Extreme harassment by neighbour, please advice

Hello Sir/Madam,

GA!! I m writing about this constant suffering of our family , Any advice/information will be highly useful in leading our daily life.

My neighbour staying next to our house who is also my aunt is almost daily harassing us (not sure if this is the right word)
She is a financier and chit fund runner of this area in bangalore. Rich in money and muscle power also. I say muscle power bcoz my other neighbour staying opposite our house is a rowdy or rather a person who is very violent and runs playing card clubs and is a close associate of my neighbour aunt.

We are first generation in our family who got educated and built a house for ourselves demolishing the 50 year old one. Problem is she is jealous that we are improving our standard of life and she always keeps shouting at us with all foul language to the extent that i have literally lost tears crying for her abusive words. She doesnt need a reason to do it. Now since we built a new house , we hve left some space towards her house and have a window facing her house, this is the same way they have for their house also.
She is taking this reason and shouting at us to close all openings from our house facing hers, in the pretext of this she uses filthy words calls my mother prostitute etc etc . she few days back was loudly telling to some visitor in her house that i had told her i am not born to my father and sometimes she shouts on the road at us very badly , she has the background of those guys in front of the house whom also most residents in the road fear. those guys use filthy language to the core among themselves while speaking in front of the house on the road.
Every day i am worried when again she will start shouting, inspite of taking troubles of building our new house, i am unable to live peacefully i sometimes feel i am always fearing when she will start off again.
while constructing house also she made baseless complaints in police station and we had to go 4-5 times, once she even complained that i threatened that i will kill her. and after going to station she will start saying only other complaints which are not linked to it. They know everyone in station through those guys in front of the house who were running playing cards and i think they cant do it without their support. i dont know if they playing cards can be proved but its the truth.

now having fed up with life of hearing abuses, many of my relatives especially women wont like to come to our house even they want to bcoz of her shoutings sometimes, and it really putting me in a very bad face when they come and if it happens.
my friend suggested me to buy a voice recorder and record them, i bought one and am recording it whn she abuses while i am at home. I have recorded it for last one month while she was abusing. will this be useful ? is there anyway to stop her from doing it with this ? she is not in talkable terms so we cant speak also.

I liked this site for few days and was going through that many kind hearted people are lending legal help or suggestion/ advice here.
I also need similar advice and I cant say by words how much difference that will make in my life, Thanks a million in advance for any suggestions in this which might help my family and tenants in the house to lead a peaceful life day by day.

Estate agent took 25000 Rs and not refunding money

Hi

I had given 25000 Rs to estate agent for transfering home to my mother name. He took 25000 Rs from me and now he is not doing work also and not refunding money also.

Can I file police complaint against him?

Can Magistrate issue arrest warrant instead of issuing Distress Warrant is there any case law on magistrate have power to issue arrest warrant.

Accident case

In an accident case one scooterist hit another scooterist due to epileptic attack. The scooterist who had epileptic symptom and with helmet died in a hospital. Since the other scooterist survived therefore he was booked under IPC 304-A,279 despite his no fault. The postmortem report did not mention anything about epileptic symptom and opined that the deceased scooterist died due to force impact. Actually, the scooterist who died had no expternal injuries but due to his back head injuries he succumbed his injuries. I would like to know the following:-

1. What is the term "Force Impact" as mentioned in the postmortem report by doctor?
2. Is a doctor while performing postmortem normally looks every aspect/cause of death or follow certain guidelines in accidental cases?
3. Was it not mandatory for doctor to mention about non wearing of helmet leading to his death since the was in back side of head?
4. Related judgement in this regard.

dowry

sir,
i am from dehra dun uttranchal.my engagement was done on 25 june.after engagement i came to know that she had some affairs in her past and she has very doubtful character. she used to drink and says that if i want post marital relationships then she doesn't care of it.when i asked to her father to break this engagement he threatned me to put my family behind bars.i have a recording of this talk in my mobile and i have her e mails that proves that she used to drink and had relationships in her past.
she is from rajasthan jaipur. now she is ready to break this engagement but her parents are not ready to talk in this matter.
please tell me what can i do. i have three options-
1. may i get anticipatry bail by moving some other juridiction because in uttranchal there is no provision for this.
2.is there any provision to declare this engagement null and void if we both(boy and girl) want.
3.i should get married to her and suffer throught my life.
please help me as soon as possible.

Surrender

Sir if one accused files surrender application before court, and court asks report from concerned police station mentioning time limit of one week for report.
whether police can arrest the accused during this period of one week.
Expecting citation and provision if any

Sec 26 Indian forest Act

Please suggest citation on Sec 26 forest Act, on the point that mere possession of forest produce is no offence and carying of wood, authorized by Village Forest panchayat out side the village is not illegal.

Sec 211 IPC

Sir,
"A" filed FIR against "B". Later "B" was acquitted by court because rest witnesses turned hostile. "A"'s followed the version of FIR and his statement under 161, in on oath Statement before court.
Now "B" has filed Application under Sec 195,340 Cr.P.C. asking taking action and punishment for under Sec 211 and 500 IPC to "A". Is it possible? if not please suggest the way and citation if any.

copy of litigation/petititon

After police fails to register an offence (eg FIR), one has to move to local magistrate (not HIGH COURT) under appropriate section for direction to file FIR. Can some one me its copy, (of their case, in which I can do necessary changes as per my case). my email is sumirdembla@yahoo.com
