requests to the Experts is to answer my few points. I will be really obliged
1-My lawer says that the bail provided to me is till 16th of January 2011.Is it ture that court gives AB till a specific date?
2-After my release my inlaws called me at their home for out of court settlement and there they beated me and snatched my 50k which i carried as a token money. My lawyer sayin not to report this to police about this incident else my wife can ask the court to reject my Ab on the grounds that i am trying to make false allegation on her family.
3-What are the chances of getting regular bail?

My husband has applied for Null&void under the grounds - We have forced him to marry me. which is not true. I have all the record proofs, marriag regtr certificate, reception conductd by them etc etc,
In the first hearning the petitioner (himself) didnt appear. And for 2nd hearning also he didnt appear. I think next time also he wont appear.
Now can i raise defamation case for it? To make me roam around the court and for mentally tortured me to state the rgisrd n

Repeated query but i have not gt the answer. So pls explain.
My husband deserted me and I am staying alone now. I, the petitioner have applid for RCR in Additional Family COurt, Chennai. He has recieved the summon but didnt appear in court for 2 continuous hearings even from the first hearing. Tomorrow there is 3rd hearning. But i heard thro his frnds that he is in other location n wont come to court tomorrwo also.
If he didnt appear tomorrwo also, what will happen?
Note: I have not applied 125Cr.P.C since i am workin women.
Answers what i got is : I may get exparty for RCR
My question is: If decree is passed for RCR. wats the use for me. Anyways he s libing separtly. Please explain me wat wld happen?

A couple were divorced 15 yrs ago and the mother gave the custody of the girl-child to the father. the father re-married and has a daughter from the second marriage and the mother also married but again got divorced and is a divorcee now she did not had any child from the second marriage. Now the mother wants the custody of her child which is now 18 yrs old.Even the child wants to come to her real mother as her step mother does not treat her well but her father loves and cares her, so how it would be possible for the mother to take her child's custody as the welfare of the child is done quite properly but just her step mother does not treat well . So, on the grounds that the child too wants to go to the mother and as she is 18 yrs now so can she go back to her mother? how it can be legally solved? please help...

A and B mutual mutually divorce, and they ragisterd divorce document before notary, they have child named C, at divorce document they make condition that, B the child's mother get custody of the child C untill they cant second marraige, now B wife remarraige with another person, and take C alone motherless life, now A father of C wants to get custody of the child,the child is only aged two years, what A can take leagley custody of child? or any other remady?

I and My wife were loving since 2006 and married on 04/03/2011 under special marriage act before a registrar.We were true to each other.We had faced lot of problems while loving.Her parents were really torturing her and her father was not behaving as a father.So My wife was always trying to come out from there. I urged her to wait until 18 so when we married she was 18 and four moths and I was 22.She was studying so we were waiting for that to complete.But once when her father tried to beat her she said about the marriage and our relation but did not say about consummation and our secret things.She has said only the things what a girl can say to her family.Their parents forced her to suit the petition to declare null and void.There they have mentioned that I was forcing and fraud and not consummated.We had consummated till September in my room and at her home when ever there were nobody at her home.I understand one thing that the petition was written by her parents and suited .The main thing is since October we could not meet or talk because her parents do not allow for that and always following her and disconnected the phone also.The main thing to object is I am from tamil family and christian but my wife is from kerala and hindu.
I have decided to go by person to the court because I also don’t like to say and show our secret things to the advocates .Can I say these to the court before questioning me on the first day.Will I get a chance to talk with my wife.pls give me some ideas to get my wife back.The hearing is next week.I thing it will be better to contest and prove after talking to my wife.
My Evidences are Love letters,Photos taken in my room,Some Sms,Her two dresses(Secret).

Dear experts,
My wife has shown jewellery worth lakhs of rupees given to our daughter at the time of marriage.She has given affidavits from her relatives stating they have given her loans for this purpose. I don't find the money flow in the records she has submitted.I believe that above 20K, IT Act does not allow loan payment be made by any other mode other than cheque.
While divorce case is on can I complain to IT authorities to check on this exorbitant amount which she is claiming from me in the suit.I never gave any consent for it. Iam though yet not complete with checking of money flow till such time she produces it in court.

Sec 24 - working lady
I have applid for divorce. My wife has applid fr RCR and Section 24 and litigation expenses. But she is hearing more than me. I have a xerox copy of her payslip. I produced that i court. But she has given statements in next hearning that "that is not her payslip. I was working earlier but since my husband mentally tortured me, I was not able to work and I resigned my job" . But I am sure that she s still working there.
How to proceed fr it?
Note: we dont have kids.
