Talaq (muslim divorce) procedure

Hi,
I'am Sunni Muslim, Belong to Hanafi School of Taught. My Marriage was solemnized as per Muslim Rites in Masjid (Mosque) Last year in April.
After 1 month of Marriage my Wife left home with her Father registering FIR in PS. Reconciliation was attempted for 6 months in our Community, Since marriage was done in Community. But No Result Came in Reconciliation. I and My elders are Mutually decided to Divorce her. We don't have any child and she was not pregnant. Can you Guide me How Can I Divorce her. I live in Mumbai and I have Nikahnama & Marriage Certificate which was issued by Qazi. What is the Acceptable Procedure to Talaq her.

Separate residence of my family


Respected Sir,

I am a software Engineer. I married my wife on 3.9.2009 and is working as a teacher. From the date of marriage I am living with my wife along with my 1) mother-in-law (working as a teacher), 2) my father-in-law (Tamil nadu Government Employee) and 3) my brother-in-law (unmarried and working in a private company), for the past 2 years and 4 months. Now, my wife gave birth to a male child on 26.12.2011 in a hale and healthy manner with 3 kg. weight.

1) I feel that I have lost my privacy, independency and right to express my views in the midst of the other 3 persons and living like a slave being in the joint family. They compel me to have my family separately in the same house by closing one door. I don’t like it.

2) I have to handover 80% of my monthly salary compulsorily to my wife and I should not ask any question about that. I have to beg before her or anybody for my pocket expenses etc., allover the month. My wife in turn doesn’t disclose her earnings.

3) Now after the birth of my son, I was not allowed to touch my son saying that any contagious disease will spread over.

I may kindly be clarified on the following points with reference to relevant section of the Act and Rules and my be advised what to do

1. Shall I put up my family i.e. my wife and son separately in a rented house in and around the location comfortable to me and my wife.

2. Will she object to this proposal and refuse to co-habit with me without her father and mother

3. Shall I be compelled to live along with their family jointly

4. Will she refuse to go with me for having a separate family

5. Shall I take my mother to have a help to my son in our absence.

Lok adalat award not complying whether contempt

lok adalat award made. one of the parties after award is made not interested in complying in terms of award. Whether not following/complying will amounts to contempt of court.

Maiden name in will

My maiden name-Petsy Fernandes, I got married in 2009 & changed name to Priya Desai. Its inter caste marriage & dad was really upset, but now he is fine. & bow making his will where he will include my maiden name coz he is not aware of name change. Should I tell him this change or should I wait for his will & then try to change name in it? PLz guide me. aCTUALLY I DONT WANNA TELL HIM, COZ HE MIGHT AGAin get upset.

actually its my first hearing in that case what should i do ?can i get bandra court transferred to thane court before the date 11th jan or i have to attend first date.plz advice

my husband has filed petition at bandra family court .he could file near by but delebrately he has done so becz he knows i will be very uncomfortable as i am having med problems .
i want to take ur advice ..
whether i can get the bandra court changed to thane court on basis of medical grounds .i m having all med prescriptions n advices.

Divorce petition

if the girl has not voluntarily signed on the mutual consent evidence petition then can the boys lawyer amend the petition to original divorce petition

if yes what is the probable time limit for the divorce decree to be granted as the original divorce petition was filed in Dec 2008

are there any other legal solutions for obtaining a divorce decree otherwise or foe ex parte settlement if the girl/ girls lawyer does not appear in court of law

if the gilrs maintenance petition once having been rejected can still be contested on the sane grounds if the girl files a maintenance petition again

Guidance

thank you to spare some of your valuable time to give guidance for my family issue as below :

my son had married on feb.'11 [his marriage is {10} TEN month old.]

his wife went to her parental home on

i] 31st oct.'11 on pretext to come on fri./sat. but didn't come. we personally went there on 13th nov.'11 to bring in.

ii] again on 5th dec.'11 she went to see her parent and and told to return on thursday but still won't come on pretext of her illness. her parent not in a position to say what illness ?

they [her parent] threaten us if we say anything against them, they immediate file/impose u/s 498A Cr.P.C. on us.

what is the remedy to counter the suit file under 498A Cr.P.C.

her relative also said that you [we] don't understand the meaning of not phoning from their side and not give your phone to girl.

moreover her parent on one pretext to other see that we don't meet their daughter on phone & personally and at the same time don't give even slight inlklin about their intention for DIVORCE. we don.t understand what is in their mind ?
