can a surety in a 324 ipc case travel abroad for a two months period . do the person for whom he had stood surety will have to bring other person in place of the one who is travelling plz advice

Respected Seniors,
Within the 2 years from marriage wife was committed an attempt to suicide for the harassment of her husband and her in-laws. At that time she was admitted in hospital and local magistrate was taken her marana vangmulam. At that time of giving marana vangmulam she was not revealed real facts with regarding to her attempt to suicide since prior to that her husband and her in-laws threatened that if the real facts are exposed then we will kill your son. With the fear of her son she could not reveal real facts with regarding to her attempt to suicide before the magistrate.
As per the version of the doctors still she is in danger of her death. But she is ready to reveal real facts with regarding to attempt to suicide.
Now my doubt is, 2nd time statement is valid under law by the said wife for her statement to attempt to commit suicide.

PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. to set aside the order dated 25.11.2008 passed in Crl.M.P.No.1928 of 2008 in C.C.No.5640 of 2007 on the file of the Chief Metropolitan Magistrate, Egmore, Chennai-08 and consequently direct the learned Chief Metropolitan Magistrate to recall P.W.1 for re-examination of the above case.
Query : What do u mean by P.W.1 ?
Any site or a good book to learn more about cross - examine in civil case & also in criminal cases.

1) As a rule, a party cannot cross-examine it's own witness. As per which section or case law(s). Also cross - examine are also applicable in any tax tribunals pls guide on it. Is cross-examine applicable to any civil cases , is it applicable to any Writ, SLP. cross-examine is applicable to which case in india if any pls or it is applicable to any case & in any court whether suboridnate to high court or not.
Pls detail info about cross-examine.
2) As a layman what do u mean by hostile witness pls with the example.

Dear Sir,
I have the company car. My company terminated me on false grounds. Later I asked them to take the car back (I dont have proof). They said they will not take the car but want money, since its under the car lease scheme (as per the agreement I will have to pay the money in case there is a termination of service). They send a legal notice to pay back the money. They filed two cases on criminal for possessing company property and one civil to get the money back. I filed a petition at the criminal court that I want to give the car back as I dont have a job to give back the money. I will never get a job due to the nature of termination letter. They want the criminal case and civil case go on for ever and trouble me.
Sir please advise how should I proceed. every month i have to attend this court. I want to give the car back.

I am a law officer in a company, my company sold ink to a accused against which cheque was given but dishonured.case is filed u/sec.138 of NI Act in year 2009 but problem is the summons report is person not found and the accused closed the shop and left the city now what to do ? which step should be taken in case? paper Proclamation? if yes in which city where case has been filed or in city where accused is living, or any other step should be taken. Please suggest .

Land forgery complaint is made against my colligues relative. he is involved in real estate and construction activities. he is trying to get bail but not getting for the past 15 days. I dont know whether he is a real acquist or not. i want to know whether there is any possibility to get bail?

Sir, I would like to request you to please go through the following few facts.
One of my relative was attacked by a group of antisocials on 17.11.2010 at about 8 pm while working in his shop in a market and the miscreants used various deadly weapons with revolver and fired three rounds to kill him for which he was seriously injured. Thereafter the person was hospitalized and F.I.R. was lodged in the local police station on 18.11.2010 by his elder brother, based on which the police registered a case by booking five accused persons under sections 452/324/307/109/34 of the IPC and under section 25 of the Arms Act. But from that date the police authorities have done nothing except arresting one person only who is at present in the judicial custodyand who figures last in the list of accused in the FIR. The man who figures first in the accused list of FIR and is the main culprit along with his nephew, behind the incident is roaming freely and the police is not arresting them inspite of their anticipatory bail application being rejected by the Hon`ble High Court Of State. Remaining two accused are absconding as per police record. I would like to say that the persons roaming freely are political leaders of the state ruling party and is an antisocial and so the police is showing unwanted favours to him. He is repeatedly threatening the family of the victim and forcing him to withdraw the case.In the meantime victim`s elder brother has submitted another application to the incharge of concerned police station with a copy to the SP of the district along with the bail rejection order, requested them to take strong steps and arrest the main culprits but the police authorities are not paying any heed to the complaints.
Please tell me what the victim should do now in order to have a safe living and to put the culprits behind the bars. Is there any need to file any sort of petitions in the Hon`ble High Court? Is it possible to change the enquiry officer because the district administration is biased?
